ANNOUNCEMENT OF CONCURRENT MEETINGS: None. PLEDGE OF ALLEGIANCE: Council Member Shin led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Regular Meeting held May 13, 2025 Minutes of the Regular Meeting held May 20, 2025 Minutes of the Regular Meeting held June 10, 2025 Minutes of the Special Meeting held June 24, 2025 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: Recognition of a donation from the Friends of the Carlsbad Library Deputy Library Director Sheila Crosby introduced Friends of the Carlsbad Library Member Taffy Cannon who presented the City Council with the donation and said a few words. Recognition of a donation from the Carlsbad Friends of the Arts Cultural Arts Manager Craddock Stropes introduced Carlsbad Friends of the Arts Board of Directors Members Liz Lichtenberger and Amanda Ecoff, who presented the City Council with the donation and said a few words. Proclamation in Recognition of the 250th Anniversary of the United States Army Council Member Shin presented the proclamation to Lieutenant Colonel Edgardo Alvarez who said a few words. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced that there was no reportable action. PUBLIC COMMENT: Mary Lucid spoke on accountability and the utilization of volunteers at the Senior Center. Buena Vista Audubon President Patti Langen expressed her support for the California Coastal Commission’s initiation of enforcement proceedings against John C. Levy related to public beach access, native vegetation and bird habitats. Martin Danner expressed his concerns with City of Carlsbad first responders living outside of city limits. James Watson expressed his concern regarding the use of illegal fireworks in Carlsbad. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item Nos. 1 through 8. Motion carried unanimously, 5/0. 1. REPORT ON CITY INVESTMENTS AS OF MAY 31, 2025 – Accept and file Report on City Investments as of May 31, 2025. (Staff contact: Christian Peacox, City Treasurer and Zach Korach, Administrative Services) Mary Lucid expressed her concern with service fees and the training of staff at the Senior Center. 2. ESTABLISH FISCAL YEAR 2025-26 SPECIAL TAXES FOR COMMUNITY FACILITIES DISTRICT NO. 1 Adoption of Resolution No. 2025-159 establishing the fiscal year 2025-26 special taxes for Community Facilities District No. 1. DONATION FROM THE FRIENDS OF THE CARLSBAD LIBRARY – Adoption of Resolution No. 2025-160 accepting a donation of $100,000 from the Friends of the Carlsbad Library to the City of Carlsbad’s Library & Cultural Arts Department. DONATION FROM THE CARLSBAD FRIENDS OF THE ARTS – Adoption of Resolution No. 2025-161 accepting a donation of $25,000 from the Carlsbad Friends of the Arts to the City of Carlsbad’s Library & Cultural Arts Department. LOAN AGREEMENT AND LEASE AMENDMENT WITH NEW VILLAGE ARTS – Adoption of Resolution No. 2025-162 approving a loan agreement in the amount of $500,000 and a first amendment to the lease agreement with New Village Arts, Inc. for the city-owned property at 2787 State Street, authorizing the City Manager to execute the loan agreement and first amendment to the lease agreement, and appropriating $500,000 from the General Fund Reserve. (Staff contact: Curtis Jackson, Community Services) 6. AGREEMENT WITH MAN-K9 INC. FOR POLICE CANINE MAINTENANCE AND TRAINING SERVICES Adoption of Resolution No. 2025-163 authorizing the City Manager or designee to approve an agreement with Man-K9 Inc. for police canine maintenance and training services in an amount not to exceed $45,000 per agreement year. ADVERTISE FOR BIDS FOR PHASE 2 OF THE BARRIO STREET LIGHTING PROJECT, CIP PROJECT NO. 4013 Adoption of Resolution No. 2025-164 adopting the plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for Phase 2 of the Barrio Street Lighting Project. (Staff contact: Brandon Miles, Public Works) Ana Stout expressed her concern regarding commercial lighting extending into the residential area of the Barrio. 