property in the City of Carlsbad under the terms of the city’s Hazard Reduction Program and
scheduling a public hearing on July 21, 2026, to consider the final Hazard Reduction Cost
Report.
Executive Summary
The City of Carlsbad conducts an annual Hazard Reduction Program to eliminate fire hazards
and nuisances caused by the accumulation of dry weeds and rubbish on vacant lots throughout
the city. City Council may declare weeds, rubbish and refuse on private property as public
nuisances, as authorized by California Government Code Sections 39560-39588.
This document is the second of three reports related to the Hazard Reduction Program. This
public hearing allows property owners an opportunity to voice any objections concerning the
parcels being declared to be public nuisances. Staff recommend scheduling another public
hearing on July 21, 2026, to review the final Hazard Reduction Cost Report.
Explanation & Analysis
The Carlsbad Fire Department completed its annual hazard survey and identified 221 parcels
that have, or are likely to have, potential hazards during the drier months when the risk of fire
increases. A list of these parcels is provided in Attachment A of Exhibit 1.
The City Council declared these parcels public nuisances on March 24, 2026. The Fire
Department and City Clerk mailed notices to property owners the following day, explaining the
City Council’s action and providing information for the public hearing on April 14, 2026. A copy
of the notice sent to property owners is attached as Exhibit 2.
After May 15, 2026, any hazards that property owners have not removed will be subject to
removal by the city. The costs related to the abatement of these parcels will be forwarded to

the San Diego County Tax Assessor for inclusion in the property tax bills for the affected
properties. This process will take place after the program closes in August, allowing the City
Council time to consider any objections from property owners.
Fiscal Analysis
Most city administrative and contractor costs related to weed abatement are recoverable from
property owners via their property tax bills. However, this recovery method does not apply to
land valued at zero or deemed to have no taxable value. In this case, a zero-value property does
not receive a property tax bill.
The Fire Department’s operating budget has sufficient funds for weed abatement expenditures
in the current year. Expenditures will be recouped via property tax bills in the following year.
Next Steps
•The city will use a contractor for weed abatement work starting May 15, 2026.
•All work will be completed by June 30, 2026.
•A public hearing will be scheduled on July 21, 2026, for the City Council to consider the
final Hazard Reduction Cost Report.
•Staff will forward the report to the San Diego County Tax Assessor for the costs related
to weed abatement for inclusion in property tax bills.
Environmental Evaluation
The proposed action to declare weeds, rubbish, and refuse on private property as public
nuisances under the city’s Hazard Reduction Program is categorically exempt from
environmental review under California Environmental Quality Act, or CEQA, Guidelines Section
15321(a) because it involves the enforcement of a law, general rule, standard, or objective
administered or adopted by the city. No exception to the exemptions as set forth in CEQA
Guidelines section 15300.2 or the Carlsbad Municipal Code Section 19.04.070 (C) apply.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING ABATEMENT OF WEEDS, RUBBISH AND REFUSE
UPON PRIVATE PROPERTY IN THE CITY OF CARLSBAD UNDER THE TERMS OF
THE CITY’S HAZARD REDUCTION PROGRAM AND SCHEDULING A PUBLIC
HEARING ON JULY 21, 2026, TO CONSIDER THE FINAL HAZARD REDUCTION
COST REPORT
WHEREAS, the City Council of the City of Carlsbad, California has determined that weeds,
rubbish, and refuse exist or are likely to exist on vacant parcels throughout the city; and
WHEREAS, said weeds, rubbish, and refuse constitute a hazard to public safety during the drier
months of the year due to combustibility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2. That this action to declare weeds, rubbish, and refuse on private property as public
nuisances under the city’s Hazard Reduction Program is categorically exempt from
environmental review under California Environmental Quality Act, or CEQA, Guidelines
Section 15321(a) because it involves the enforcement of a law, general rule, standard,
or objective administered or adopted by the city. No exception to the exemptions as set
forth in CEQA Guidelines section 15300.2 or the Carlsbad Municipal Code Section
19.04.070 (C) apply.
3.That this resolution, and all action subsequently taken in connection with it, is taken
pursuant to the provisions of California Government Code Section 39560, et seq.
(Alternate Procedures for Weed and Rubbish Abatement).
4.That the words used in this resolution and subsequent action in connection with it shall
be defined as outlined in said code sections.
5.That the City Council of the City of Carlsbad declared weeds, rubbish, and refuse as
public nuisances upon those certain parcels of private property in the City of Carlsbad
described in Attachment A, incorporated by reference.
6. That the City Council of the City of Carlsbad declared its intention to cause the removal
of said weeds, rubbish, and refuse. The City Clerk of the City of Carlsbad mailed written

notices of the proposed abatement of said nuisances to all persons owning the property
described in Attachment A.
7. That property owners were notified that nuisances existing after May 15, 2026, are
subject to abatement by the City of Carlsbad, and the cost of abatement will appear on
the property tax bill.
8. That a public hearing was held in the City of Carlsbad Chamber at 1200 Carlsbad Village
Drive, Carlsbad, CA, on April 14, 2026, to consider responses from property owners to
said proposed removal of weeds, rubbish, and refuse.
9. That the Fire Chief of the City of Carlsbad is designated to perform the duties imposed
on the Superintendent by California Government Code Section 39560, et seq.
10. That the Superintendent is authorized to abate the nuisance declared by Resolution No.
2026-065 by having the weeds removed from the properties listed in Attachment A to
this Resolution. The Superintendent may enter upon those private parties to abate the
nuisance. Before the Superintendent arrives, any property owner may remove the
weeds, at the property owner’s expense.
11. That the Superintendent shall keep an account of the cost of abatement for each parcel
of land where the work is done by the City. The Superintendent shall submit to the City
Council the final Hazard Reduction Cost Report at the City Council meeting on July 21,
2026, at 5 p.m., where a public hearing will be held in the City Council Chamber at 1200
Carlsbad Village Drive, Carlsbad, California, to consider the final Hazard Reduction Cost
Report.

