Background On June 20, 2025, Cal/OSHA conducted an in-person inspection at the Maerkle Reservoir facility. The inspection was carried out by a Cal/OSHA compliance inspector who had not previously examined the Maerkle Reservoir facility. On October 22, 2025, a subsequent meeting was convened to discuss the findings of the inspection. The inspector identified four general violations, which are described in Attachment A, Cal/OSHA Citation and Notification of Penalty. On November 20, 2025, the Carlsbad Municipal Water District (CMWD) submitted Attachment B to Cal/OSHA to comply with the 15-day response requirement. Citation The violations are summarized below with the responses/actions from the CMWD: Citation 1 Item 1 Violation Noted: Respiratory Protection. The employer failed to identify and evaluate the respiratory hazard in the workplace and did not perform the reasonable estimate of employee exposure to 19% ammonia when it was transferred to tank #2. The employer failed to base respirator selection on the reasonable estimate of employee exposure to 19% ammonia located in the ammonia room. Response/ Action -In May 2020, an industrial hygiene study was conducted in the form of personnel monitoring of one operator conducting the ammonia transfer process. Although the employee wore a National Institute for Occupational Safety and Health (NIOSH)-approved Carlsbad Municipal Water District 5950 El Camino Real I Carlsbad, CA 92008 I 442-339-2722 t CMWD Board Memo -CalOSHA Citation and Notification of Penalty at Maerkle Facility December 4, 2025 Page 2 full-face respirator with appropriate cartridges during the initial study, there was no follow-up area testing to confirm the environment was not Immediately Dangerous to Life or Health (IDLH) potentially creating a hazard to employees working at this location. In June 2020, the CMWD made a process change shortly after the initial industrial hygiene study to make the handling of ammonia safer by limiting the amount of time personnel were inside the room during the transfer. The CMWD did not ensure that the employee signed the documentation or followed through with the necessary finalization of the paperwork required for such incidents. In response to this citation, on October 30, 2025, staff completed another industrial hygiene study to capture both personnel exposure limits and the area saturation of hazardous vapors. Additionally, steps have been taken to ensure that the CMWD documents, signs and files each incident in a timely manner. Citation 1 Item 2 Violation Noted: Respiratory Protection. The employer failed to ensure that employees utilize a NIOSH-approved respirator for escaping IDLH atmosphere developed during foreseeable emergencies when opening chlorine equipment and changing ton containers. Response/Action -In the initial industrial hygiene study conducted in May 2020, it was noted that during the chlorine transfer process, the employee utilized a full-face respirator that was approved by NIOSH, equipped with appropriate cartridges. Subsequent findings revealed that the cartridge utilized during this operation was only capable of withstanding a minimum exposure level of 5 parts per million (ppm), failing to meet the peak exposure limit of 99 ppm. Typically, this peak regulation is a requirement specific only to water treatment plants; however, it has now been extended to encompass all interactions involving chlorine. To comply with this heightened requirement, staff have conducted research and procured compliant cartridges for each operational employee, ensuring that these new cartridges will exceed the specified peak exposure limit. Citation 1 Item 3 Violation Noted: Airborne Contaminants. The employer failed to monitor the level of ammonia vapors during the transfer of 19% ammonia in tank #2 located in the ammonia room. The employer did not ensure that employees were not exposed to ammonia vapors in excess of levels permitted. Response/Action -The chlorine and ammonia detectors situated in the ammonia room were positioned in the corner opposite to the area where the employee replaces the ammonia transferred to the #2 tank. In addition to changing the face cartridges, as outlined in the Response/Action to Citation 1 Item 2 above, the employee will now be required to utilize a Honeywell single-gas detector, which is rated for chlorine and ammonia, during the transfer CMWD Board Memo -CalOSHA Citation and Notification of Penalty at Maerkle Facility December 4, 2025 Page 3 process. This will ensure that the vapor levels for ammonia and chlorine will be monitored wherever the employee is located. Citation 1 Item 4 Violation Noted: Process Safety Management of Acutely Hazardous Materials. The employer failed to ensure that the emergency "B" Kits for chlorine are sealed after each inspection, and such seals were broken only by authorized persons or in case of accidents. Response/ Action -The B Kits are now sealed, and staff have revised the processes to ensure that the B Kits are resealed when broken. Penalty Attachment A shows a proposed penalty of $1,820 for the four violations. The penalty was paid prior to the due date of November 26, 2025. Citation and Notification of Penalty Page 3 of 14 Cal/OSHA-2 V 1 Rev O 1 /2024 EMPLOYEE RIGHTS Employer Discrimination Unlawful -The law prohibits discrimination by an employer against an employee for filing a complaint or for exercising any rights under Labor Code Section 63 l O or 63 l l. An employee who believes that he/she has been discriminated against may file a complaint no later than six (6) months after the discrimination occurred with the Division of Labor Standards Enforcement. Employee Appeals -An employee or authorized employee's representative may, within 15 working days of the issuance of a citation, special order, or order to take special action, appeal to the Occupational Safety and Health Appeals Board the reasonableness of the period of time fixed by the Division of Occupational Safety and Health (Division) for abatement. An employee appeal may be filed with the Appeals Board or with the Division. No particular format is necessary to initiate the appeal, but the notice of appeal must be in writing. If an Employee Appeal is filed with the Division, the Division shall note on the face of the document the date of receipt, include any envelope or other proof of the date of mailing, and promptly transmit the document to the Appeals Board. The Division shall, no later than l O working days from receipt of the Employee Appeal, file with the Appeals Board and serve on each party a clear and concise statement of the reasons why the abatement period prescribed by it is reasonable. Employee Appeal Forms are available from the Appeals Board, or from a district office of the Division. Employees Participation in Informal Conference -Affected employees or their representatives may notify the District Manager that they wish to attend the informal conference. The box should be sealed after each inspection and such seals should be broken only by authorized persons or in case of accidents. Many owners coordinate routine inspection with training drills. All Viton gaskets are stamped with the date of manufacture and should be removed from emergency use after a four-year shelf life.
