APPROVAL OF MINUTES: Minutes of the Regular Meeting held Oct. 21, 2025 Minutes of the Regular Meeting held Oct. 28, 2025 Minutes of the Special Meeting held Nov. 18, 2025 Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, to approve the minutes as presented. Motion carried unanimously, 5/0. PRESENTATIONS: None. PUBLIC REPORT OF ANY ACTION TAKEN IN CLOSED SESSION: City Attorney Cindie McMahon announced that there was no reportable action. PUBLIC COMMENT: Glenn Bernard spoke regarding Arizona State Senator Mark Kelly and expressed his concern for the closure of pharmacies in the City of Carlsbad. Mike Borrello spoke regarding climate change and urged the City Council to install a walkway over El Camino Real for access to Carlsbad High School and Valley Middle School. (Staff contact: Zach Korach, Administrative Services) Glenn Bernard spoke about a report on Social Security, retirement packages, and federal pay packages and suggested that all City employees should be enrolled in Social Security. CS-501 – INSTALL ALL-WAY STOP CONTROL AT THE INTERSECTIONS OF JEFFERSON STREET AND OAK AVENUE, MADISON STREET AND CHESTNUT AVENUE, ROOSEVELT STREET AND CHESTNUT AVENUE AND MADISON STREET AND MAGNOLIA AVENUE – Adoption of Ordinance No. CS- 501 amending Title 10, Chapter 10.28 of the Carlsbad Municipal Code to amend Sections 10.28.110, 10.28.120, 10.28.130, 10.28.270, 10.28.810 and 10.28.997 to establish all-way stop control at the intersections of Jefferson Street and Oak Avenue, Madison Street and Chestnut Avenue, Roosevelt Street and Chestnut Avenue, and Madison Street and Magnolia Avenue. CALIFORNIA COASTAL COMMISSION’S SUGGESTED MODIFICATIONS TO THE HOUSING ELEMENT REZONE PROGRAM AND LAND USE AND ZONING MAP CORRECTIONS – 1) Hold a public hearing; and 2) Adoption of Resolution No. 2025-257 acknowledging receipt of and approving the California Coastal Commission’s suggested modifications to the Local Coastal Program, as well as correcting mapping errors on sites 1, 2, 4 and 19 for GPA 2022-0001/LCPA 2022-0015 - Housing Element Rezone Program; and 3) Introduced Ordinance No. CS-502 acknowledging receipt of and approving the California Coastal Commission’s suggested modifications to the Local Coastal Program, as well as correcting mapping errors on sites 1, 2 and 4 for ZCA 2022-0004/ZC 2022-0001/AMEND 2023-0010/LCPA 2022-0015 - Housing Element Rezone Program. Motion carried unanimously, 5/0. 7. ORDINANCE NO. CS-498 – ADOPTING THE CALIFORNIA BUILDING CODE AND RELATED CALIFORNIA CODES FOR CONSTRUCTION, ALONG WITH LOCAL AMENDMENTS (MCA 2025-0001) – 1) Hold a public hearing; and 2) Adoption of Ordinance No. CS-498, amending Carlsbad Municipal Code Chapters 18.03 – General Provisions, 18.04 – Building Code, 18.08 – Historical Building Code, 18.09 – Existing Building Code, 18.10 – Mechanical Code, 18.12 – Electrical Code, 18.16 – Plumbing Code, 18.18 – Solar Energy Code, 18.19 – Dangerous Building Code, 18.20 – Residential Code, 18.21 – Green Building Standards Code, and 18.30 – Energy Conservation Regulations. CS-499 AND CS-500 – ADOPTING THE 2025 CALIFORNIA FIRE CODE AND THE 2025 CALIFORNIA WILDLAND-URBAN INTERFACE CODE, ALONG WITH LOCAL AMENDMENTS – 1) Hold a public hearing; and 2) Adoption of Ordinance No. CS-499, repealing the existing Carlsbad Municipal Code Chapter 17.04 (Fire Prevention Code) and adopting a new Chapter 17.04 (Fire Prevention Code) based on the 2025 edition of the California Fire Code; and 3) Adoption of Ordinance No. CS-500, establishing a new Carlsbad Municipal Code Chapter 17.06 (Wildland-Urban Interface Code) based on the 2025 edition of the California Wildland-Urban Interface Code. Motion carried unanimously, 5/0. DEPARTMENTAL AND CITY MANAGER REPORTS: 9. HOMELESSNESS ACTION PLAN FISCAL YEAR 2024-25 ANNUAL REPORT AND FISCAL YEAR 2026-27 FUNDING PLAN – 1) Received the fiscal year 2024-25 Annual Report on the Homelessness Action Plan; and 2) Adoption of Resolution No. 2025-258 approving the fiscal year 2026-27 Homelessness Action Plan Funding Plan and directing city staff to include the funding plan’s activities in the city’s Preliminary Operating Budget. (Staff contact: Mandy Mills and Chris Shilling, Community Services) City Manager’s Recommendation: Receive the report and adopt the resolution. Homeless Services Manager Chris Shilling and Police Lieutenant Shaun Lawton reviewed a PowerPoint presentation (on file in the Office of the City Clerk). Teri Jacobs commended staff for their work on the Homelessness Action Plan, expressed her concern that Carlsbad might become a magnet to homelessness services and spoke in support of Proposition 36. Vanessa Forsythe commended staff for their work on addressing the homelessness issue, expressed her concern for the increase in newly homeless individuals in Carlsbad and opposed fines being imposed on individuals living in their vehicles. Motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, to adopt Resolution No. 2025-258. Motion carried unanimously, 5/0. 10. E-BIKE SAFETY STRATEGY OPTIONS – Received an update on e-bike safety strategies and provide direction to staff as desired. (Staff Contact: Jason Arnotti, Police, and Jennifer True, City Attorney) City Manager’s Recommendation: Receive the report and provide direction to staff as desired. Peter Penseyres spoke on the laws the City of Carlsbad already has in place for the safety of bicyclists and encouraged regulations for unsafe passing be added to the Carlsbad Municipal Code. Motion by Mayor Blackburn, seconded by Council Member Acosta, to eliminate Recommendation #5: Adopt an ordinance prohibiting those under 16 from operating e-bikes during hours of darkness, with the ability to reconsider once staff comes back with the statistics of incidents during the hours of darkness. Motion carried unanimously, 5/0. Motion by Council Member Bhat-Patel, seconded by Council Member Acosta, adding language to Recommendation #4 to include correct and legal passing rules, and modifying Recommendation #6 to grant the City Manager the authority to make decisions on the prohibition of the operation of e-bikes beyond the ban at Pine and Poinsettia Ave Community Parks. Motion carried unanimously, 5/0.
