Recommended Action
Receive a presentation from the Chief of Police regarding the update provided to the City Council at
the Feb. 3, 2026, City Council Meeting on what the Carlsbad Police Department has observed in
terms of federal activities within the City of Carlsbad.
Fiscal Analysis
There is no direct fiscal impact associated with the informational report.
Environmental Evaluation
The proposed action is not a “project” as defined by California Environmental Quality Act, or
CEQA, Section 21065 and CEQA Guidelines Section 15378(b)(5) and does not require environment
review under CEQA Guidelines Section 15060(c)(3) and 15061(b)(3), because the proposed action
to report on the city’s observations specific to recent federal activities in the City of Carlsbad is an
organizational or administrative government activity that does not involve any commitment to any
specific project which may result in a potentially significant physical impact on the environment.
Any subsequent action or direction stemming from the proposed action may require preparation
of an environmental document in accordance with CEQA or the CEQA Guidelines.

The California Values Act (SB 54)ITEM 5: FEDERAL ACTIVITIES
Pursuant to SB 54, the Police Department DOES NOT:
•Use local law enforcement resources or personnel for federal civil immigration
enforcement
•Inquire into immigration status or honor immigration detainers
•Share nonpublic personal information with immigration authorities
•Conduct arrests based solely on civil immigration warrants
•Transfer persons to immigration authorities without judicial authorization
•Deputize or place officers under federal supervision for immigration enforcement
•Use immigration authorities as interpreters
•Provide dedicated space or detention facilities for federal immigration custody

The California Values Act (SB 54)ITEM 5: FEDERAL ACTIVITIES
Pursuant to SB 54, the Police Department MAY :
•Investigate or arrest for certain serious federal reentry offenses (8 U.S.C. § 1326) when
discovered during unrelated law enforcement activity, subject to transfer rules
•Respond to requests for an individual’s criminal history information, as permitted by
state law
•Participate in joint law enforcement task forces focused on non-immigration crimes and
share information for those investigations, consistent with local policy
•Make inquiries necessary to certify individuals as potential victims for T or U visas, as
required by federal law
•Allow immigration authorities to interview individuals in custody, in compliance with the
TRUTH Act requirements
