Receive a report on Proposition 28 from a representative of the San Diego County Office of
Education.
Executive Summary
This item supports the Arts Commission Work Plan Fiscal Year 2024-25 goals to “receive
periodic reports on topics that deepen awareness of national trends and emerging priorities in
the arts which are relevant to the Arts & Culture Master Plan” and “research best practices to
strengthen content knowledge in order to more effectively advocate in our community.” The
update is being presented by Pauline Crooks from the San Diego County Office of Education.
Explanation & Analysis
On November 8, 2022, California voters approved Proposition 28: The Arts and Music in Schools
(AMS) Funding Guarantee and Accountability Act. The measure required the state to establish a
new, ongoing program supporting arts instruction in schools beginning in fiscal year 2023–24.
The proposition requires at least 80 percent of the additional funding be used to hire staff. The
remaining funding could be used for training, supplies and materials, and for arts educational
partnership programs. More information on Proposition 28 is available on the California

The proposed action is not a “project” as defined by CEQA Section 21065 and CEQA Guidelines
Section 15378(b)(5) and does not require environment review under CEQA Guidelines Section
15060(c)(3) and 15061(b)(3), because the proposed action to report on the Proposition 28
Update is an organizational or administrative government activity that does not involve any
commitment to any specific project which may result in a potentially significant physical impact
on the environment. Any subsequent action or direction stemming from the proposed action
may require preparation of an environmental document in accordance with CEQA or CEQA
Guidelines.

Are community partners hired as independent
contractors/vendors considered “staff”––in other words do
they fall under the 80 percent?
No.
Contractors/vendors are not employees of the local educational agency. Up to
20 percent of the expended Arts and Music in Schools (AMS) funds may be
used for “training, supplies and materials, and arts educational partnership
programs,” which includes outside contractors.
Furthermore, instruction provided by community-based organizations is
considered part of the 20 percent and, therefore, is not annually reported as
Full Time Equivalent (FTE).

Can schools pool their
Arts and Music Schools (AMS) funds?
Yes, schools can share teachers and teacher aides as well as
community arts partners as long as the allocation from one school
site is not being used to pay for the cost of arts education programs
at another school site.
This strategy may be useful for school sites whose AMS allocation is
not sufficient to hire a full-time teacher.
