Executive Summary The City Council established 13 sewer benefit areas in 1991 to collect fees from future developments. Developers within each of the benefit areas pay a sewer benefit fee based on the number of homes or equivalent dwelling units they construct.1 The revenue is then used to reimburse developers that previously constructed the sewer collection facilities within the benefit area, or to provide funds for the city to construct the improvements if necessary. (Resolution No. 91-21) This staff report concerns Sewer Benefit Area H, which was last updated in 2010. The latest engineering report, completed this year, recommends expanding the boundary of Area H to include 77 additional parcels that are already served by Area H’s sewer facilities. The engineering report also found that development within Area H will result in higher sewer flows than previously projected, and that additional pipeline capacity will be needed to accommodate this growth. Staff recommend that the City Council approve the revised boundary for Sewer Benefit Area H in accordance with the engineering report. Staff are also taking this opportunity to advise the City Council of staff’s plan to use existing and future Area H fee revenues to partially fund the Poinsettia Lane Sewer Line Capacity Improvements Project, which the City Council previously approved in March 2025. (Resolution. No. 2025-072) 1 An equivalent dwelling unit is a unit of measure for the sewage generated from particular buildings, structures or uses. One equivalent dwelling unit is equal to the approximate amount of sewage generated by an average single- family residence. In accordance with Carlsbad Municipal Code Section 13.10.080, the City Council may revise sewer benefit area boundaries in accordance with an associated engineering report. The use of Sewer Benefit Area H funds for the Poinsettia Lane Sewer Line Capacity Improvements Project is authorized by and consistent with the City Council’s establishment of Sewer Benefit Area Boundaries and Fees in Resolution No. 91-21. Explanation & Analysis Background The growth areas served by the sewer benefit areas were delineated by the city’s 1986 General Plan, which provided a forecast of the growth anticipated in the city at that time. Each sewer benefit area overlays a specific sewer basin, which is defined by the boundaries of a wastewater collection system where sewage flows to a common point, such as a sewer pumping station. These benefit areas were located in largely undeveloped portions of the city’s sewer service area at the time of the 1986 General Plan. The fees are collected before a building permit can be issued. The sewer benefit area fees have funded a total of 38 facilities, such as sewer mains and lift stations.2 In Area H, the fees funded eight of these sewer facilities, including the Poinsettia Lift Station. The scope of sewer facility improvements and the associated fees are updated periodically to reflect changes in land use and zoning, development density, engineering design standards, sewer facility layout and sewer facility costs. •The fees charged in Sewer Benefit Area H and some of the other areas were set by the City Council in 2010. (Ordinance No. CS-077) •On May 13, 2025, the City Council enabled sewer benefit areas to be adjusted by a City Council resolution rather than requiring an ordinance. (Ordinance No. CS-491, which amended Municipal Code Section 13.10.080, Sewer benefit area fees.) •Fees are adjusted annually, effective September 1, by the annual change to the Engineering News-Record’s Los Angeles Construction Cost Index, in accordance with Municipal Code Section 13.10.080. •Pursuant to Municipal Code Section 13.10.080, the sewer benefit area fees may also be changed—and benefit areas may be added or removed—by resolution in accordance with an associated engineering report. Sewer Benefit Area H The existing Sewer Benefit Area H boundary is shown in Exhibit 2 and generally defined by the area east of El Camino Real to the city boundary with the City of San Marcos, south of Palomar Airport Road and north of Alga Road. All parcels within Area H drain to the Poinsettia Lift Station, located on Poinsettia Lane just east of Alicante Road. The fee charged on developments in Area H was revised in updates in 2004 and 2010. These updates estimated the sewer basin to ultimately support 4,145 equivalent dwelling units when the area was fully developed, or “built out,” which reflects the area being developed to the maximum density allowed for each parcel. Planning for this condition ensures the 2 Lift stations elevate sewage with pumps so that it can continue flowing by gravity through the sewer system. Since the 2010 Sewer Benefit Area H update, the city’s engineering standards, local and state planning laws and environmental regulations have changed, and construction costs have escalated. Engineer’s report The 2025 engineer’s report summarizes the