A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS, AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THE POINSETTIA LANE SEWER IMPROVEMENTS AND BRESSI SEWER MANHOLE REHABILITATION PROJECTS, AND AUTHORIZING ADDITIONAL APPROPRIATION OF FUNDS FROM THE SEWER REPLACEMENT FUND TO CAPITAL IMPROVEMENT PROGRAM PROJECT NO. 5548 WHEREAS, the City Council of the City of Carlsbad, California, has determined that it is necessary, desirable and in the public interest to construct the Poinsettia Lane Sewer Improvements Project, Capital Improvement Program, or CIP, Project No. 5548-D, and the Bressi Sewer Manhole Rehabilitation Project, CIP Project No. 5503-26, collectively, the Project; and WHEREAS, the sewer pipeline and manholes are owned and operated by the city and are vital components of the wastewater collection system; and WHEREAS, the 2019 Sewer Master Plan Update identified the extents of sewer mains for replacement to convey build-out condition sewer flows in accordance with the city’s engineering standards; and WHEREAS, on March 25, 2025, the City Council approved the amended project scope for CIP Project No. 5548-D and determined that the project was exempt from further environmental review pursuant to the California Environmental Quality Act, or CEQA, Guidelines Section 15168 with Resolution No. 2025-072; and WHEREAS, the combined estimated construction contract value, including contingency, for the Project is $4,608,000; and WHEREAS, the plans, specifications and contract documents for the Project have been prepared, are on file at the City Clerk’s office and are incorporated herein by reference; and WHEREAS, the City Council’s adoption of these plans and specifications is required under Carlsbad Municipal Code Section 3.28.080(E) because the estimated construction contract value exceeds $220,000; and WHEREAS, additional appropriation in the amount of $2,726,045 is required to complete the Poinsettia Lane Sewer Improvements portion of the Project, CIP Project No. 5548-D; and Nov. 18, 2025 Item #5 Page 6 of 11 Docusign Envelope ID: 29AE5AA8-B8E7-44F0-8264-2C2C203E6B2E WHEREAS, sufficient funds are available to complete the Bressi Sewer Manhole Rehabilitation portion of the Project in CIP Project No. 5503-26. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.That the City Council has determined that in accordance with the California Environmental Quality Act, or CEQA, procedures and CEQA Guidelines sections 15080 through 15097, a Program Environmental Impact Report (PEIR), State Clearinghouse No. 2012021006 (City Planning Case No. EIR 12-01), was certified as complete on Nov. 13, 2012 by the City Council for the Sewer Master Plan and Carlsbad Municipal Water District Water Master Plan and Recycled Water Master Plan Updates (Resolution No. 2012-245). A first addendum to the Final EIR 12-01 was prepared for the 2019 Master Plan Update and adopted on Sept. 17, 2019, (Resolution No. 2019-183). Pursuant to CEQA Guidelines section 15168, the request to approve a change in the scope of work for CIP Project No. 5548 is within the scope of the Project covered by a previously certified PEIR and no new environmental document is required. There is no public review period required. The effects of the Project were examined in the PEIR and Addendum and all feasible mitigation measures and alternatives developed in the PEIR are incorporated into the resolution approving the change in the scope of work for CIP Project No. 5548. Further, since no changes to the PEIR or Addendum are necessary to support the Project, the city is not required to prepare an Addendum or Supplemental EIR to the PEIR per State CEQA Guidelines section 15164. Therefore, the prior PEIR is sufficient to support the proposed action. No further analysis or environmental documentation is required. 3.That the City Council has determined that the proposed action of rehabilitation of existing sewer manhole structures is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or Nov. 18, 2025 Item #5 Page 7 of 11 Docusign Envelope ID: 29AE5AA8-B8E7-44F0-8264-2C2C203E6B2E former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or CMC Section 19.04.070(C) apply. 4.That the City Manager or designee is authorized to appropriate funds from the Sewer Replacement Fund in an amount of $2,726,045 to CIP Project No. 5548. 5.That the plans, specifications and contract documents for the Project are hereby adopted and on file in the Office of the City Clerk. 6.That the City Clerk is hereby authorized and directed to publish, in accordance with state law, a notice to contractors inviting bids for construction of the Project in accordance with the referenced plans and specifications. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 18th day of November, 2025, by the following vote, to wit: AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin.
