HomeMy WebLinkAbout2025-09-09; City Council; Resolution 2025-196Exhibit 1 RESOLUTION NO. 2025-196 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE BIDS AND AWARDING A CONTRACT TO ASTER CONSTRUCTION SERVICES, INC. FOR THE 2025 CONCRETE REPAIR PROJECT IN AN AMOUNT NOT TO EXCEED $950,019 WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to replace damaged and unusable concrete sidewalks, curbs and gutters, Americans with Disabilities Act, or ADA, -compliant curb ramps, driveway approaches and cross-gutters, as part of the city’s Concrete Repair/Replacement Program; and WHEREAS, on May 20, 2025, the City Council adopted Resolution No. 2025-112, adopting the plans, specifications and contract documents and authorizing advertisement of the 2025 Concrete Repair Project, Capital Improvement Program, or CIP, Project No. 6013-25, or Project, for construction bids; and WHEREAS, on June 25, 2025, staff received four bids for construction of the Project; and WHEREAS, Aster Construction Services, Inc. submitted the lowest responsive bid in an amount not to exceed $950,019, and staff determined Aster Construction Services, Inc. is a responsible bidder; and WHEREAS, the Project is funded with Gas Tax and Road Maintenance and Rehabilitation Account funds; and WHEREAS, sufficient funding is available to complete the Project; and WHEREAS, Carlsbad Municipal Code, or CMC, Section 3.28.080(C) requires the city to use formal bidding procedures for construction contracts when the value exceeds $220,000 and Section 3.28.080(I)(6) designates the City Council as the awarding authority for such contracts and therefore the Project is subject to these requirements; and WHEREAS, CMC Sections 3.28.040(C)(5) authorizes the City Manager or designee to approve change orders in an amount equal to the contingency set at the time of contract award, which is $191,000 for the Project. Sept. 9, 2025 Item #4 Page 4 of 7 Docusign Envelope ID: F3F1E5AE-E0AC-471F-B045-D12E652E2D75 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2. That the City Council has determined that the proposed action for replacement of damaged concrete sidewalks, curbs and gutters, ADA-compliant curb ramps, driveway approaches and cross-gutters, is categorically exempt from environmental review under the California Environmental Quality Act, or CEQA, Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or CMC Section 19.04.070(C) apply. 3.That the lowest responsible and responsive bid of $950,019 submitted by Aster Construction Services, Inc. for construction of the 2025 Concrete Repair Project, CIP Project No. 6013-25, is accepted, and the Mayor is authorized to execute the contract for the Project. 4.That the City Manager or designee is authorized to approve construction change orders up to $191,000 for the Project. 5.That the City Manager or designee is authorized to sign all other documents necessary for regulatory compliance, to extend funding opportunities, or to otherwise implement and finalize the Project, all of which are subject to review and approval as to form by the City Attorney’s office. 6.That the award of this contract is contingent upon Aster Construction Services, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 calendar days after adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies.