impacts of these factors on the existing sewer system previously constructed with Sewer Benefit Area H Fees. The report: •Recommends expanding Area H’s boundary to include properties that are now served by its facilities •Proposes additional sewer improvements •Determined the current Sewer Benefit Area H Fee was adequate to fund the improvements associated with the Poinsettia Lane Sewer Line Capacity Improvements Project. The 2025 Engineer’s Report makes the following findings: Unit count Sewer Benefit Area H is now projected to support a maximum of 4,872 equivalent dwelling units when fully developed, which is 727 units more than was estimated in the 2004 and 2010 updates. This projection is consistent with the city’s 2024 update of its Housing Element, its plan for housing in the city, and considers the effect of state Senate Bill 330, the Housing Crisis Act of 2019, which prioritizes construction for higher-density developments that provide affordable housing to low-income families. Area H currently has 4,349 equivalent dwelling units, 204 more than were estimated in the 2004 and 2010 updates. There are nine remaining undeveloped properties within the area capable of providing a total of up to 523 equivalent dwelling units. Area H Fees will be collected from these remaining units to fund the sewer capacity improvements proposed in the Poinsettia Lane Sewer Line Capacity Improvements Project in proportion to developments’ increase in density. Sewer Benefit Area H boundary The 2025 engineer’s report recommends revising the Area H boundary to include an additional 77 parcels. These properties were previously mapped outside of the Area H assessment area but benefit from the Area H’s sewer facilities that were constructed since the 2010 update. A map of the proposed boundary revision is shown on Exhibit 2. Sewer Improvements – Poinsettia Lane Sewer Line Capacity Improvements Project Several sewer pipe segments in Area H require additional capacity to support the sewer basin’s fully developed condition of 4,872 equivalent dwelling units. The 2025 engineer’s report recommends removing approximately 2,560 feet of 12-inch diameter sewer pipeline and replacing it with about 1,650 feet of 18-inch sewer pipeline from the Poinsettia Lift Station eastward to Mica Road and approximately 910 feet of 15-inch sewer pipeline from Mica Road to about 300 feet west of El Fuerte Street. To address the needed sewer capacity improvement, the City Council approved the change in scope of work for the Poinsettia Lane Sewer Line Capacity Improvements Project on Oct. 28, 2025 Item #1 Page 3 of 29 Docusign Envelope ID: 173E870A-BE51-497D-B6BC-B241DF72A126 March 25, 2025. (Resolution No. 2025-072) This improvement is consistent with the scope of the projects in Sewer Benefit Area H, and the benefit area’s fee revenues are eligible for contributing to the project. The 2025 engineer’s report, provided as Attachment A to Exhibit 1, recommends the use of Area H fee revenues to contribute toward the total project costs of the project. Fiscal Analysis The total estimated cost of the Poinsettia Lane sewer capacity improvement in the Poinsettia Lane Sewer Line Capacity Improvements Project is approximately $5 million. This cost includes planning, engineering design, environmental studies, permitting, construction contract, contingency, construction management and inspection, and public outreach services during construction. An opinion of probable cost is provided in Appendix D of the 2025 Engineer’s Report, which is provided as Attachment A to Exhibit 1. The current Sewer Benefit Area H fee is $1,445 per unit and applies to development permit applications received after Sept. 1, 2025. A developer’s permit application to construct 320 equivalent dwelling units in Area H was submitted prior to Sept. 1, 2025, which would result in the fee for the development being assessed at the prior rate of $1,418 per unit or an estimated $453,760 for 320 units. The remaining balance of 203 projected equivalent dwelling units would be at the current fee or approximately $293,335. The total of the fees for the remaining equivalent dwelling units that have not been built is approximately $747,095, or about 15% of the total estimated project cost for the Poinsettia Lane Sewer Line Capacity Improvements Project, which is proportional to the increase in Area H’s equivalent dwelling unit count. Therefore, the current fee is adequate, and no adjustment to the Sewer Benefit Area H Fee is needed at this time. The remainder of the project’s costs will be funded by the city’s Sewer Replacement Fund. Next Steps If the City Council approves revising the Sewer Benefit Area H boundary in accordance with the associated engineering report, staff will return to the City Council at a future meeting to seek adoption of the plans, specifications and contract documents and authorization to advertise for bids for the Poinsettia Lane Sewer Line