HomeMy WebLinkAbout1991-06-05; Design Review Board; ; RP 90-06|CDP 90-03 - VISTA/CARLSBAD SEWER INTERCEPTORSTAFF REPORT DATE: JUNE 5, 1991 TO: DESIGN REVIEW BOARD FROM: PLANNING DEPARTMENT SUBJECT: RP 90-6/CDP 90-3 - VISTA/CARLSBAD SEWER INTERCEPTOR - Request for a Redevelopment Permit and Redevelopment Coastal Permit to allow the constmction of a 36" to 48" sewer interceptor within the City's right-of-way along Jefferson Street and Oak Avenue, and within the AT&SF Railroad right-of-way from Oak Avenue to the southem redevelopment boundary. I. RECOMMENDATION That the Design Review Board ADOPT Design Review Board Resolution No. 166 recommending approval of the Negative Declaration issued by the Planning Director, and ADOPT Resolution No's. 167 and 168 recommending approval of RP 90-6 and CDP 90-3 based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND The proposed public works project consists of the replacement and expansion of the Vista/Carlsbad Sewer Interceptor, which is the major trunk system serving the nonhem half of the City. The interceptor extends from the Buena Vista Lagoon, through the downtown area and Agua Hedionda Lagoon to the Encina Water Pollution Control Facility Treatment Plant. The project includes the constmction of a 36" to 48" replacement interceptor parallel to the existing interceptor within the rights-of-way of Jefferson Street from 1-5 to Oak Avenue, Oak Avenue to the railroad right-of-way, and south along the railroad right-of-way to a point 1,400 feet south of Tamarack Avenue. Section 65401 ofthe Califomia Govemment Code requires that a General Plan Consistency Determination be made for major public works projects. This Consistency determination for the project was made by the Planning Commission on May 15, 1991. The Interceptor expansion is required due to projected capacity deficits identified in the Zone 1 Local Fadlities Management Plan and the Cit/s Master Sewerage Plan. The expanded interceptor satisfies through buildout the Zone 1 Growth Management Performance Standard for sewer collection systems requiring trunk line capacity to meet demand. The existing interceptor will be abandoned and each new segment will be constmcted when the lines can no longer meet current or future demand. Constmction will consist of trench grading to bury the new interceptor parallel to exisling lines within the City and railroad rights-of-way. [s the proposed public works project consistent with the Village Redevelopment Zone as specified in the Village Area Redevelopment Pian? 2. Are the proposed improvements consistent with the Land Use and Public Facilities Elements of the General Plan? 3. Is the proposed project consistent with the Village Redevelopment Local Coastal Program as specified in the Village Design Manual? Village Redevelopment Zone Approval of the proposed major public works project is consistent with the Redevelopment Zone since the Village Area Redevelopmenl Plan authorizes the Housing and Redevelopment Commission to make provisions for the constmction of pubUc utilities necessary to carry out the Plan's goals and objectives. The Redevelopment Zone is subject to the Growth Management standard for sewer collection systems requiring that tmnk line capacity to meet demand must be provided concurrent with development. The City's Master Sewerage Plan indicates that the above described improvements to the Vista/Carlsbad Interceptor will be required to meet existing as well as buildout demand; therefore, approval of the new Interceptor is necessary to accomplish the goals and objectives set fonh in the Redevelopment Plan. General Plan Consistency One overriding goal of the Public Facilities Element of the General Plan is to ensure that adequate public facilities are available for the existing and future population of the City. This project achieves this objective by providing existing and future residents in Zone 1 with an adequate sewer collection system through buildout of the City. The Land Use Element of the General Plan states that the Planning Depanment should: 1) permit the development of land only after adequate provision for services such as transportation, water, sewerage, utilities, and public facilities; and 2) develop programs which would correlate rate of growth and service capabilities of the City. This project which provides an adequate sewer collection system to meet the exisling and future demand of the area as required by the Growth Management Ordinance is consistent with these policies. RP 90-6/CDP 90-3 - VISTA/CARLSBAD SEWER INTERCEPTOR JUNE 5, 1991 PAGE 3 Village Redevelopment Coastal Development Program The portion of the project within the Village Redevelopment Coastal Program area is consistent with the Local Coastal Plan since the expanded capacity of the new sewer interceptor will allow development to proceed to meet projected future demand based on the existing General Plan designations regulating residential density and commercial/industrial uses. Trench grading in the existing street rights-of-way to bury the interceptor segments will minimize prolonged constmction impacts such as traffic, dust, and noise. In summary, the proposed improvements to the Vista/Carlsbad Sewer Interceptor are consistent with the above General Plan goals and policies, the Redevelopment Zone, and the Local Coastal Program; therefore. Staff recommends that the Design Review Board recommend approval of Redevelopment Permit RP 90-6 and Coastal Development Permit CDP 90-3 as conditioned. IV. ENVIRONMENTAL REVIEW The Planning Director has determined that the projeci will have no significant environmental impacts and has issued a Negative Declaration on December 28, 1990. This Planning Director's decision was based on the Initial Study and a field visit conducted by staff. The project will replace an exisling sewer interceptor and will be locaied undemeath existing streets, and therefore will creale no significant environmental impacts. The Negative Declaration was sent to the Slate Clearinghouse for agency review and no comments were received. ATTACHMENTS 1. Design Review Board Resolution No. 166 2.
