The City Planner has completed a review of your application for Substantial Conformance, CD 2025-0011,
pursuant to Chapter 21.89 of the Carlsbad Municipal Code (CMC). The substantial conformance review
consists of a minor modification to Minor Site Development Plan SOP 2023-0008 -CON LOT 6, for the
construction of a 150,700-square foot, 36'-4"-tall light industrial building located at 2891 Whiptail Loop
(APN 209-120-05-00}, an 11.55-acre lot identified as Lot 6 in the Oaks North Business Park Specific Plan,
SP 211(C). The project was approved by the City Planner on May 9, 2025.
After careful consideration of the request, the City Planner has determined the request meets the
required findings pursuant to Carlsbad Municipal Code (CMC} Section 21.89.080 listed below and
APPROVES this request. The proposed minor modifications include the following:
• Reduction of 28 parking spaces from a 302-space lot, resulting in 274 spaces and a 9.2% reduction
in parking. The reduction is to allow for the expansion of the loading dock wells at rear elevation.
• Removal of landscaping associated with the reduction in parking
• Modification to dock-high overhead doors and knockout panels
• Relocation of bike lockers and accessible pedestal bicycle repair station
For a substantial conformance to be approved, the following findings must be made pursuant to CMC
Section 21.89.080:
1) That the proposed revision provides an architectural style of development that is substantially
consistent with the building forms, building colors, and building materials that were approved as
part of the authorizing discretionary action, in that the architectural modifications are
compatible with the approved design for the light industrial building and the requirements of
SP 211{C).
2} That the proposed revision complies with all relevant development standards and design criteria
and will not result in any health, safety, or welfare impacts, in that the Fire Department and the
land Development Engineering Division have approved the revisions, and the project remains
consistent with the Oaks North Business Park Specific Plan SP 211{C} and the Zoning Code,
including setbacks, landscaping and parking.
3) That the proposed revision is consistent with the density, intensity, or use from what was approved
as part of the authorizing discretionary action, in that an increase in square footage is not

proposed and the reduction in parking substantially conforms with Minor Site Development
Plan SOP 2023-0008. Further, the proposed number of parking spaces remains consistent with
the proposed breakdown in uses for the 150,700-square-foot shell building. Specifically, 274
spaces are required and 274 are proposed.
4) That the proposed revision is minor and authorizes a deviation or deviations of no more than 10
percent, provided it is consistent with the authorizing discretionary action and maintains
compliance with all relevant development standards, in that the removal of 28 parking spaces
represents a 9.2% reduction in parking. A total of 302 parking spaces were approved and 274
spaces are proposed. The project complies with all relevant development standards of SP
211{C}.
5) That the proposed revision maintains, in their entirety, all the project conditions required as part
of the authorizing discretionary action as approved by the City Planner on May 9, 2025.
6) That the proposed revision is consistent with the previously evaluated environmental findings and
will not result in any significant environmental impact, and/or require further environmental
review in that the parking reduction and minor modifications to the rear elevation of the
building are within the scope of the previously certified Final Program Environmental Impact
Report (EIR} and Mitigation Monitoring and Reporting Program (MMRP} for the Oaks North
Business Park Specific Plan (EIR 98-08, State Clearinghouse No. 2000051057), certified by the
City Council on October 8, 2002.
7) That the proposed revision is consistent with the standards set forth in the Village and Barrio
Objective Design Standards or the Citywide Objective Design Standards, as applicable, in that the
proposed project does not propose multifamily development; therefore, the Village and Barrio
ODS and Citywide ODS for multifamily development projects are not applicable to this
substantial conformance review.
Therefore, the City Planner has determined that the application qualifies for a substantial conformance
with the approved permit and approves the changes to the project pursuant to CMC Section 21.89.060.