Capacity Improvements Project. Construction of the project is expected to begin in early summer 2026 and be completed in late 2026. Staff will also return to the City Council to request authorization to reimburse the Sewer Replacement Fund from the Sewer Benefit Area H fund once the project is complete. The Sewer Benefit Area H fee will continue to be updated annually on September 1 of each year to reflect inflation adjustments, in keeping with Carlsbad Municipal Code Section 13.10.080. The original engineering report entitled “Benefit Area Fees for Conveyance System Improvements Update to the December 1987 City of Carlsbad Master Plan of Sewerage,” dated August 1990, established thirteen benefit areas labeled A through M. SBA H is one of the thirteen sewer basins within the program in which fees were collected to construct eight facilities within the basin, all of which have been constructed as of 2010. The basin has surpassed the maximum unit loading originally estimated in the 2010 update and will continue to construct units on several developable properties. While the sewer system serving the basin has been constructed, sewer modeling has verified the need for increased sewer conveyance capacity at several facilities previously constructed by the fee program due to this increased development density. The scope of this engineer’s report is limited to SBA H and revises the boundary of the basin and member parcels participating in the program, provides an assessment of the existing development density, identifies the need and cost for additional sewer improvements, estimates future development in the basin, and allocates the proportionate share of the fair- share cost to each future Equivalent Dwelling Unit (EDU) within the SBA H boundary. Background SBA Program Individual sewer facilities were proposed by the SBA program consisted of sewer lift stations, force mains, manholes, and gravity mains. Costs for each sewer facility were tabulated and distributed proportionally among each EDU proposed in the basin area receiving direct benefit from the sewer facility. Developers were reimbursed by the program for constructing extensions or oversized facilities that were to accommodate future flow projections within the basin at build-out. Subsequent fee revisions to the program followed in 2002, 2004 and 2010 to reflect changes to the alignment and sizing of pipelines, revisions to EDU projections at build- out, elimination of sewer facilities no longer proposed in the program, and updated project costs. New facilities have not been added to the original list of projects in any of the updates. SBA H – Historical Context The sewer basin extents for SBA H are shown in Appendix A and are generally defined by the area east of El Camino Real to the city boundary with San Marcos, south of Palomar Airport Road, and north of Alga Road. Eight sewer facilities were constructed consisting of the Poinsettia Lift Station, associated force main and several gravity trunk sewers. The entire basin drains to the Poinsettia Lift Station where sewage is then pumped into the Vallecitos Interceptor Sewer at the intersection of El Camino Real and Cinnabar Way. Oct. 28, 2025 Item #1 Page 10 of 29 Docusign Envelope ID: 173E870A-BE51-497D-B6BC-B241DF72A126 - 2 - Of the thirteen SBAs within the program, SBA H had the second highest growth projection at the time of the 1990 Update with 4,962 EDUs planned throughout its’ seven sewer subbasins at build-out. An additional 80 units from Vallecitos Water District service area were added to the basin in 2000 via a flow exchange agreement approved in Agenda Bill No. 15,653. Updates to the SBA H fee in 2004 and 2010 reflected actual design and construction costs and a reduction in the number EDUs anticipated in the ultimate build-out condition. Both updates estimated 4,145 EDUs at build-out, a reduction of 817 units estimated in the 1990 Update. The reduction in EDUs led to smaller pipe sizes for several facilities proposed in the 1990 Update. Reach VBT1D, the trunk line immediately east of the Poinsettia Lift Station, was originally proposed as a 15-inch diameter sewer in the 1990 Update. The 2004 and 2010 fee updates reduced the pipe size to 12-inch diameter with the expected reduction of EDUs. All eight facilities in SBA H were constructed by the end of 2010. Several reaches were not reimbursed by SBA H funds and were either funded by the city sewer replacement fund (VBT1B) or at the developer’s own expense (VBT1E and VBT1F) for failing to meet the reimbursement agreement requirements. SBA H – Present Condition For this 2025 engineer’s report, all building and conditional-use permits previously issued within SBA H were compiled to determine the basin currently supports 4,349 EDUs, 204 more than the maximum density estimated in the 2004 and 2010 updates. The increased density is attributed to changes in state housing laws and local planning and zoning regulations