This TCO is official authorization permitting the opening of this establishment to serve WKHJHQHUDOSXEOLF, prior to issuance of a final Certificate of Occupancy. Temporary occupancy is granted for a period of 30 days, from JULY 30, 2025 through AUGUST 30, 2025, on the condition that the permit holder and operator agree that the following conditions and schedule of interim requirements and dates of completion are satisfied. 1.This Temporary Certificate of Occupancy (TCO) allows “public use.” 2.Prior to requesting a final Certificate of Occupancy, the non-complaint ADA parking accommodations and accessible path of travel must be corrected as per Building Department corrections. 3.The property owner, permit holder, and operator agree to indemnify, defend, and save free and harmless the City of Carlsbad, its officers, agents, employees, and representatives (“Indemnified Parties”) from and against any and all claims, demands, losses, actions, or causes of action which may be asserted, prosecuted or established against them, or any of them, in whatever kind or nature, arising out of or attributable to, or in any manner connected with the temporary occupancy. Property owner, permit holder, and operator, on behalf of themselves and all parties claiming under or through them, waive all rights of subrogation and contribution against the Indemnified Parties while acting within the scope of their duties, from all claims, losses and liabilities arising out of or incident to activities or operations performed while the TCO remains effective, regardless of any prior, concurrent or subsequent passive negligence by the Indemnified Parties. The property owner, permit holder, and operator further acknowledge that the issuance of a TCO requires that completion of construction be done in a timely manner and that all utilities may be turned off for any hazardous conditions or for not completing the construction permitted. 4.Prior to engaging in business activity, the operator will obtain and secure a business license from the City of Carlsbad. This TCO is being issued in absolute good faith and in a spirit of settlement and compromise, with the schedule of compliance dates leading to permanent occupancy and compliance with the permits and approvals granted by the city to avoid hazards to life or property. FAILURE TO OBTAIN CITY APPROVAL FOR THE COMPLETED WORK BY THE ABOVE-LISTED COMPLETION DATES shall cause a forfeiture of any right for continued temporary use and the TCO will be revoked with notice in writing pursuant to Carlsbad Municipal Code Section 18.04.045. Occupancy of a building without a TCO or permanent certificate of occupancy may result in enforcement action, including a notice of violation, citations, an order to cease the unlawful occupancy of a building or portion thereof, an order to vacate the building, and any other remedies provided in Chapters 1.08 and 1.10 of the Carlsbad Municipal Code.
