SUBJECT: CDP 2022-0025/MS 2023-0001 (DEV2021-0096) -MADDOX MINOR SUBDIVISION -lST
EXTENSION
The Planning Division has completed a review of your application for the 1st Extension of Minor Coastal
Development Permit CDP 2022-0025 and Minor Subdivision MS 2023-0001 -MADDOX MINOR
SUBDIVISION, submitted on September 10, 2025. The project site, located at 4208 Highland Drive and in
the Mello II segment of the Coastal Zone, was approved to be subdivided into three lots on September
22, 2023 and is due to expire on September 22, 2025. After careful consideration of the circumstances
surrounding this request, it has been determined that (1) the first extension of Minor Coastal
Development Permit CDP 2022-0025 and Minor Subdivision MS 2023-0001 -MADDOX MINOR
SUBDIVISION was submitted in a timely manner prior to the expiration date, (2) there has been no change
of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations,
(3) the project is still in compliance with the Minor Coastal Development Permit regulations and Minor
Subdivision regulations, and (4) that the findings required for granting a Minor Coastal Development
Permit and Minor Subdivision Extension can be made; therefore, the Assistant Director of Community
Development APPROVES the 1st Extension of Minor Coastal Development Permit No. CDP 2022-0025
and Minor Subdivision MS 2023-0001 for two (2) years (from September 22, 2025 to September 22,
2027), based on the following findings and conditions.
Findings:
1. All of the findings contained in the administrative approval letter dated September 22, 2023 for
Minor Coastal Development Permit CDP 2022-0025 and Minor Subdivision MS 2023-0001 apply to
this extension and are incorporated herein by reference and remain in effect.
2. That the 1st two-year extension (from September 22, 2025 to September 22, 2027) is appropriate
because the project is still consistent with the Minor Coastal Development Permit and Minor
Subdivision regulations, and the extension would allow the owner/applicant to preserve existing
property entitlements while satisfying the conditions for the three-lot subdivision.
3. That such permits and approvals as extended are consistent with the requirements of Titles 20 and
21 of this code at the time of their extension.
4. That the Assistant Director of Community Development has determined that the project is exempt
from the requirements of the California Environmental Quality Act (CEQA) per Sections 15315-Minor
Land Divisions of the State CEQA Guidelines and will not have any adverse significant impact on the
environment.

Conditions:
1. This 1st Extension of Minor Coastal Development Permit CDP 2022-0025 and Minor Subdivision MS
2023-0001 is granted from September 22, 2025 to September 22, 2027. If building permits for this
project are not obtained within this time period, the Minor Coastal Development Permit extension
will expire on September 22, 2027 unless extended per Section 21.201.210 of the Carlsbad Municipal
Code.
2. All of the conditions contained in administrative approval letter dated September 22, 2023 for Minor
Coastal Development Permit CDP 2022-0025 and Minor Subdivision MS 2023-0001 apply to this
extension and are incorporated herein by reference and remain in effect.

NOTICE
Please take NOTICE that approval of your project includes the "imposition" of fees, dedications,
reservations, or other exactions hereafter collectively referred to for convenience as "fees/exactions."
You have 90 days from the date of final approval to protest imposition of these fees/exactions.
If you protest them, you must follow the protest procedure set forth in Government Code Section
66020(a), and file the protest and any other required information with the City Manager for
processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow
that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul
their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT
APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other
similar application processing or service fees in connection with this project; NOR DOES IT APPLY to any
fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute
of limitations has previously otherwise expired.
This decision may be appealed by you or any other member of the public to the Planning Commission
within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at
1635 Faraday Avenue in Carlsbad, along with a payment of $952. The filing of such appeal within such
time limit shall stay the effective date of the order of the City Planner until such time as a final decision
