The project site, an approximately 0.41-acre (17,860-square-foot) lot, currently is developed with a 3,356-square-foot single family residence and 919- square-foot detached building containing a three-car garage, workshop, and storage room. The garage/workshop/storage building is detached from the main residence but shares an approximately 4- foot-wide covered breezeway between the structure. Vehicular access is provided off Buena Vista Drive. The project proposes the construction of a second story 821-square-foot accessory dwelling unit with a 201-square-foot patio above the existing detached garage/workshop/storage building. The garage/workshop/storage building with second level ADU is proposed at 24-feet-3-inches tall. No changes are proposed to the existing building footprint. In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. This preliminary review does not represent an in-depth analysis of your project. It is intended to give you feedback on critical issues based upon the information provided in your submittal. This review is based upon the plans, policies, and standards in effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. General Plan and zoning designations for the property are as follows: a. General Plan Land Use Designation: R-4, Residential (0-4 dwelling units per acre) b. Zoning: One-Family Residential (R-1) Zone. c. Coastal Zone: The project site is located within the Coastal Zone and is subject to the Mello II Segment of the Local Coastal Program (LCP). The LCP Land Use and Zoning are consistent with the City's General Plan Land Use and Zoning for the site. The property is located within the California Coastal Commission's Appeals Jurisdiction. PRE 2025-0031 (DEV2025-0039) -BEIM ADU August 1, 2025 Pa e 2 2. The project requires the following permits: a. Minor Coastal Development Permit (CDP). A Minor CDP is required for all AD Us in the Appeals Jurisdiction of the Coastal Zone. b. Building Permit. 3. Coastal Zone. This property is subject to all applicable Mello II Segment policies in the Local Coastal Program (LCP). The property is in the Permit Appeals Jurisdiction. The Coastal Commission or another party may appeal the City's decision on the project if they disagree with the City's interpretation of standards applied to the project. 4. Site Plan. On a formal application submittal, please dimension all property lines. The latest aerial imagery shows two structures located on the driveway. Please identify and dimension these structures on the plans. 5. ADU Location and Height. Detached accessory dwelling units (ADUs) are limited to one story and a maximum height of 16 feet, unless they are constructed above or below a detached garage. In such cases, the ADU may exceed the 16-foot height limit but must comply with the applicable height limits of the zone. However, the ADU is still limited to one story above or below the one-story garage. As the proposed ADU is considered detached from the main residence, it may only exceed 16 feet in height if it is located above a detached garage. The height limit in the R-1 zone is 30 feet if a minimum 3:12 roof pitch is provided or 24 feet if less than a 3:12 roof pitch is provided. As the submitted roof plans show a 5:12 pitch, the ADU may be permitted at a height up to 30 feet if it is above a detached garage space only. Pursuant to the Carlsbad Municipal Code section 21.04.150, a private garage is defined as "An accessory building or an accessory portion of the main building, enclosed on all sides and designed or used only for the shelter or storage of vehicles owned or operated by the occupants of the main building." The portion of the ADU proposed above the workshop and storage room is not permitted. Please revise. Please note, although the garage/workshop/storage building roof is connected to the main residence by a breezeway, the structure is still considered a detached accessory structure under CMC Section 21.04.020, which defines "accessory" as "a building, part of a building or structure, or use that is subordinate to and the use of which is incidental to that of the main building, structure or use on the same lot. If an accessory building is attached to the main building by a common wall, with a width dimension of at least three feet and a height dimension of at least one story, such building area is considered a part of the main building and not an accessory building or structure, except for "accessory dwelling units" or ''junior accessory dwelling units" as defined in Sections 21.04.121 and 21.04.122. Accessory dwelling units and junior accessory dwelling units that comply with the PRE 2025-0031 (DEV2025-0039) -BEIM ADU August 1, 2025 Pa e 3 requirements of Section 21.10.030 and California Government Code Sections 65852.2 (effective Jan. 1, 2023} and 65852.22 (effective Jan. 1, 2023}, respectively, are considered accessory. 6. Parking. Pursuant to Government Code §65863.2(a), parking is not required for the proposed ADU as the project site is located within one-half mile of a major transit stop (Carlsbad Village Station). 7. Architecture. On a formal submittal, the plans should demonstrate that the ADU shall have the same architectural finishes and features as the main duplex units including the exterior roofing, trim, walls, windows, and color palette. Land Development Engineering: 1. Complete a Stormwater Standards Questionnaire Form E-34. This questionnaire will guide you and the city in determining what type of reports and storm water mitigation must be completed to satisfy state and City storm water quality requirements. The questionnaire is located on the City of Carlsbad website. 2. Based on a preliminary analysis it appears that this project will be a Standard Project. Complete the Standard Project Requirement Checklist, Form E-36, and show all source and site design BMPs on the conceptual grading and drainage plans. 3. Provide a Preliminary Title Report (current within the last six (6) months). 4. Annotate and delineate all existing easements and encumbrances listed in the Preliminary Title Report on the site plan. If any vacations or quitclaims are planned with this development annotate on the site plan. 5. Please be advised that a more in-depth review of the proposed development will occur with the discretionary permit application when a more complete design of the project is provided. Building Division: 1. Structural calcs, truss calcs, geotechnical report and other requirements will be required at building plan submittal and plan review. Fire Department: No comments. Single-family residences located in subdivisions with 10 or more single-family residences and where the § 110.IO(a)1: applicatior1 for a tentative subdivision map for the residences has been deemed complete and approved by the enforcement agency, which do not have a ohotovoltaic svslem installed, must comolv with the reauirements of & 110. tOfbl-/el. Minimum Solar Zone Area. The solar zone must have a minimum total area as described below. The solar zone must comply with access, pathway, smoke ventilation, and spacir1g requirements as specified in Title 24, Part 9 or other parts of Title 24 or in any requirements adopted by a local jurisdiction.