Hazards on your property must be removed by May 15, 2026
Dear property owner,
The risk of wildfires is an increasing hazard within our region. The City of Carlsbad’s annual Hazard Reduction
Program was established to minimize the risks and the possible impacts of wildfire by reducing hazardous
conditions on properties throughout the community. We are sending you this letter to inform you that the city has
identified a potential fire hazard on your property, and that this hazardous vegetation and/or rubbish must be
removed from the property by May 15, 2026.
The condition and reduction of hazards on the property is your responsibility as the property owner. Should you
no longer own the property, please notify the Carlsbad Fire & Life Safety Division immediately. This demand is in
accordance with state law that authorizes cities to require property owners to remove such public nuisances,
California Government Code Sections 39560, et. seq. No other notices will be placed on the property.
If the property is not cleared and maintained free of combustible vegetation and/or rubbish by May 15, 2026, in
compliance with the requirements listed on the enclosed City of Carlsbad Fire Department Hazard Reduction
Standard sheet, the city will remove the hazard(s) and charge you for the cost of that service. The cost of cleaning
parcels by the city is based upon a unit price per hour for mulching, hand labor and tractor mowing and by the
cubic yard for chipping, spreading, and rubbish removal. The charge for cleaning by the city will also reflect an
administration charge of $360.00 per parcel.
The city urges you to clear the hazards from your property in accordance with the Hazard Reduction Standards
listed on page 3 by May 15, 2026, to avoid incurring the cost of the city performing this abatement work and
associated administrative fees.
Part of this program includes an assessment of native habitat and single native species adjacent to existing
structures. An assessment of all identified vacant lot parcels that may contain native habitat vegetation will be
conducted during the 2026 abatement cycle. As the property owner, if you would like to discuss assessment
findings or accompany our department during our assessment of your parcel, please schedule an inspection with
our department before April 14, 2026. We will make every reasonable effort to accommodate your availability.
Please note that an assessment of all vacant parcels will be conducted from public access locations, regardless of
owner presence.

NOTICE TO DESTROY WEEDS AND REMOVE RUBBISH
NOTICE IS HEREBY GIVEN On March 24, 2026, the City Council of the City of Carlsbad passed a resolution
declaring that noxious weeds, rubbish, or refuse growing on or in front of certain properties constitute a
public nuisance. Property owners must abate this nuisance by removing the weeds, rubbish, or refuse. If
the property owner fails to do so, the city will remove them and assess the cost of removal against the
property. This assessed cost will constitute a lien on the property until paid.
NOTE: Certain protected (sensitive) native habitats may be exempt from these requirements and must
not be cleared without prior consultation. If, after reviewing this notice, you believe an exemption may
apply to your property, contact the Fire & Life Safety Division at WildfireMitigation@carlsbadca.gov or
442-339-2669 no later than April 14, 2026, to discuss your specific circumstances before undertaking
any vegetation removal.

HAZARD REDUCTION STANDARDS
The City of Carlsbad Fire Department uses these guidelines when evaluating properties. Should you
choose to abate the property yourself or hire a contractor, the work will be evaluated in accordance with
the standards listed below:
PROPERTIES WITH NATIVE VEGETATION & PROTECTED HABITAT
Before clearing native brush or chaparral, you must contact the Fire & Life Safety Division to avoid
conflicts with endangered species protection laws.
•A case-by-case assessment is required to protect endangered species
•The Fire Department will provide specific guidance for your property

GENERAL REQUIREMENTS FOR PROPERTIES WITHOUT NATIVE VEGETATION OR HABITAT
Trash and Rubbish

Grass and Weeds
•Cut grass and weeds to 4 inches in height or less.
•Use power mowing, hand trimming, or approved discing methods.
•Remove cut vegetation from your property.
•Provide 3 feet of unobstructed clearance around fire hydrants.
•Ensure clearance along roadways and pedestrian rights-of-way.
Shrubs
•Remove all dead or dying shrubs.
•Remove cuttings, shrub debris, and fallen branches.
•Provide 3 feet of unobstructed clearance around fire hydrants.

Trees
•Remove dead trees, branches, and limbs.
•Trim low-hanging branches to at least 6 feet above the ground.
•Clear heavy leaf accumulation (no more than 4 inches deep) beneath trees.

PROPERTIES ADJACENT TO STRUCTURES
Vegetation clearance of up to 10 feet may be required where vegetation is located adjacent to properties
containing habitable structures.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that the City of Carlsbad City Council will hold a public hearing on
Tuesday, April 14, 2026, at 5 p.m. in the Council Chamber, 1200 Carlsbad Village Drive, Carlsbad,
California, to hear objections from property owners regarding the removal of weeds, rubbish,
and refuse on private properties as part of the Hazard Reduction Program.
Those persons wishing to speak on this item are cordially invited to attend the public hearing.
The staff report will be available starting Friday, April 10, 2026, at
https://www.carlsbadca.gov/city-hall/meetings-agendas. The meeting can be viewed online at
https://www.carlsbadca.gov/residents/communication/city-tv-channel. If you have any
questions, please contact Fire Marshal Darcy Davidson in the Fire Department at 442-339-2662
or via email at darcy.davidson@carlsbadca.gov.
In addition, written comments may be submitted to the City Council at or prior to the public
hearing via U.S. Mail to the attention of the Office of the City Clerk, 1200 Carlsbad Village Drive,

If you challenge the Hazard Reduction Program in court, you may be limited to raising only those
issues presented at the public hearing or in written correspondence delivered prior to the public
