ANNOUNCEMENT OF CONCURRENT MEETINGS: The City Council is serving as the Carlsbad Municipal Water District Board of Directors on Consent Calendar Item No. 1, Ordinance for Introduction Item No. 3 and Departmental and City Manager Reports Item No. 4. PLEDGE OF ALLEGIANCE: City Manager Geoff Patnoe led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the Special Meeting held Sept. 23, 2025 Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, approved the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: None. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced that there was no reportable action. PUBLIC COMMENT: Mary Lucid spoke regarding budgeting accountability. Paige DeCino spoke regarding the California Coastal Commission and public access to beaches. Diane Nygard spoke regarding coastal access and permit issues for Levy Land. CONSENT CALENDAR: Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to approve Consent Calendar Item No. 1. Motion carried unanimously, 5/0. 1. ADVERTISE FOR BIDS FOR THE ELM AND SKYLINE STEEL RESERVOIR COATING PROJECT, CIP PROJECT NO. 5024-3 – Adoption of a Carlsbad Municipal Water District Board of Directors Resolution No. 1784 the plans, specifications and contract documents for the Elm and Skyline Steel Reservoir Coating Project and authorizing the Secretary to the Board of Directors to advertise for bids for the project. (Staff contact: Daniel Zimny and Keri Martinez, Public Works) BOARD AND COMMISSION MEMBER APPOINTMENTS: 2. Nomination by Mayor Blackburn to adopt Resolution No. 2025-222 appointing Bruce Fitz-Patrick to the Senior Commission. Motion carried unanimously, 5/0. ORDINANCES FOR INTRODUCTION: 3. AMEND TITLE 1 AND REPEAL AND REPLACE TITLE 2 OF THE CARLSBAD MUNICIPAL WATER DISTRICT CODE AND UPDATE THE RESIDENTIAL SHUTOFF PROTECTION POLICY – 1) Introduction of Ordinance CMWD No. 51 of the Carlsbad Municipal Water District Board of Directors amending Title 1 and repealing and replacing Title 2 of the Carlsbad Municipal Water District Code; and 2) Adoption of Resolution No. 1785 of the Carlsbad Municipal Water District Board of Directors approving an update to the Residential Water Service Shutoff Protection Policy for nonpayment of charges. (Staff contact: Dave Padilla, Public Works) City Manager’s Recommendation: Introduce the ordinance and adopt the resolution. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to introduce Carlsbad Municipal Water District Board of Directors Ordinance No. 51 and adopt Carlsbad Municipal Water District Board of Directors Resolution No. 1785. Motion carried unanimously, 5/0. ORDINANCES FOR ADOPTION: None. PUBLIC HEARINGS: None. DEPARTMENTAL AND CITY MANAGER REPORTS: 4. OPTIONS FOR THE MAERKLE RESERVOIR SITE SOLAR FEASIBILITY STUDY, CIP PROJECT NO. 4722 1) Adoption of a Carlsbad Municipal Water District Board of Directors resolution authorizing execution of a professional services agreement with ForeFront Licensing, LLC for Phase 1 of the Maerkle Reservoir Site Solar Feasibility Study; or 2) Adoption of a Carlsbad Municipal Water District Board of Directors Resolution No. 1786 rejecting all proposals for the Maerkle Reservoir Site Solar Feasibility Study. Susan McArthur expressed her concern about the ability to secure homeowners insurance and the potential decline in home values. Deborah Assman expressed her opposition and concern with a solar farm being established in a designated high fire threat area. Barbara Diamond spoke in support of the feasibility study. Lynda Daniels spoke in support of the feasibility study. Rene Barton expressed her concern about the ability to secure homeowners insurance, and the impact a solar farm would have on the surrounding neighborhoods and wildlife. Mike McMahon spoke in support of the feasibility study. Paige DeCino spoke in support of the feasibility study. Lane Sharman spoke in support of incorporating the conditions of the feasibility study into a Request for Proposals. Don Christiansen spoke in support of Option 1. Alan Goodman spoke in opposition to the project and expressed his concern for the negative impacts this project would have on the City of Oceanside and the City of Vista. Becky Evanson spoke on behalf of a group consisting of Robert Ramage, Tim Evanson, Johanna Alandt, and Joe Phaoes. Ms. Evanson spoke in opposition to the project. Steve Hill spoke in opposition to the project and expressed his concern about temperature rise and fumes. Dr. Victoria Tellkamp-Foster spoke in opposition to the project and expressed concern about a heat island. Motion by Council Member Shin, seconded by Council Member Burkholder, to adopt Carlsbad Municipal Water District Board of Directors Resolution No. 1786. Motion carried unanimously, 5/0. Minute motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, directing the City Manager to return at a future meeting to look at other potential sites throughout the city for solar project opportunities. HOW COMMUNITY CONCERNS HAVE BEEN ADDRESSED AT WINDSOR POINTE APARTMENTS – Receive a report on City Council-directed actions related to the Windsor Pointe Affordable Housing Project. (Staff contact: Mandy Mills, Community Services, and Reid Shipley, Police) City Manager’s Recommendation: Receive the report. Housing and Homeless Services Director Mandy Mills and Assistant Police Chief Reid Shipley reviewed a PowerPoint presentation (on file in the Office of the City Clerk). The City Council received the report. 6. UPDATE ON THE POLICE DEPARTMENT’S ENFORCEMENT EFFORTS ON UNLAWFUL CAMPING IN VEHICLES, OVERSIZED VEHICLES AND OTHER PARKING VIOLATIONS – Receive an update on the Police Department’s enforcement efforts on unlawful camping in vehicles, oversized vehicles and other illegal parking violations. (Staff contact: Shaun Lawton and Jason Arnotti, Police) City Manager’s Recommendation: Receive the update. Police Lieutenant Shaun Lawton and Police Lieutenant Jason Arnotti reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Kristina Luckett spoke about Housing First grant funds which provide aid to individuals who are living in their vehicles. Sunny Blende expressed her concern about oversized vehicles parking on streets in her neighborhood. The City Council received the update. COUNCIL REPORTS AND COMMENTS: Mayor Blackburn and the City Council Members reported on activities and meetings of some committees and subcommittees of which they are members. Minute motion by Council Member Shin, seconded by Council Member Burkholder, directing the City Manager to bring back an item to discuss anticipated changes to ARJIS’ case categorization and how those changes may impact the City of Carlsbad and residents. Motion carried unanimously, 5/0. Mayor Blackburn requested Police Chief Christie Calderwood read a letter received by the Carlsbad Police Department.
