The construction, addition, or alteration of buildings is governed by the California Contractors License Law
(commencing with Business Professions Code section 7000). The law has an exemption that allows a person
who is not a California Licensed Contractor to construct a single-family residential structure and engage in
home improvements and repairs, provided they meet certain requirements. (Form B-61 provides information
about the requirements that apply to Owner-Builders makes you aware of your responsibilities and possible
risk you may incur by having a permit issued to an Owner-Builder.) Permits for multi-family projects are only
to be issued to California Licensed Contractors. Refer to Form B-16 for other frequently asked questions.

subject of this application.
܆ I/We understand that State law mandates the Applicant to provide an estimated value of all work
proposed (B-29 form). I/We hereby certify the construction valuation provided is accurate and
includes all proposed work such as all structural work, finish work, painting, roofing, electrical,
plumbing, heating, air conditioning, elevator, labor costs, and all permanent equipment and systems.
If the valuation is underestimated, the permit may be denied, unless the Applicant can show detailed
estimates to meet the approval of the Building Official.
܆ If the Applicant is not the Property Owner, both the Property Owner and Applicant (authorized
Contractor or authorized Agent of the Property Owner/Contractor) must sign below. By signing this
declaration, the Property Owner authorizes the Applicant listed in this application to act as the
Property Owner’s Agent on all matters before the city pertaining to development on this property.
܆ I/We understand that State law requires construction to be done by a Licensed Contractor and the
Property Owner may apply for an Owner-Builder permit under an exemption from the law.
܆ A. If the Contractor is the Applicant, the License Contractor Declaration on page 4
must be completed.
܆ B. If the Applicant is an Owner-Builder, an Owner-Builder affidavit is required and
must be submitted (Form B-61). The city will not issue a building permit until this form
has been submitted. The License Contractor Declaration on page 4 does not need to
be submitted.
܆ I/We have read this application form in its entirety and reviewed the building permit application and
the information I/we have provided is true and correct to the best of our knowledge. Grade lines as
shown on drawings accompanying this application are assumed to be correct. This certifies that the
description of the project and all the plans and supporting documentation; including the location and
labeling of all existing and proposed buildings, structures, access roads, and utilities and easements;
are accurate in all material respects as of the date when made. I/We understand that it is my
responsibility to ensure that statements and representations are not misleading. I/We agree to
promptly remove, correct, or add information as needed to correct any misleading or materially
inaccurate information. I/We understand that any misstatement or omission of the requested
information or of any information subsequently requested might be grounds for rejecting the

܆ I/We certify that I am (we are) aware of all permit requirements and will not willfully deviate from the
approved plan. I/We agree to comply with all applicable city and county ordinances and state laws
relating to building construction. I/We assume full responsibility for the satisfactory completion of all
work authorized under the permit(s), including work performed prior to assuming control.
܆ After construction begins, I/we understand that a height certification, pad certification, or boundary
certification may need to be submitted to the Building Inspector, when required.
܆ I understand that a building permit application will expire If a permit has not been issued/obtained
within one year from the application date (original filing date), unless an extension of time has been
granted (Form B-25). With some limited exceptions, if a building permit application expires and there
is interest in proceeding with the same project, a new application will be required and the project will
be subject to new fees and regulations that are in effect at the time the new application is submitted.
܆ After submitting the application, the Billing Party designated as part of the application will be sent
future city invoices for above referenced building permit(s). I understand that if a permit fee or
development impact fee refund is issued, the check will be mailed to the financial responsible party
(the actual person or company that paid the invoice). If the information on file for the financially
responsible party is outdated or inaccurate, it must be corrected before the refund can be sent. Form
B-49B may be completed to update the financially responsible party’s contact information.
܆ I/We agree to waive, release, and discharge the City of Carlsbad ("City") and its officers, elected or
appointed officials, employees, volunteers and agents (the "Indemnified Parties") from all claims and
demands, rights and causes of action of any kind with respect to the building permit application, the
purpose of which is to challenge, attack set aside, void, modify, or annul the approval or denial of the
application, or the processing thereof, except liability caused by the Indemnified Parties’ sole
negligence or willful misconduct, in which case the indemnity received by the city shall be reduced by
the amount: (a) that the city’s active negligence contributed to the liability on a comparative basis; or
(b) such other amount as may be required by law. This obligation is effective without reference to the
existence or applicability of any insurance coverages which may have been required by city or any
additional insured endorsements which may extend to Indemnified Parties. Property Owner(s) and
Applicant, on behalf of themselves and all parties claiming under or through them, waive all rights of
subrogation and contribution against the Indemnified Parties while acting within the scope of their
duties, from all claims, losses and liabilities arising out of or incident to activities or operations

