A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE 2025 HAZARD REDUCTION COST REPORT AND DIRECTING THE CITY CLERK TO FILE A CERTIFIED COPY OF THE RESOLUTION AND REPORT WITH THE SAN DIEGO COUNTY AUDITOR BEFORE AUGUST 10, 2025 WHEREAS, on March 18, 2025, the City Council of the City of Carlsbad, California, approved Resolution No. 2025-066, declaring weeds growing upon or in front of certain property described in Attachment A in Carlsbad to be a public nuisance and authorized the City Clerk of the City of Carlsbad to notify property owners to abate the nuisance; and WHEREAS, on March 19, 2025, the City Clerk mailed written notices to property owners listed in Attachment A; and WHEREAS, property owners were notified that nuisances existing after May 15, 2025, are subject to abatement by the City of Carlsbad, and the cost of abatement would appear on the property tax bill; and WHEREAS, the mailed notices stated that the City Council would hear objections or protests, if any, to the proposed abatement on Tuesday, April 15, 2025, at 5 p.m. at the City of Carlsbad City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California; and WHEREAS, a public hearing was conducted in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, on April 15, 2025, at 5 p.m. to consider responses from property owners to said proposed removal of weeds, rubbish, and refuse; and WHEREAS, the City Council authorized the Superintendent to abate the nuisances declared by Resolution No. 2025-066 by having the weeds removed from the properties listed in Attachment A; and WHEREAS, the Fire Chief of the City of Carlsbad is designated to perform the duties imposed on the Superintendent by California Government Code Section 39560, et seq.; and WHEREAS, the Fire Chief directed the City to abate all remaining nuisances after May 15, 2025; and WHEREAS, California Government Code Section 39560, et seq. requires a cost report for abatement services to be submitted to the City Council for confirmation following a public hearing to consider any objections from property owners; and July 22, 2025 Item #7 Page 3 of 11 Docusign Envelope ID: 9FD4BD34-2EF8-4B57-9674-6B8C9199EFC2 WHEREAS, a public hearing was scheduled in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, on July 22, 2025, at 5 p.m. to consider and confirm the final 2025 Hazard Reduction Cost Report. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.That the City Council has determined the proposed action to approve the 2025 Hazard Reduction Cost Report is categorically exempt from environmental review under CEQA Guidelines Section 15321(a) because it involves the enforcement of a law, general rule, standard, or objective administered or adopted by the city. No exception to the exemptions as set forth in CEQA Guidelines section 15300.2 or the Carlsbad Municipal Code Section 19.04.070 (C) applies. 3.That this resolution, and all action subsequently taken in connection with it, is taken pursuant to the provisions of California Government Code Section 39560, et seq. (Alternate Procedures for Weed and Rubbish Abatement). 4.That a public hearing was held in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, on July 22, 2025, at 5 p.m. to consider and confirm the final 2025 Hazard Reduction Cost Report. 5.That all protests and objections, other than those allowed and deleted from said report, if any, are hereby overruled and denied. 6.That the report is confirmed and each of the amounts set forth herein is hereby assessed against the parcel of real property and shall constitute a special assessment and a lien against such parcel of land. 7.That the City Clerk is hereby directed to forward a certified copy of this resolution with said report to the Office of the San Diego Auditor and Controller by August 10, 2025.
