I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6136 and 6137 APPROVING Conditional Use Permit CUP 05-31 and Special Use Permit SUP 06-01 based on the findings and subject to the conditions contained therein. II. INTRODUCTION The proposed project consists of a Conditional Use Permit (CUP 05-26) and Special Use Permit SUP 06-01 for the demolition of the existing Chevron fuel station and the development of a new fuel station to include a 2,793 square foot convenience store and five fuel pumps under a 3,472 square foot canopy. The site was previously developed as fueling station and auto repair center. The property is zoned Local Shopping Center (C-L) and the General Plan Land Use designation is Local Shopping Center (L). The project site however, is not part of an existing shopping center and was developed prior to the centers development. This site was originally approved in 1969 and developed in 1970, prior to the shopping center which was developed in 1975. There is internal access between the shopping center and the project site via cross access agreements. The project complies with City standards and all necessary findings can be made for the approval being request"ed. The Planning Commission is the final decision making body for this project. III. PROJECT DESCRIPTION AND BACKGROUND Background and Project Description The proposed project will include the demolition of the existing Chevron fuel station, and removal of the existing underground tanks. Currently there are four ingress and egress driveways on Haymar Drive and El Camino Real. The westerly driveway on Haymar Drive will be closed with the proposed project leaving three of the existing driveways. The project site will maintain internal access to the existing Von's shopping center surrounding the project to the east and south. To the north of site is Highway 78 and to the west is the Plaza Camino Real regional shopping center. CUP 05-26/SUP 06-01-CHE,RON SERVICE STATION #09-1312. July 19, 2006 Pae 2 The new fuel station will include a 2,793 square foot convenience market that will sell coffee and fountain drinks, beer and· wine if the appropriate Alcohol and Beverage Control (ABC) license can be obtained, as well as snacks, pre-packaged food items, and other convenience items. Other project components include five fuel pumps for a total of ten fueling stations under a 3,472 square foot canopy and an air and water station. The building and the fuel pump canopy have a Spanish style of architecture consistent with the "Old California" design theme of the El Camino Real Development Standards. IV. ANALYSIS The project is subject to the following plans, ordinances, and standards: A. Local Shopping Center (L) General Plan Land Use designation; B. Local Shopping Center Zone (C-L) (Chapter 21.31 of the Carlsbad Municipal Code); C. Conditional Uses (Chapter 21.42 of the Carlsbad Municipal Code); D. Parking Ordinance (Chapter 21.44 of the Carlsbad Municipal Code); E. El Camino Real Corridor Development Standards; and F. Growth Management Ordinance (Chapter 21.90 of the Carlsbad Municipal Code). The recommendation for the approval of this project was developed by analyzing the project's consistency with all applicable regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. Chapter 21.42) Approval of a CUP requires the adoption of findings found in Chapter 21.42 of the Carlsbad Municipal Code (C.M.C.). The findings required by the C.M.C. can be supported. The requested use is desirable for the development of the community because it will replace the existing Chevron fuel station. The project is essentially in harmony with the various elements and objectives of the General Plan as discussed above in the General Plan section of this report. The project is not detrimental to existing uses specifically permitted in the zone in which the proposed use is located because the site is physically separated from other properties so it will not have a direct physical impact to other commercial, industrial, or residential developments in. the area. The site for the intended use is adequate in size and shape to accommodate the fuel pumps and convenience market without the need for a variance from the development standards of the C-L Zone or the El Camino Real Corridor Development Standards. CUP 05-26/SUP 06-01-CH,RON SERVICE STATION #09-1312 - July 19, 2006 Pae 5 All the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained. The site will be landscaped consistent with the Carlsbad Landscape Manual and the guidelines of the El Camino Real Corridor Development Standards including the use of London Plane trees and six foot width planter areas and planting adjacent to the building. The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. The project will generate approximately 1,600 Average Daily Traffic (ADT). This is a reduction of 260 ADT from the existing 1,860 ADT generated by the existing fuel station. The proposed project will reduce the intensity of the use of the site through the reduction of one fuel pump. Primary access to the site will come from El Camino Real which is a prime arterial street capable of adequately handling the amount of traffic that the proposed project is expected to generate. The project consists of the redevelopment of an existing fuel station which is integrated with and accessible to the adjacent community shopping center. D. Parking Ordinance (C.M.C. Chapter 21.44) Onsite parking for the convenience market is required at a ratio of one parking space for every 300 square feet of gross retail building area. The convenience market building is 2,793 square feet and the total number of onsite parking spaces required is ten. The project is providing eleven parking spaces on site. The project complies with the onsite parking requirements of the Parking Ordinance. E. Special Use Permit and El Camino Real Corridor Development Standards (ECRCDS) Special Use Permits are required whenever a site is located within a Scenic Preservation Overlay Zone. The proposed application is located within the El Camino Real Scenic Corridor Overlay Zone. The El Camino Real Corridor Development Standards (ECRCDS) are intended to maintain and enhance the appearance of the roadway by setting standards for setbacks, signs, building height, grading, and design theme. The document is also intended to further the goals of the Land Use and Circulation Elements of the General Plan and the objective of preserving unique city resources as they relate to scenic highways. To meet these objectives, the ECRCDS include design guidelines as well as specific standards. The project's compliance with specific standards is depicted in Table 3 below. Growth Management Ordinance The proposed project is located within Local Facilities Management Zone 2 in the northeast quadrant of the City. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table 4 below. ENVIRONMENTAL REVIEW The project qualifies as a CEQA Guidelines Section 15302 (Replacement or Reconstruction) Class 2 Categorical Exemption from CEQA. The project consists of the replac~ment of a commercial structure with a new structure of substantially the same size, purpose and capacity. The project is exempt from further environmental documentation pursuant to Section 15302 of the State CEQA guidelines.