Bathroom Remodel Code Requirements:
1.Indoor Water Use – New/replacement plumbing fixtures must be water conserving: water closets max 1.28 gallons/flush,shower heads 1.8 gpm, multiple shower heads serving one shower- combined flow rate of 1.8 gpm, lavatory faucets 1.2gpm) [CGBSC 4.303]
2.Electrical Requirementsa.A minimum of one 20-amp circuit is required for bathrooms. This circuit shall not contain other outlets, except, where the
20-amp circuit supplies a single bathroom. Outlets for other equipment within the same bathroom shall be permitted to be
supplied in accordance with CEC 210.23(A)(1) and (A)(2).
b.At least one electrical outlet shall be installed within 36” of the outside edge of each bathroom sink basin and be located on
the wall adjacent to the sink, on the countertop or installed on the side or face of the basin cabinet not more than 12” below
the countertop.
3.Mechanical Requirementsa.Back draft dampers are required on bathroom ventilation fans. Ventilation fans must vent through an approved duct andshall terminate 3’ from an opening or property line.b.Each bathroom containing a bathtub or shower shall have an exhaust fan with humidity control.c.Each bathroom that contains a bathtub, shower, or similar source of moisture shall have an exhaust fan ducted to the outsidewith a minimum ventilation rate of 50 cfm. The ducting shall be sized according to ASHRAE Standard 62.2 Table 7.1. Fansshall be switched separately from lighting.d.No electrical fixtures located within a zone measured 3’ horizontally and 8’ vertically from the top of the bathtub rim orshower dam.e.Recessed lighting at a bathtub shall be suitable for damp locations. When located in showers it shall be suitable for wetlocations. A solid lens cover shall be provided.
4.Lighting Requirementsa.Bathroom lighting shall be high efficacy. A vacancy sensor shall control at least one luminaire. Low efficacy lighting is notpermitted. Refer to the 2019 CEnC.b.Recessed luminaires installed in an insulated ceiling shall be I.C. rated and A.T. shall be sealed and/or gasket betweenceiling and housing.
5.Plumbing/ Glazing Requirementsa.Shower stalls shall be a minimum finished interior area of 1,024 square inches and encompass a 30” diameter circle.Shower doors shall swing out of the enclosure and have a minimum clear opening of 22”. (CPC 408.6)b.Shower stalls and bathtubs with showerheads installed, shall have walls finished with a non-absorbent surface for aminimum of 6’ (72”) above the floor. (CRC R307.2)c.Water closets are required to be minimum 15” from center to wall; 24” clear in front of toilet.d.Maximum three water closets on a 3” line.e.Provide 12”x12” min. access to slip joint trap and whirlpool tub motor.f.Showers and shower-tubs shall be provided with individual control valves of the pressure balance, thermostatic, orcombination pressure balance/thermostatic mixing valve type that provide scald and thermal shock protection.g.Provide a removable panel for the whirlpool bathtub pump. The panel shall be large enough to access and remove thepump. The pigtail receptacle shall face the access door.h.Any glazing that is within 5’ of a shower, bathtub, or Hydro massage tub with the bottom edge of the glazing located lessthan 60”above the floor shall be safety glazing (i.e. tempered glass) (CRC R308.4.5)i.Lavatories without overflow outlets shall have a strainer installed in lieu of a stopper.
6.SB407 Requirements - All existing non-compliant plumbing fixtures for all residential buildings built and available for useon or before January 1, 1994 must be replaced with water conserving plumbing fixtures. (Noncompliant = Tank-type toilets
1.6 gallons/flush, shower heads 2.5 gpm, faucets 2.2 gpm) [CGBSC 4.303.1]
7.Smoke and Carbon Monoxide Alarms - Kitchen renovations will require smoke and carbon monoxide detectors inconformance with the CRC Section R314 & R315. Smoke detectors are required in each sleeping room, outside of each
sleeping area in the immediate vicinity of the bedrooms, and on each story. Smoke detectors shall be installed a maximum of12 inches vertically down from the highest point of the ceiling and a minimum of 3 feet horizontally from a supply register or
the tip of a ceiling fan blade. Carbon Monoxide detectors are required on each level and outside of the sleeping rooms andinside every room that contains gas appliances. New detectors shall be hardwired, with battery backup and interconnected.
Exception: detectors can be battery operated with 10-year life batteries in existing construction if their installation requiresthe removal of wall or ceiling coverings.
