TO: FROM: CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT May 13, 1975 REPORT ON: PLANNI NG COMMISSION PLANNING DEPARTMENT ZONE CHANGE 155 & 156 SCHOOLS, PARKS AND OTHER SITES TO BE REZONED TO 0-S (OPEN SPACE) APPLICANT: CITY INITIATED I. REQUEST: The Planning Commission of the City of Carlsbad has initiated the rezoning to 0-S of various schools, parks lagoons, beach areas and other sites designated on the land use plan as open space areas. All of the land proposed to be rezoned to 0-S i.s located within the Carlsbad City limits and their respective locations and will be defined in more detail elsewhere in this re- port and through e xhibits attached hereto: II . RECOMMENDATIONS: Zone Ch an ge 155 & 156 -Staff recommends that both ZC 155 and ZC 156 as shown on Exhibits A through G and Exhibits 1 through 14, dated May 13, 1975 and attached hereto be APPROVED based on the following justifications: l) This zone change is justified because it will implement the goals and objectives of the General Plan of the City and provide for open space and recreational uses which hav e been deemed necessary for the aesthetically attractive and orderly development of the commu nity. 2) Th is Zone Change will make the Land Use Plan and Zoning Map c onsistent, which is a mandatory requirement under the provisions of the California Government Code (Section 65860). 3) The permitted uses in this proposed class ifi ca tion will not be detrimental in any way to surrounding properties because the areas to be rezoned are now developed as publ ic school sites, park sites, beach areas, or are proposed to be developed as active or passive recreation- al areas or will remain as vis ua l open space areas whi ch will be 9fcgreat benefit to residents of the City of Carl sb ad. 4) The properties in this application are more suitable f or the proposed zone than the existing zone because open space (O-S) zoning will more accura tely reflect e xisting and proposed land uses of these properties . BACKGROUND: ZC-155 A) Ge neral: There are six existing school sites and one future school site (located in the Laguna Riviera subdivision) proposed to be reeoned to Open Space. Their locations and approximate site areas are as follows: 1 . 2. 3 . 4 . 5. Buena Vista Elementary School Site, 1330 Buena Vista Avenue, (approx.g.12 ac ) located southerly of Las Flores Drive, northerly of Buena Vista Avenue and easterly of Olive Drive. (Exhibit A) Jefferson Elementar School Site, 3743 Jefferson Street, approx. 8.2 ac located westerly of Jefferson Street, between Magnolia Avenue and Tamarack Avenue (Exhibit B) Pine Elementary School Site, 801 Pine Avenue (approx. 13.6 ac), located westerly of Harding Street, southerly of Pine Avenue and northerly of Palm Avenue . (Exhibit C) Magnolia Elementary School Site, 1905 Magnolia Avenue (approx. 10.9 ac), located southerly of Magnolia Avenue, easterly of Valley Street. (Exhibit D) Valley Jr. High School Site, 1645 Magnolia Avenue (approx. 20 ac.) located southerly of Bass wood, easterly of Valley Street, westerly of Monroe Street and northerly of Chestnut Avenue. (Exhibit F) Laguna Riviera Future School Site, (approx 8.3 ac) located southerly of Hillside'Drive, westerly of Valley Drive and easterly of Cordoba Place. (E xhibit G) Zoning: None of these school sites are presently zo.ned, although they are surrounded by residentially zoned properties. Legal Descriptions: Detailed legal descriptions are on file in the Planning Department General Plan Consideration: Although the Land Use Plan has identified the various existing and proposed school sites in the sepa rate land use category (schools) they can be classified in the Open Space category since these facilities do provide recreational facilities and open space areas in the form of football and baseball fields, tennis courts, track, etc. These uses are also defined as permitted uses (by CUP)'in the 0-S Zone. Zoning: Unzoned (2) Pio Pico Park Site, (appro x. 0.76 ac), located easterly of Pio Pico Drive, northerly of Knowles Avenue and southerly of Buena Vista Avenue . (Exhibit 2) Zoning: R-1-7500 One-Family Residential (3) Maxton Brown Park, {approx . 0195 ac), located easterly of State Street, northerly of Laguna Drive and souther- ly of the Buena Vista Lagoon. (Exhibit 13) Zoning: PU Public Utility San Diego Gas and Electric Lands (approx 254.8 ac), lo- cated east of Interstate 5 and adjacent to and south of Agua Hedionda Upper Lagoon Area (Exhib i t 13) Zoning: PU-Public UtilitY Carlsbad Beach State Park (approx . 4400 ft. of beach area), extending between the extension of Oak Street and the entrance of Agua Hedionda, bounded on the east by the westerly right of way line of Carlsbad Blvd . (No Exhibit) Zoning: Un zoned -7- B) C) (18) Carlsbad Beac h Area (approx. 4500 ft. of beach area), extending from the entrance to Agua Hedionda south to the northerly limits of Tierra Del Oro Subdivision bounded on the east by the westerly right of way line of Carlsbad Blvd. (No Exhibit) Zoning: Unzoned and R-T Residential Tourist (19) La Costa State Park Beach and South Carlsbad State Beach (approx. 