Recommended Action
Adopt a resolution authorizing additional appropriation of funding in an amount not to exceed
$147,000 for the State Street Parking Lot Electric Vehicle Charging Stations Project.
Executive Summary
This project will install an additional six electric vehicle charging stations serving 10 stalls in the
city-owned parking lot at 3021 State St. The EV chargers have been procured as authorized by
the City Council and are awaiting installation.
The total estimated construction cost is $237,800, including construction, contingency and
construction management and inspection services. Most of the initial project funding has been
expended or encumbered, so additional funding in an amount not to exceed $147,000 is needed
to complete the project.
Staff request that the City Council authorize an additional appropriation of $147,000 from the
Public Facilities Fees Fund to the State Street Parking Lot Electric Vehicle Charging Stations
Project, Capital Improvement Program Project No. 4090.
Explanation & Analysis
The charging stations at the State Street parking lot have consistently had the highest public use
of all the city-owned public charging stations. There is one charging station that serves two stalls
used by the public at the parking lot. A location map is provided as Exhibit 2.
The installation of six additional charging stations, including two Level 3 charging stations and
four Level 2 charging stations, which can charge two vehicles at once,1 will provide chargers in

overnight charging.). Level 2 chargers will fully charge an electric vehicle in about 5-6 hours. Level 3 chargers, also
called DC fast chargers, significantly reduce charging times to under an hour, typically between 15 and 45 minutes.

10 more spaces, allowing for more public use of electric vehicle charging services in the lot.
Users pay fees for the service.
The city approved and began the electric vehicle charging project in 2023, with SDG&E
responsible for designing and installing the utility-owned electrical infrastructure under a special
tariff, Rule 45. Since then, the city:
•Approved an easement giving SDG&E access to the site.
•Purchased and obtained the charging stations.
•Accepted a $350,000 grant from the California Energy Commission to help fund the
project. This state grant funding was included in the California Budget Act of 2023 at the
request of Assemblymember Tasha Boerner.
•Completed the design and obtained the necessary permits for the project.
SDG&E unexpectedly terminated the Rule 45 agreement in August 2025 because the California
Public Utilities Commission had capped funding for that program. As a result, the city had to shift
to a different SDG&E tariff, Rule 16, to obtain the required electrical infrastructure. Under Rule
16, the city receives a cost allowance. SDG&E now expects the required upgrades to cost less
than that allowance, so no additional SDG&E charges are anticipated.
SDG&E has now completed its revised design and is ready to move into construction. However,
once the city updated its construction cost estimate for the portion of the work it must build,
staff determined that the remaining project costs are expected to exceed the funding currently
budgeted for the project.
The project’s estimated remaining costs along with current encumbrances are anticipated to
exceed the project’s current appropriations, so staff are requesting that the City Council
authorize an additional appropriation of $147,000 to cover all anticipated project costs through
completion of the project.
Carlsbad Municipal Code Section 3.28.080 authorizes award of construction contracts of less
than $220,000 through informal bidding procedures. Under Municipal Code Section 3.28.080(H),
the City Manager or designee shall award all such contracts. Since the estimate of $193,000 is
less than $220,000, the City Manager or designee can award the contract and will select the
lowest responsive and responsible bidder.

Fiscal Analysis
Staff are requesting an additional appropriation in the amount of $147,000 from the Public
Facilities Fees Fund to Capital Improvement Program Project No. 4090, as shown in following
table.
Next Steps
Upon City Council approval, the City Manager or designee will appropriate $147,000 from the
Public Facilities Fees Fund to CIP Project No. 4090. Staff will continue to work with SDG&E to
issue the utility service order under SDG&E Rule 16, and staff will proceed with informal bidding
procedures for the portion of the project that the city is responsible for constructing.
Upon receipt and evaluation of bids, the City Manager or designee will award a construction
contract to the lowest responsive and responsible bidder. Completion of all remaining
construction work is expected to be completed in approximately six months, around late
summer 2026.
Upon completion of the project, staff will submit the final project report that is required by the
California Energy Commission grant agreement requesting the final $175,000 payment.
Environmental Evaluation
The proposed action for the installation of additional electric vehicle charging stations is
categorically exempt from environmental review under the California Environmental Quality Act,
or CEQA, Guidelines Section 15301 because it involves the maintenance, repair or minor
alteration of existing facilities with negligible or no expansion of the existing or former use. No
exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or
Carlsbad Municipal Code Section 19.04.070(C) apply.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING ADDITIONAL APPROPRIATION OF FUNDING IN
AN AMOUNT NOT TO EXCEED $147,000 FOR THE STATE STREET PARKING
LOT ELECTRIC VEHICLE CHARGING STATIONS PROJECT
WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary,
desirable and in the public interest to construct the State Street Parking Lot Electric Vehicle, or EV,
Charging Stations Project, Capital Improvement Program, or CIP, Project No. 4090, or Project; and
WHEREAS, staff have procured six new EV charging stations, which will serve 10 stalls, in the
city-owned State Street Parking Lot located at 3021 State Street; and
WHEREAS, the new EV charging stations have arrived and are ready for installation; and
WHEREAS, staff are working with San Diego Gas & Electric, or SDG&E, to extend the utility-
owned electrical distribution lines necessary to support the Project; and
WHEREAS, the Project’s plans, specifications and contract documents have been permitted, and
the Project is ready to move into the construction phase; and
WHEREAS, the estimated total cost to complete the Project has increased and additional
funding is needed prior to bidding the Project for construction; and
WHEREAS, staff request an additional appropriation of $147,000 from the Public Facilities Fees
Fund to CIP Project No. 4090; and
WHEREAS, Carlsbad Municipal Code Section 3.28.080 authorizes award of construction
contracts of less than $220,000 through informal bidding procedures, and the City Manager or designee
shall award all informal contracts; and
WHEREAS, since the engineer’s estimate of $193,000 is less than $220,000, staff anticipate that