8. TERMINATION OF THE DECLARATION OF EXISTENCE OF AN EMERGENCY CONDITION IN THE KELLY DRIVE CHANNEL, CIP PROJECT NO. 6606 – Adoption of Resolution No. 2025-165 terminating the declaration of the existence of an emergency condition in the Kelly Drive Channel. CS-497 – INSTALLING STOP SIGNS ON KELLY DRIVE AT THE INTERSECTIONS AT PARK DRIVE AND HILLSIDE DRIVE – Adoption of Ordinance No. CS-497 amending Title 10, Chapter 10.28 of the Carlsbad Municipal Code to amend Sections 10.28.993 and 10.28.994 and add Section 10.28.998 to establish all-way stop control on Kelly Drive at the intersections at Park Drive and Hillside Drive. (Staff contact: Morgen Fry, City Clerk) City Manager’s Recommendation: Adopt Ordinance No. CS-497. FISCAL YEAR 2025-26 FINAL ENGINEER’S REPORT AND ANNUAL LEVY OF ASSESSMENTS IN STREET LIGHTING AND LANDSCAPING DISTRICT NO. 1 – 1) Hold a public hearing, and 2) Adoption of Resolution No. 2025-166 confirming the diagram and assessment amounts of Street Lighting and Landscaping District No. 1, a special assessment district, and authorizing the levy of the district’s annual assessment for fiscal year 2025-26. (Staff contact: Katie Schroeder, Administrative Services) City Manager’s Recommendation: Take public input, close the public hearing and adopt the resolution. FISCAL YEAR 2025-26 FINAL ENGINEER’S REPORT FOR THE ANNUAL LEVY OF ASSESSMENTS WITHIN STREET LIGHTING AND LANDSCAPING DISTRICT NO. 2 – 1) Hold a public hearing, and 2) Adoption of Resolution No. 2025-167 confirming the diagram and assessment amounts for Street Lighting and Landscaping District No. 2, a special assessment district, and authorizing the levy of the district’s annual assessment for fiscal year 2025-26. UPDATED SAN DIEGO HUMANE SOCIETY USER FEES FOR ANIMAL CONTROL AND REGULATION 1) Hold a public hearing; and 2) Adoption of Resolution No. 2025-168 adopting the San Diego Humane Society’s updated user fees for the recovery of costs related to animal control and regulation services. (Staff contact: Ryan Opeka and Reid Shipley, Police) City Manager’s Recommendation: Take public input, close the public hearing and adopt the resolution. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 13. PROCESSING PRIVATELY INITIATED APPLICATIONS TO AMEND THE CITY’S GENERAL PLAN AND ZONING DESIGNATIONS TO ALLOW FOR NEW RESIDENTIAL DEVELOPMENT ON PROPERTIES NOT INCLUDED IN THE HOUSING ELEMENT REZONING PROGRAM – Adoption of a resolution directing the City Manager to process privately initiated applications that amend the city’s General Plan and/or zoning designations to allow for new residential development on properties not included in the city’s 2021- 2029 Housing Element rezoning program following the city’s standard processes (Staff contact: Jeff Murphy, Community Services) City Manager’s Recommendation: Adopt the resolution. Community Development Director Jeff Murphy, Assistant Director of Community Development Mike Strong and City Planner Eric Lardy reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Mayor Blackburn clarified that the definition of “expedited” in this context does not mean that privately initiated applications are prioritized over other applications for approval, but as a way to confirm to applicants whether they should continue the application process for approval. Minute motion by Mayor Blackburn, seconded by Mayor Pro Tem Bhat-Patel, directing staff to process applications using the expedited permit review process with additional direction to staff not to include an automatic recommendation of denial. Motion carried unanimously, 5/0. 14. TRAFFIC SAFETY & MOBILITY COMMISSION WORK PLAN FOR FISCAL YEAR 2025-26 – Adoption of Resolution No. 2025-169 approving the Traffic Safety & Mobility Commission Work Plan for fiscal year 2025-26. (Staff contact: Nathan Schmidt, Public Works) City Manager’s Recommendation: Adopt the resolution. Transportation Planning & Mobility Manager Nathan Schmidt reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Traffic Safety & Mobility Commission Chair Josh Coehlo provided comments to the City Council. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2025-169. TYLER STREET SIDEWALK IMPROVEMENT PROJECT, CIP PROJECT NO. 6103 – Adoption of Resolution No. 2025-170 approving the conceptual plan for Capital Improvement Program Project No. 6103, renaming the project title to the Tyler Street Sidewalk Improvement Project and authorizing the City Manager or designee to proceed with its final design and engineering. (Staff contact: Nathan Schmidt, Public Works) City Manager’s Recommendation: Adopt the resolution. Transportation Planning & Mobility Manager Nathan Schmidt reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Matt Hall expressed his support for the Tyler Street Sidewalk Improvement Project and thanked staff for their efforts. Motion by Council Member Burkholder, seconded by Mayor Pro Tem Bhat-Patel, to adopt Resolution No. 2025-170. Motion carried unanimously, 5/0.
