RESOLUTION NO. 2026-061 .
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ADOPTING THE PLANS, SPECIFICATIONS AND CONTRACT
DOCUMENTS AND AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS
FOR THE PONTO SEWER MANHOLE REHABILITATION PROJECT
WHEREAS, the City Council of the City of Carlsbad, California, has determined that it is
necessary, desirable and in the public interest to rehabilitate the Ponto sewer manholes, Capital
Improvement Program, or CIP, Project No. 5503-17, or Project; and
WHEREAS, the sewer pipeline and manholes are owned and operated by the city and are vital
components of the wastewater collection system; and
WHEREAS, on April 22, 2025, the City Council adopted Resolution No. 2025-083, approving
plans, specifications and contract documents and authorizing the City Clerk to advertise for bids for
construction of the Project; and
WHEREAS, on May 27, 2025, staff received two bids in response to the bid advertisement; and
WHEREAS, one bid received for the project was deemed non-responsive and the bids
significantly exceeded the estimate; and
WHEREAS, on July 22, 2025, the City Council adopted Resolution No. 2025-172, rejecting the
bids presented pursuant to Carlsbad Municipal Code, or CMC, Section 3.28.080(I)(3); and
WHEREAS, the plans, specifications and contract documents for the Project have been revised,
are on file at the City Clerk’s office and are incorporated herein by reference; and
WHEREAS, sufficient funds are available in the CIP Project No. 5503-17 budget to complete
construction of the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2. That the City Council has determined that on March 19, 2025, the Planning Commission
adopted Resolution Nos. 7538 and 7539, adopting the project’s initial study/mitigated
negative declaration (IS/MND) with the mitigation monitoring and reporting plan (State
Clearing House SCH No. 2025010786) and approving the Site Development plan, Coastal
Development Plan and Habitat Management Plan (SDP2024-0014, CDP2024-0019,
HMP2024-0007 (PUB2022-0007). The IS/MND was issued in accordance with applicable

local and state laws to address potential environmental effects associated with the
proposed project. The IS/MND identified effects related to Biological,
Cultural/Paleontological and Tribal Cultural Resources that might be potentially
significant. However, design and minimization measures, construction methods, and/or
mitigation measures provide mitigation to a point where potential impacts are reduced
to less than a significant level. The Planning Commission is the decision-making body
required for approving the project's proposed Site Development Permit, Coastal
Development Permit and Habitat Management Plan Permit. A Site Development Permit
is required due to the rehabilitation activities being conducted within an
environmentally sensitive habitat area in the Coastal Zone and Transportation Corridor.
A Coastal Development Permit is required because the project site is located within the
Mello II Segment of the Coastal Zone. Finally, a Habitat Management Plan Permit is
required to ensure that the natural habitats in the project site are preserved and to
protect the rare and unique biological resources located within those habitats. Staff
have incorporated numerous project design features and construction measures to
reduce the potential for environmental effects. The contractor will be required to
comply with the environmental mitigation measures described in the approved IS/MND,
to mitigate potential environmental impacts to a level of insignificance. Following
construction of sewer rehabilitation work, the city’s environmental monitoring
consultant will complete and sign checklist for each mitigation measure, fulfilling the
city's monitoring requirements with respect to Assembly Bill 3180 (1988), Public
Resources Code Section 21081.6 and as included in the project Mitigation Monitoring
and Reporting Program.
3.That the plans, specifications and contract documents for the Ponto Sewer Manhole
Rehabilitation, CIP Project No. 5503-17, are hereby adopted and on file in the Office of
the City Clerk.
4.That the City Clerk is hereby authorized and directed to publish, in accordance with state
law, a notice to contractors inviting bids for construction of the Ponto Sewer Manhole
Rehabilitation Project, CIP Project No. 5503-17, in accordance with the referenced plans
and specifications.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 24th day of March, 2026, by the following vote, to wit:
AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin.
NAYS: None.
ABSTAIN: None.
ABSENT: None.
