Executive Summary The 2025 Concrete Repair Project, Capital Improvement Program Project No. 6013-25, will replace damaged concrete sidewalks, curbs and gutters, and install Americans with Disabilities Act-compliant curb ramps throughout the city. A list of streets included in this project is provided in Exhibit 2. This project is part of the city’s ongoing Concrete Repair/Replacement Program, Project No. 6013. Staff request that the City Council accept the bids and award a contract for the project to Aster Construction Services, Inc., or Aster Construction, in an amount not to exceed $950,019. Carlsbad Municipal Code Section 3.28.080(C) requires the city to use formal bidding procedures for construction contracts when the value exceeds $220,000 and Section 3.28.080(I)(6) designates the authority to award such contracts to the City Council. Explanation & Analysis The City Council adopted the project’s plans, specifications and contract documents May 20, 2025, authorizing the City Clerk to advertise for construction bids. (Resolution No. 2025-112) The project was then advertised using the city’s formal bidding procedures. Staff received four bids for construction of the project on June 25, 2025. Staff determined that Aster Construction was the lowest responsible bidder, with a responsive bid in an amount not to exceed $950,019. Aster Construction was found to be responsive because its bid meets the requirements of the bidding documents and responsible because it submitted a list of similar projects to show its capability and qualification to perform the specified work. Next Steps Once the City Council accepts the bids and awards the construction contract to Aster Construction, staff will issue a purchase order, schedule a pre-construction meeting with the contractor and issue a notice to proceed for construction of the project, which is expected to commence in late 2025. The duration of the construction contract is three months, not including rainy days and delays from change orders that may extend the project’s duration. Upon successful completion of the project, which is expected to be in early/mid-2026, a notice of completion will be recorded to release bonds issued for the project. Environmental Evaluation The proposed action for replacement of damaged concrete sidewalks, curbs and gutters, ADA- compliant curb ramps, driveway approaches and cross-gutters is categorically exempt from environmental review under the California Environmental Quality Act, or CEQA, Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. FOR THE 2025 CONCRETE REPAIR PROJECT IN AN AMOUNT NOT TO EXCEED $950,019 WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to replace damaged and unusable concrete sidewalks, curbs and gutters, Americans with Disabilities Act, or ADA, -compliant curb ramps, driveway approaches and cross-gutters, as part of the city’s Concrete Repair/Replacement Program; and WHEREAS, on May 20, 2025, the City Council adopted Resolution No. 2025-112, adopting the plans, specifications and contract documents and authorizing advertisement of the 2025 Concrete Repair Project, Capital Improvement Program, or CIP, Project No. 6013-25, or Project, for construction bids; and WHEREAS, on June 25, 2025, staff received four bids for construction of the Project; and WHEREAS, Aster Construction Services, Inc. submitted the lowest responsive bid in an amount not to exceed $950,019, and staff determined Aster Construction Services, Inc. is a responsible bidder; and WHEREAS, the Project is funded with Gas Tax and Road Maintenance and Rehabilitation Account funds; and WHEREAS, sufficient funding is available to complete the Project; and WHEREAS, Carlsbad Municipal Code, or CMC, Section 3.28.080(C) requires the city to use formal bidding procedures for construction contracts when the value exceeds $220,000 and Section 3.28.080(I)(6) designates the City Council as the awarding authority for such contracts and therefore the Project is subject to these requirements; and WHEREAS, CMC Sections 3.28.040(C)(5) authorizes the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of contract award, which is $191,000 for the Project. That the City Council has determined that the proposed action for replacement of damaged concrete sidewalks, curbs and gutters, ADA-compliant curb ramps, driveway approaches and cross-gutters, is categorically exempt from environmental review under the California Environmental Quality Act, or CEQA, Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies.