15,000 ft. of beach area), extending from the southerly limits of Poinsettia Beach Unit No. l, to southerly City ~imit. (No Exhibit) Zoning: Unzoned and PC Planned Community (20) 1974 State Beach Ac~uisition (approx . 20.l ac), located easterly an southerly of Terramar Units 4, 5 and 6 and bounded on the east by the AT&SF RR Right of Way. (Exhibit 14) Zoning: R-1-7500 -One Family Residential Legal Descriptions: Since in several instances detailed lega l descriptions of these properties are not readily available the City Attorney has recommended that rezoning be accomplished by adoption of a map and locational property desc ription. General Plan Consideration: Most of the above properties have been designated on the Land Use Plan as Open Space. There are however, three exceptions, as follows: (1) The westerly portion of the Magee property (Exhibit 7) is designated as RHM (Medium-High Denisty Residential) and is zoned R-3, the easterly portion (adjacent to Carlsbad Boulevard) is shown as T-S (Travel Services and Traffic Dependent) and is zoned C-2 (General Commercial). It should however, be pointed out that this property is now owned by the City of Carlsbad and is proposed to be developed as a City Park and reeoning to 0-S is therefore justified . Although eventually the Land Use Plan will have to be amended to reflect this area as Open Space . (2) The Greenwood property (Exhibit 5) is designated as G (Governmental Facilities). The southerly portion of this property now contains the Parks and Recrea- tion Department offices and storage area. The northerly half of this property is also proposed to be landscaped and should logically be considered as an Open Space area. (3) The southerly portion of the County of San Diego Airports Di vision Land Acquisition (Exhibit 11) -8- extending easterly of Palomar Airport and El Camino Real is shown as G (Government Facilities). This portion of land will eventually be developed with an Instrument Landing System (ILS) as part of the Palomar Airport . Since all of this parcel is under San Diego County ownership with a major portion shown as Open Space on the Land Use Plan, all of th i s prop- erty should be considered for rezoning from PM (Planned Industrial) to OS (Open Space). It should also be noted that the major portion of this land can be considered as undevelopable due to its extreme- ly rough terrain. Only two small mesas might ultim- ately be used for Planned Industrial Development which of course would require an amendment to the Land Use Plan at such time as development is con- sidered . It should also be noted that there a r e several other a reas wh i ch are designated as Open Space on the Land Use Plan . Al l of these areas are part of Planned Community (PC) Zo nes, and will not need to be rezoned since these area s al r eady have been designated as open space areas on ap proved Master Plans and will rema i n as open space when de velopment of these Planned Communities occurs. Rezoning of these areas to OS should therefore be considered as a duplication effort and would not serve any useful purpose. Al t hough most of the areas proposed to be rezoned to Open Sp ac e require no further explanation as to e x isting or proposed uses, i .e., the Buena Vista and Agua Hedionda La goons, Lake Calavera and Carlsbad Beach areas, three area s may require additional explanations : (1 ) The SDG&E land (Exhibit 13) east of Interstate 5 and south of Agua Hedionda Lagoon, i s traversed by transmission lines originating at the power plant . The land under the transmission lines cannot be built upon, but can be used for agricultural uses and i s therefore designated as Open Spa ce . (2) Squires Dam Area (E xhibit 11) -The Dam a rea is owne d by CMWD . The remaining portion of t his land is part of the Dawson-Los Monos Ecological Reserve, a nd is owned by the University of California and is to be used as a natural laboratory area for ecological re- search purposes. (3) 1974 State Beach Ac quisition (Ex hibit 14). Thi s property was obtained by the State of California in 1974 and will eventually be developed as part of Carlsbad State Beach area. ENVIRONMENTAL IMPACT CONSIDERATIONS: Due to the nature of this reclassification, it has been determined that a Declaration of Negative (Non-Significant) Environmental Effect is warranted on both ZC -155 and ZC-156. Reasons for Negative Declaration: (1) Rezoning of above described properties to Open Space (0-S) Zoning is mandatory under the provisions of Section 65860 of the Government Code requiring the consistency of the zoning ordinance with the General Plan, and impleme nts the goals and objectives of the City of Carlsbad General Plan . (2) Rezoning of above described properties to Open Space (O-S) will ensure their continued use as visual and recreational open spaces deemed necessary for the aesthetically attrac- tive and orderly growth of the communi ty . (3) Rezoning of the above properties will not change present or proposed land uses in the vicinity of each subject property or the present or proposed use of the subject pr operty.
