Dear Mr. Hasan,
As of this date our records reveal that you have not yet made
application for permit for the construction of the attic conversion
at the above mentioned address. Please see the attached copy of
your letter dated July 20, 1990. During the meeting we had here at
my office you stated your intent to settle this matter as soon as
possible.
This matter has been an open case for over three years and the City
has been more than patient regarding it; however the City can no
longer ignore the violation and the need to bring the property into
compliance. If you fail to make an application for the required
permits for the construction by October 1, 1990 this office will
request immediate legal action from the City Attorney. Action will
be to file charges for violations of Carlsbad Municipal Code,
Sections 18.04.010, 18.12.080,and 18.16.010, for the lack of
obtaining proper approval and permits for the construction.

This is a rep l y regarding Michael Ha rrington's certif ied letter
dated 7-06-1990. I don't h ave any final plans dra wn up for
the reconstruction of t he addition in v iolation. I have an
architect (James Chi n ) and a contractor and we are a ll going to
get together on 7-26-1990 and then I will make a decision
related to the final plans for t he reconstruction.
I did not receive payment for the construction until about 5
mClnths ago. The delay of a li ttl e more tha n 2 years was beyond my
control.
What is s lowing things a l ittle n o w is I am looking into
possi bl y extending the upstairs by an additional 200 square f e et
depending on cos t . I will have final plans ready for approval b y
the city as soon as tha t deci s ion is made and final p l ans are
drawn out which should be i n about four to five weeks.
I am just as anxious to fini sh the reconstructi on so I can start
using the upstairs for something besides a storage are.

This letter is t~ inform you that this office can no longer stay
legal action regarding the construction of the attic conversion
without proper approval and permits at the above referenced
address. The City has been more than reasonable in delaying action
regarding this matter in hopes that the litigation would solve the
financial burden you face to bring this construction into
conformance; however action to comply can no longer be delayed.
To comply you must submit the required plans, two sets, and obtain
the necessary permits for the construction. As the owner of the
property you are responsible for the property and can be charged
with violations of Carlsbad Municipal Code, Section 18.04.010, the
construction of an attic conversion without proper approval and
permits. If you fail to comply by JULY 24. 1990 this office will

notice 5 days after escrow closed . Indicates construction without
permits. I told hi m the story and sent him a copy of your
memo, officia l notice and Tony's memo.

I told Mr. Waldrip what Mr. Mata told me regarding the inspection and
requirements to bring the property into conformance.
1. Remove the batltroom fiacilties
2. Enclose the stairway and erect a door to seperate the area
of the atti c ( for storage only) and the rest of the living

3. Submit ~ plans reflecting all work done and the proper
dimen sions of the attic/for storage only and the room addition

The attic conversion at 2719 York Dr. upon physical inspection does not
meet any acceptable code criteria. Seven foot height ceiling is not
acceptable for a den as submitted on working plans. The additional
bathroom constructed also does not meet the required door heights.
Plus the corridor to the bathroom measures 6'4" and is not acceptable.
I have advised them that they can comply to acceptable code demands by
meeting all the code criteria for Occupancy requirements for (R OCC) or,
convert back to attic use by walling up and installing door separation,
and removing all bathroom facilities.
This department cannot accept what has been constructed without a
permit.
The first floor addition of a Family Room, I feel, mee ts code criteria
and is very well done with double window pane, R-11 walls insulation and
R-19 board insulation on the roof area .
