SUBJECT: SDP 97-25(A)xl -KELLY CORPORATE CENTER -A request for a Site
Development Plan Extension to extend the permit for two proposed office
buildings located adjacent to and on the south side of Palomar Airport Road
between Hidden Valley Road and A viara Parkway in Local Facilities
Management Zone 5.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution Number 5726,
APPROVING Site Development Plan Extension SDP 97-25(A)xl based on the findings and
subject to the conditions contained therein.
II. INTRODUCTION
This is a proposed four-year extension of SDP 97-25(A) for the construction of two office
buildings proposed on the south side of Palomar Airport Road between Hidden Valley Road and
A viara Parkway, through September 1, 2008.
III. PROJECT DESCRIPTION AND BACKGROUND
On September 1, 1999 the Planning Commission approved SDP 97-25 to permit the construction
of four office buildings totaling 250,093 square feet along the south side of Palomar Airport
Road between the parcel west of Hidden Valley Road and Aviara Parkway. Two of the
buildings, one on each side of Hidden Valley Road, have already been constructed. The two
remaining buildings will be a 50,398 square foot and a 77,300 square foot multi-tenant office
building.
The project's original resolution of approval (No. 4602) included a condition, No. 21, which
states "Building permits for at least one of the four office buildings must be issued within 24
months of the date of approval or this approval shall expire. Building permits for any remaining
buildings shown on the Site Development Plan must be issued within 5 years of the date on
which the Site Development Plan received Planning Commission approval or the Site
Development Plan will expire as it pertains to any office buildings not constructed." This
application is to extend the approval and modify that condition to allow an additional four years
(until September 1, 2008) to exercise the permit for the two remaining buildings.

The project site has been rough graded and all other agency permits have been secured. Since
the project still meets the development standards of the zone, staff has no issues with the
proposed time extension. The Coastal Development Permit is an administrative action and will
be acted on by the Planning Director subsequent to the Planning Commission's action on the
SDP extension.
IV. ANALYSIS
A. The Kelly Corporate Center project is still consistent, as conditioned, with all applicable
plans, policies and regulations described below:
1. Planned Industrial (PI) and Open Space General Plan Land Use Designations;
2. Planned Industrial, Qualified Development Overlay Zone (P-M-Q);
3. Site Development Plan findings required by the Qualified Development Overlay
Zone, Carlsbad Municipal Code, Chapter 21.06, Section 21.06.020;
4. Comprehensive Land Use Plan for McClellan-Palomar Airport;
5. Mello II Segment of the Local Coastal Program, the Coastal Agricultural Overlay
Zone -Carlsbad Municipal Code, Chapter 21.202 and the Coastal Resource
Protection Overlay Zone -Carlsbad Municipal Code, Chapter 21.203; and
6. Growth Management Ordinance (Local Facilities Management Plan Zone 5).
B. The adopted project findings for SDP 97-25 and SDP 97-25(A), which are contained in
Planning Commission Resolutions No. 4602 and 4779, still apply to this project (SDP 97-
25(A)xl).
C. The adopted project conditions for SDP 97-25 and SDP 97-25(A), which are contained in
Planning Commission Resolutions No. 4602 and 4779 still apply to this project (SDP 97-
25(A)xl) with the exception of Condition No. 21 of Planning Commission Resolution
No. 4602, which is amended by Condition No. 3 in Planning Commission Resolution No.
5726 to extend the period in which the permit (SDP 97-25(A)) must be exercised by four
years, through September 1, 2008.
V. ENVIRONMENTAL REVIEW
The proposed project has been reviewed pursuant to the California Environmental Quality Act
(CEQA). On August 6, 1999 the Planning Director issued an Amended Mitigated Negative
Declaration, Addendum, and Mitigation Monitoring and Reporting Program for the proposed
project. On September 1, 1999 the Planning Commission adopted the Mitigated Negative
Declaration, Addendum, and Mitigation Monitoring and Reporting Program. On May 21, 2000,
the Planning Director issued a Subsequent Mitigated Negative Declaration, Addendum, and
Mitigation Monitoring and Reporting Program for the proposed project. On June 7, 2000, the
Planning Commission adopted the Subsequent Mitigated Negative Declaration, and Mitigation
Monitoring and Reporting Program through Planning Commission Resolution No. 4779.
