Executive Summary Staff are requesting the Carlsbad Municipal Water District Board's approval to terminate (or "quitclaim") one water easement and portions of a second water easement that currently allow CMWD staff access to portions of the Aviara Oaks School campus located at 6880-6900 Ambrosia Lane . Easements like these give the CMWD access to private property to install or maintain public infrastructure. The easements, or portions of them, and the water facilities remaining in an easement, are no longer needed for public water system purposes because of the Carlsbad Unified School District's modernization project on the campus, so staff recommend the easements be quitclaimed, with ownership of the remaining water pipes and equipment transferred to the school district. The CMWD Board's approval is required because the CMWD Code and ordinances do not provide authority to the Executive Manager or designee to approve quitclaim deeds or transfer ownership of facilities that are no longer needed for the public water system. Sept.23,2025 Item #3 Page 1 of 16 Explanation & Analysis The school district granted water easements to the CMWD as follows: • General utility and access easement, Instrument No. 1997-0307224, recorded in 1997 is for a public water main that was never installed and is no longer needed. {Quitclaim deed VAC2024-0002) • Waterline easement, Instrument No. 2000-0114184, recorded in 2000 is for a public fire hydrant and water meters to serve the Aviara Middle School, which is located next to the Aviara Elementary School. {Quitclaim deed VAC2024-0003) The district's school modernization plan for Aviara Oaks School campus was approved by the city in 2023 {Private Development Plan PD2023-0013). The project modernized the campus with new structures, drainage facilities and traffic circulation improvements. The public water facilities for which the 1997 easement had been granted were never installed, so CMWD access to the area covered by the easement is not needed. Similarly, portions of the 2000 easement area should be quitclaimed because the existing water meter services will be removed from the public portion of the pipe at one location, and a dead- end segment of water main in another portion of this easement should have its ownership transferred to the CUSD so that the district can continue to maintain the water pipes serving the campus facilities. Staff recommend that the CMWD Board quitclaim these water easements to the CUSD and approve transferring ownership of the remaining water facility within the quitclaimed easements to the CUSD. Quitclaiming the easement will transfer and relinquish any existing interest or right in the easement to the CUSD. Fiscal Analysis There are no fiscal impacts in quitclaiming these easements. All fees necessary to process these quitclaims have been paid by the school district. Next Steps Upon approval of the CMWD Board, the Secretary to the Board will record the required quitclaim deeds and other required recording documents with the San Diego County Office of the Recorder. Environmental Evaluation The proposed action is not a "project" as defined by the California Environmental Quality Act, or CEQA, in Public Resources Code Section 20165 and CEQA Guidelines Section 15378{a) and therefore does not require environmental review per CEQA Guidelines Section 15060{c){3), because the action is limited to recording the quitclaim deeds and transferring ownership of the remaining water facility. Recording the deeds and transferring ownership of the water facility has no potential to cause either a direct physical change or a reasonably foreseeable indirect physical change in the environment. Location map Sept. 23, 2025 Item #3 Page 2 of 16 RESOLUTION NO. 1781 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING TRANSFER OF OWNERSHIP OF WATER FACILITIES AND QUITCLAIM DEEDS OF EASEMENT OVER ASSESSOR'S PARCEL NUMBER 215- 050-74-00, LOCATED AT THE AVIARA OAKS ELEMENTARY AND MIDDLE SCHOOL CAMPUS, 6880-6900 AMBROSIA LANE (QUITCLAIM DEEDS VAC2024-0002 AND VAC2024-0003) Exhibit 1 WHEREAS, the Carlsbad Unified School District, fee owner of Assessor Parcel Number 215-050- 74-00, in development of the Aviara Oaks School Modernization plans made a request to the Carlsbad Municipal Water District of the City of Carlsbad, California, or CMWD, asking the CMWD to quitclaim a CMWD water easement over its property; and WHEREAS, on June 29, 1997, the subject water easement was dedicated to the CMWD as Instrument No. 1997-0307224; and WHEREAS, the CMWD Board has determined that the 1997 water easement is no longer required for the purpose for which it was granted, nor will it be needed for any future public water purpose; and WHEREAS, the school district, fee owner of Assessor's Parcel Number 215-050-74-00, in development of the Aviara Oaks School Modernization plans made a request to the CMWD, asking the CMWD to quitclaim portions of a water easement over its property; and WHEREAS, on March 7, 2000, this second water easement was dedicated to the CMWD as Instrument No. 2000-0114184; and WHEREAS, the CMWD Board has determined that portions of the 2000 water easement are no longer required for the purpose for which they were granted, nor will they be needed for any future public water purpose; and WHEREAS, the CMWD Board has determined that water facilities remaining in the portion of the 2000 water easement are no longer required for public purposes, but should have ownership transferred to the Carlsbad Unified School District to continue privately serving the school facilities; and WHEREAS, the CMWD Board has determined it necessary, desirable and in the public interest to approve these quitclaim deeds of easement to the school district for the entire 1997 water easement and portions of the 2000 water easement. Sept. 23, 2025 Item #3 Page 3 of 16 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad Municipal Water District of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the CMWD Board has determined that the proposed action is not a project as that term is defined by the California Environmental Quality Act (CEQA), in Public Resources Code Section 20165 and CEQA Guidelines Section 15378(a) and therefore does not require environmental review per CEQA Guidelines Section 15060(c)(3) because the action is limited to recording the quitclaim deeds and transferring ownership of the remaining water facility and the recording of quitclaim deeds and transfer of ownership have no potential to cause either a direct physical change in the environment or a reasonable foreseeable indirect physical change to the environment. 3. That the quitclaim deeds, attached hereto as Attachment A (VAC2024-0002) and Attachment B (VAC2024-0003), on file with the Secretary to the Board and incorporated herein by reference, are approved. 4. That privatization of the existing water facilities remaining within the quitclaimed easement with transfer of ownership to the Carlsbad Unified School District, is approved. 5. That the CMWD Board President is authorized to execute the quitclaim deeds attached hereto as Attachment A and Attachment B, and the Secretary to the Board is hereby authorized to record said documents.
