Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 PLEDGE OF ALLEGIANCE: Chair Chung led the Pledge of Allegiance. APPROVAL OF MINUTES: Minutes of the regular meeting held Dec. 4, 2025 Motion by Commissioner Breyer, seconded by Commissioner Ferone, to approve the minutes as presented. Motion carried, 7 /0. PRESENTATIONS: None. PUBLIC COMMENT: None. CONSENT CALENDAR: None. PUBLIC HEARING: None. DEPARTMENTAL REPORTS: 1. RALPH M . BROWN ACT AND PUBLIC RECORDS ACT PRESENTATION: Receive a presentation regarding the Ralph M. Brown Act and Public Records Act. (Staff contact: Morgen Fry, City Clerk's Office; Cindie McMahon, City Attorney) Recommended Action: Receive the presentation. The Commission received the presentation. City of Carlsbad Attorney Cindie McMahon and Assistant City Clerk Morgen Fry shared a PowerPoint presentation (on file in the Office of the City Clerk.) Commissioner Breyer requested clarification on what is considered a meeting amongst Arts Commissioners and City Attorney McMahon stated a discussion is classified as a meeting when the discussion is in regard to subject matter jurisdiction. Commissioner Nassiri asked if the meeting is publicly noticed, does the meeting have to take place in Council Chambers. City Attorney McMahon and City Clerk Fry, advised that yes the meeting does need to take place in Council Chamber due to the recording and streaming capabilities of the meetings. Commissioner Nassiri also asked if the same goes for special meetings that would allow for more public participation. City Clerk Fry advised that she would look into it and report back to the staff liaison with her findings. Feb.5,2026 Arts Commission Regular Meeting Page 2 Commissioner George asked if changing the order of agenda items or pulling an item from the consent calendar requires a motion and a second. City Clerk Fry advised that no, it is up to the meeting Chair's discretion and if there is a need to do that. Commissioner George asked for clarification if four or more commissioners attend an event, would that be considered a meeting. Attorney McMahon advised that there are exceptions to the Brown Act such as events that are purely social or ceremonial are an exception. 2. COMMUNITY ARTS GRANTS RECIPIENT REPORT FROM SAGE CREEK HIGH SCHOOL DANCE DEPARTMENT: Receive a report from Community Arts Grant recipient, Sage Creek High School Dance Department. (Staff contact: Krystal Roa, Library & Cultural Arts Department) Recommended Action: Receive the report. The Commission received the presentation. Sage Creek High School Dance Teacher, Sarah Eichler shared a PowerPoint presentation (on file in the Office of the City Clerk.) 3. CHESTNUT AVENUE INTERSTATE 5 UNDERPASS PUBLIC ART UPDATE: Receive a report from artist team, Greenmeme, with an update for Chestnut Avenue 1-5 Underpass Public Art. (Staff contact: Krystal Roa, Library & Cultural Arts Department) Recommended Action: Receive the report. Lori Robbins spoke about recommended modifications to the artwork design. The Commission received the presentation. Program Manager, Krystal Roa shared a PowerPoint presentation (on file in the Office of the City Clerk.) Commissioner Breyer suggested that the west side entrance should lean towards more coastal flowers and the east side more towards inland flowers and plants as well as including the Bird of Paradise and ranunculus. Greenmeme artist Brian Howe advised that there is enough in the budget for 16 colors of powder coating which will allow for a wide array of native and local plants and flowers. Commissioner Geroge suggested to try to connect more with the Hispanic culture with the use of Poinsettia's, traditional Mexican paper flowers and pinatas. Commissioner Ferone asked the artist team if they know what kind of material they are planning to use. Greenmeme artist Howe believes it will most likely be a powder coated stainless steel. Commissioner Ferone also stated that the Barrio Public Art Project will incorporate more Hispanic culture themes so the underpass can focus more on the native flowers and plants. Commissioner Ferone suggested how the color scheme was selected be explained to the city so community members understand how the colors were chosen and why. Commissioner Chung suggested the use of insects in the artwork. Feb.5,2026 Arts Commission Regular Meeting Page 3 4. FISCAL YEAR 2026-27 COMMUNITY ARTS GRANTS GUIDELINES AND CALENDAR: Approve the Fiscal Year 2026-27 Community Arts Grants Guidelines (CAG} and funding cycle calendar. (Staff contact: Krystal Roa, Library & Cultural Arts Department) Recommended Action: Discuss and approve the FY 2026-27 Community Arts Grants Guidelines and funding cycle calendar. The Commission received the presentation. Program Manager, Krystal Roa shared a PowerPoint presentation (on file in the Office of the City Clerk.) Commissioner Breyer asked for clarification is there a grant reward limit per school site or per department. Program Manager Roa clarified that each school may apply up to three times for three different departments. Commissioner Ferone asked for clarification on how an organization would not qualify for a grant if they are already receiving funds from another organization. Program Manger Roa explained it would only disqualify them if the funds are coming from the City of Carlsbad. Commissioner Nassiri asked if applicants are able to upload a video along with their application. Program Manager Roa stated yes, videos and other marketing materials are encouraged but not required. Motion by Commissioner Nassiri, seconded by Commissioner George, to approve Fiscal Year 2026-27 Arts Grants Guidelines and funding cycle calendar as presented. Motion carried, 7 /0. COMMISSION COMMENTARY AND REQUESTS FOR CONSIDERATION OF MATTERS: The Arts Commissioners report on activities and meetings of some committees and subcommittees of which they are members. ANNOUNCEMENTS: This section of the Agenda is designated for announcements to advise the community regarding events that Members of the Arts Commission have been invited to, and may participate in. STAFF COMMENTS: Library and Cultural Arts Director Suzanne Smithson commented on the following: • Lunar New Year celebration at the Library Learning Center • Saturday in the Courtyard concert RB Anthony & Pacific Sound Brass • Front Row Saturday in the Schulman Auditorium with Jesse London • New partnership with Alliance Francaise with Night of Ideas-film and open discussion with the films director • TGIF Concerts in the Parks 2026 series sponsorship portal is now open. Band line up will be announced in early March • William D. Cannon Art Gallery flooring refurbishing is complete, and a new exhibit is expected to open in March Feb.5, 2026 Arts Commission Regular Meeting Page 4 • The Carlsbad Reads Together 2026 book and author have been announced -"Stay True" by Pulitzer Prize winning author Hua Hsu.