since the last fee update in 2010. There are nine remaining undeveloped parcels within the basin with an estimated load of 523 EDUs. The total estimated density within the basin at build-out is now 4,872 EDUs, 727 more than originally estimated in 2004 and 2010. A tabulation of EDUs by subbasin is provided in Appendix B and provides both historical and current density projections throughout each subbasin within SBA H. The 2019 City of Carlsbad Sewer Master Plan Update identified several sewer pipe segments within reach VBT1D that had insufficient capacity to support peak wet weather flows. The 2019 hydraulic model has been revised to reflect the new build-out density and wet weather flow trends observed from flow monitoring in the spring of 2025 and identifies reaches VBT1D and VBT1C are in need of additional capacity. These reaches are the entirety of the eastern trunk line on Poinsettia Lane tributary to the lift station (from the lift station to El Fuerte Street). Capacity improvements to these reaches are recommended to achieve the city’s engineering design criteria for relative depth (flow depth over diameter (d/D) of less than 0.75) in peak wet weather events, and the basins’ ultimate build-out condition. Oct. 28, 2025 Item #1 Page 11 of 29 Docusign Envelope ID: 173E870A-BE51-497D-B6BC-B241DF72A126 - 3 - Process This report will memorialize proposed changes to SBA H in accordance with the Benefit Assessment Act of 1982: -Delineate the geographic area of the basin’s fee area -Estimate current and proposed EDUs within the basin -Identify facility capacity improvements -Estimate the cost of improvements -Recommend proposed fee changes This report provides a basis for the use of SBA H fund revenue to partially fund the needed sewer capacity improvements in reaches VBT1D and VBT1C in Poinsettia Lane. These improvements may be funded by SBA H fees from the remaining 523 units to be constructed and the available fund balance. The available fund balance consists of fees collected since 2010 less payments for constructed SBA H facilities, including available fees collected but not used for reimbursement. The SBA H fee is evaluated to ensure the cost per future EDU is adequate to fund the recommended capacity improvements. Sewer Basin Boundary SBA H extents are shown in Appendix A. SBA H is divided into ten sewer drainage zones: 6B, 6C, 10A, 10B, 10C, 10D, 17A, 17B, 17C, and 18B. These were created as part of each Local Facilities Management Zone (LFMZ) and their respective flow patterns to downstream trunk sewers. Several changes to subbasins have occurred since the 1990 Update but were not illustrated in the 2004 and 2010 updates. The revised mapping is reflected in Appendix A and summarized below: -Subbasin 17C split from 17B - removed 25 parcels originally tributary to facilities VBT1C and D but are now solely tributary to facility VBT1D. 24 units have been constructed and one parcel remains undeveloped. -Subbasin 10D split from 10A - removed 55.8 units from LFMZ 17 and are now located in LFMZ 10. The mapping revision is administrative as both subbasins are tributary to facility VBT1E. Assessor Parcel Numbers 2131100100, 2131101500 and 2131101600 are currently mapped as SBA G but drain to SBA H. Future fees for tenant improvements or lot splits will be collected under SBA H for this parcel. -18B expansion – added 30 parcels and 29 units to subbasin area 18B that were originally mapped as outside of SBA H. The expansion area mostly consists of open space but SBA H fees were previously collected from parcels that have developed and drain to SBA H facilities. This fee update formally recognizes their inclusion in SBA H. -Creation of 6C – area includes 74 parcels and 70 residential units constructed prior to the original SBA program. Flow previously drained to the Leucadia Wastewater District service area via a lift station at the end of Chorlito Street but now drains to Carlsbad’s service area after the construction of facilities VBT1A, VBT1C, VBT1D and other Oct. 28, 2025 Item #1 Page 12 of 29 Docusign Envelope ID: 173E870A-BE51-497D-B6BC-B241DF72A126 - 4 - improvements shown on Drawing No. 459-5. These parcels were previously not in the SBA program but will now be assessed SBA H fees. Of these, APNs 2153703300, 2153703200, 2153703100, 2153703000 remain undeveloped and can accommodate up to 16 additional units within the subbasin. Additional fee revenue may also be generated from further lot splits on properties within the subbasin. Construction of the sewer system facilities in SBA H is complete and further sewer extension within SBA H is not anticipated. The sewer improvements included in this fee update will provide additional capacity of reaches VBT1D and VBT1C to convey wet weather sewer flow in accordance with the engineering standards. Existing and Future Build-Out Conditions Past building and conditional use permits issued within SBA H were used to determine