Subject: Amendment and Extension of Design Services Agreement with LPA, Inc.
for Additional Contract Administration Services for the Monroe Street
Pool Renovation and Replacement Project and Additional Funding
District: 1
Recommended Action
Adopt a resolution authorizing an amendment and extension of the design services agreement
with LPA, Inc. for additional contract administration services for the Monroe Street Pool
Renovation and Replacement Project and appropriating additional funding.
Executive Summary
The city is rebuilding the 43-year-old Monroe Street Pool to address aging infrastructure and
ensure the popular facility meets current health, safety and building code requirements.
The City Council authorized an amendment to the professional services agreement with LPA,
Inc. to develop design and construction plans and specifications for the Monroe Street Pool
Renovation and Replacement Project on Feb. 14, 2023.
The project, Capital Improvement Program Project No. 4724, is now approximately 50%
complete, and LPA has exhausted the budget for contract administration services that has been
provided since the start of the project. LPA has submitted a proposal to amend and extend the
professional services agreement with the city to continue these services through the forecasted
end of the project, which is currently Sept. 18, 2026.
City Council authorization of the amendment is required under Carlsbad Municipal Code
Section 3.28.040, Procurement and disposition responsibilities, because the value of the
amendment is more than $100,000.
Explanation & Analysis
LPA, the architect of record for the project, was contracted to provide construction
administration services as part of the professional services agreement to complete the design
and construction phases of the project.
The design work was then completed and permitted.

•On Sept. 10, 2024, the City Council authorized staff to post the contract documents for
bid advertisement.
•On Jan. 14, 2025, the City Council awarded a construction contract to Edwards
Construction Group, Inc.
•On March 27, 2025, staff issued a notice to proceed to Edwards.
•Construction work began on March 31, 2025.
Even though construction of the project is now about 50% complete, LPA has now exhausted
the budget for these services because of several design changes that required more services
from the design team and accelerated the use of the contract administration services budget.
One design change was the result of incorrect information from a previous contractor, which
required a change to bring in the correct amount of water to the site. Others were because of
the unforeseen condition of extensive termite damage and design changes initiated by staff due
to recent lessons learned on projects at the Alga Norte Aquatics Center.
After the City Council’s Feb. 14, 2023, approval of Amendment 3, the city issued three
amendments to the professional services agreement, all within the City Manager’s authority:
•Amendment No. 4, for design and engineering services related to the administration
building roof replacement because of the termite damage
•Amendment No. 5, for design and engineering services related to the increased water
service to the site and a revision to the type of lockers to be installed
•Amendment No. 6, for design services to revise the lobby area of the administration
building
The agreement’s budget for the contract administration was nearly depleted, so LPA contacted
city staff and provided a proposal to amend and extend these services.
Staff are requesting that the City Council authorize Amendment No. 7 to the Agreement with
LPA and fund it by appropriating $243,000 from the Infrastructure Replacement fund, General
Capital Construction Fund and park-in-lieu fees.
LPA’s extended contract administration services will be performed until the project’s
completion, currently projected for Sept. 18, 2026.

Fiscal Analysis
The project is funded by the Infrastructure Replacement Fund, General Capital Construction
Fund and park-in-lieu fees. Budgeted funds have been set aside for the remaining categories of
work on site, and staff request additional appropriation in an amount not to exceed $243,000
from the Infrastructure Replacement Fund, General Capital Construction Fund and park-in-lieu
fees for the additional contract administration services needed.
Monroe Street Pool Renovation and Replacement Project
Capital Improvement Program Project No. 4724
Total appropriation to date $20,164,978
Total expenditures and encumbrances to date -$19,260,802
Total available balance $904,176
Amendment No. 7 with LPA -$242,935
Contingency budget for furniture, fixtures and equipment
(estimated) -$503,362
Special inspections and staff oversight time (estimated) -$78,222
Public art and outreach (budgeted) -$322,592
Total remaining project costs -$1,147,111
Remaining balance -$242,935
Additional appropriation needed (rounded) $243,000
On Jan. 14, 2025, when the construction contract was awarded, excess project funding of over
$1.4 million was returned to the funding sources because the winning construction bid was
lower than what had been estimated, as shown in the table below:
Balance returned to the funding sources based on award of a
construction bid lower than the estimate $1,402,074
General Capital Construction Fund (53%) $743,099
Infrastructure Replacement Fund (34%) $476,705
Park-in-lieu Fees – Northwest Quadrant (13%) $182,270
Based on the percentages in the table above, staff recommend that the additional funding
needed for Amendment No. 7 come from each of these three funds in the amounts as shown
below:
Additional appropriation needed (rounded) $243,000
General Capital Construction Fund (53%) $128,790
Infrastructure Replacement Fund (34%) $82,620
Park-in-lieu Fees – Northwest Quadrant (13%) $31,590

Next Steps
With the City Council’s authorization for the Mayor to sign Amendment No. 7, staff will amend
and extend the agreement with LPA to provide contract administration services through the
end of the project.
Environmental Evaluation
The proposed action is not a “project” as defined by California Environmental Quality Act
Section 21065 and CEQA Guidelines Section 15378(a) and does not require environmental
review under CEQA Guidelines Section 15060(c)(2) because the action is limited to the
execution of an amendment to a professional services agreement to provide additional contract
administration services for the Monroe Street Pool Renovation Project. The action has no
potential to cause either a direct physical change in the environment or a reasonably
foreseeable indirect physical change in the environment.
