Hearing
Government Cod e Section 65401 requires the governing body .of any
special distri ct or school district whose jurisdiction lies
who lly or partially within a city with an adopt~d General Plan
to submit a 1 ist to the city of proposed public wo_rks reG:om-
rnen ded for planning, initiation or construction in the ensuing
fiscal year.
On April 1 9 , 1977 the Carlsbad City Council adopted Resolution
No .. 5057 reque sting special districts to s ubmit a list of pro-
posed public works every year to the City and directing the pre-
paration of a coordinated program of proposed public works . A
letter was s e nt on March 4 , 1981 to fifteen (15) special
districts whose territory lies wholly or partially within the.
City of Carlsbad. To date , responses have been r eceived from
fourteen distr icts. Only the San Marcos Water District has not
responded.
The attache d list of _proposed public works has been prepared from
the informa tion supplied by the d istricts. Some of the informa-
tion provided i s ve ry ske tchy since districts have not as yet
finalized the ir plans . This i s the best information available at
this time.
Also, prior to the acquisition of real prope rty or construction
of new facilities , Government Code 65402 provddes for a sp~cific
review on a p roje ct-by-project basis for conformity to the
General Plan. •
The attached list is being submitted t0. the Planning Commis s ion
for review. A report to the C~ty Council regarding conformity
to the Carlsbad General Plan will be prepared after the Planning
Commission a c t s upon this .item.
ENV I RONMENTAL REVIEW
·A .General Plan con s istency finding is a statutor y exe~ption .
(Section 1507 2 of CEQA). Each proj e ct approv ed will have
e nvironmental review before the buil ding permit is issued.

.Staff recommend s that the Planning Commission find the following

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, FINDING
GENERAL PLAN CONSISTENCY FOR A COORDINATED
PROGRAM OF PROPOSED PUBLIC WORKS .
WHEREAS, Cali fornia Government Code Section 65401 provides
for the p reparation of a coordinated program for proposed public_
WH EREAS, the City :of Carlsba d has officia lly adopted a

WH EREAS, Government Code Section 65401 provide s that the
governing bodies of any special district or school di strict whose
jurisdiction l~es wholly or partially within the City and whose .
function s include remodeling, preparing plans f o r, or c on structing
major public works, .shall submit a lis t of the propo~ed public
works recommended for planning, initiation, or constructipn
during the ensuing fiscal yea r to an age ncy designated by the
City Council; and
WHEREAS, on April 19, 1977, the City Council resolved as
follows:

PROVIDING FOR A COORDINATED PROGRAM
OF PROPOSED PUBLIC WORKS
WHEREAS, Government Code Section 65401 provide s for the

A RESOLUTION OF THE PLANNING COMMISSION OF THE ·
CITY OF CARLSBAD, CALIFORNIA , FINDING GENERAL
PLAN CONSISTENCY FOR A PROGRAM OF PROPOSED
PUBLIC WORKS.

WHEREAS , California Government Code Section 65401 provides
I • for the prepar ation of a coordinated program for proposed public
works, and
Wher eas , Government Code Section 65401 provides that the
governing bodies of any special district or school district whose
jurisdiction lies wholly or partially within the city and whose
functions include remode ling , preparing plans for, or constr ucting
major public works, shall submit a list of the proposed public
works rec ommended for planning, initiation, or construction during
the ensuing fiscal year to an a~ency designated by the City
Council; and
WHEREAS , Government Code Section 65402 provides that no real
property shall be acquired for public purposes and that no· r eal
property shall be disposed of by a public agency unless such
·property has been submitt ed to and r eported upon by the planning
agency as to conformity with the adopted general plan; and
WHEREAS , ON April 19, 1977 , the City Council resolved as
follows:
1. That special di~tricts and school districts located wholl
or partially within the City of Carlsbad submit a ·list of proposed
public works recommended for planning ,· initiation; or construction
1 during the ensuing fiscal year to the City Council of the .City of
2 Carlsbad prior to May 1 of each year.
3 2. That the City Manager cause to be prepared a coordinated
4 program of proposed public w9rks for submittal to the Planning
5 Commission.
6 3. That the Planning Commission r eview the coordinated
7 program for conformity to the General Plan of the City of Carlsbad
8 and report its findings to the .City Council.
9 WHEREAS, a program of public works has been prepared and has
10 been submitted to the Planning Commission for r eview of conformity
11 to the Ge neral Plan of the City of Carlsbad.
12 NOW, THEREFORE, BE IT HEREBY RESOLVED hy the Planning Comm i s-
13 sion of t he Ci ty of Carlsbad, California , as follows:

1. The attached program of proposed public works is
consistent with the C?.rlsbad General Plan.
2. Said finding of conformity of the program of proposed
17 public works shall b e reported to the City Council.