the existing EDU count within the basin. Additional units are projected to be constructed on nine undeveloped properties identified in Appendix A. The future unit count is estimated based on the allowable density supported by the parcel area, development applications received by developers for several of the properties, and density bonus proposed or anticipated for each site. The existing and build-out density of the basin is tabulated below and itemized by each subbasin. Approximately 2,560 linear feet of the eastern trunk line, or reaches VBT1C and VBT1D tributary to the Poinsettia Lift Station, do not meet hydraulic design standards during the existing peak weather flow condition. These reaches were previously constructed with SBA H fees. Design flow was determined using the tabulation of existing units tributary to these reaches and flow monitoring results observed at the lift station during wet weather events in the spring of 2025. Sewer flow will increase with the construction of additional units on the nine undeveloped properties, tenant improvements that add sewer demand on existing developed property, residential accessory dwelling units, and increased enrollment at schools within the basin. The pipeline upsize will commence at sewer Manhole 38C-2 just upstream of the Poinsettia Lift Station and terminate at Manhole 38D-8, the first structure west of the intersection of Poinsettia Lane and El Fuerte Street. The proposed upsizing necessary to achieve hydraulic design standards consists of the following: 1. Upsize 1,650-feet of 12-inch sewer to 18-inch between MH 38C-2 to MH 38D-4 (Poinsettia Lift Station to Mica Road). 2. Upsize 910-feet of 12-inch sewer to 15-inch between MH 38D-4 to MH 38D-8 (Mica Road to approximately 330-feet west of El Fuerte Street). Cost Estimate The engineer’s opinion of probable cost to construct the pipeline upsize is $5,000,000 and is summarized in Appendix D. The opinion of probable cost includes the estimated contract cost for the improvements shown on Drawing No. 553-3, a construction contingency amount, engineering design, construction management and inspection, materials testing, and public outreach. The opinion of probable cost is supported by bid tabulations and service costs for recent capital improvement projects implemented by the city and neighboring agencies. Fee Methodology The SBA H fee will be allocated to each future EDU to be constructed within the sewer basin to fund the capacity-related portion of the proposed sewer improvements. The revenue generated by the fees to be collected from the remaining units must be proportional to the cost of the sewer improvements. Therefore, the sewer replacement fund will be used to fund the pipe replacement component of the project, representing the sewer capacity previously constructed and funded by SBA fees. Conclusion A total of 4,872 units are proposed within the basin at build-out, which is 727 units or 15% more than previously planned in the 2010 update. Of the 727 units, 204 have already been constructed and an additional 523 units are estimated for nine remaining undeveloped parcels representing five development sites. The current SBA H fee is $1,455 per unit, subject to annual inflation adjustment per the Engineering News Record Construction Cost Index (ENR CCI). The current fee will generate $755,735 from the remaining units to be constructed. The total cost of the proposed sewer improvements is $5,000,000. The anticipated fee will generate 15% of the total project cost and is proportional to the increased density planned within SBA H. Therefore, the current fee is adequate to fund the proposed development density’s proportionate share of the sewer capacity increase provided by the proposed sewer improvements and no adjustment to the SBA H fee is warranted. Future Projection The EDUs planned at build-out in this report represent the development density proposed by development applications, current approved land use and zoning, and density bonus estimates allowed by state housing law. This report does not grant approvals for sewer connections for future development and future development applications will be evaluated on a case-by-case basis. Revisions to the sewer basin’s maximum planned density, or EDUs, will be included in future flow estimates for adequate sizing of the sewer system at build-out. Changes in unit count and sewer flow may occur due to tenant improvements, residential accessory dwelling units (ADU)s, and increased student enrollment at schools. These increases are uncertain, unpredictable and generally less than the sewer demand of undeveloped sites within the basin. Further changes to local planning and state housing laws also have the potential to increase density allowances and associated sewer demands. Updates to the city’s Sewer Master Plan will monitor basin flows to evaluate the need for future facility improvements or adjustment to SBA H fee.
