Executive Summary The City of Carlsbad conducts an annual Hazard Reduction Program to eliminate fire hazards and nuisances caused by the accumulation of dry weeds and rubbish on vacant lots throughout the city. City Council may declare weeds, rubbish and refuse on private property as public nuisances, as authorized by California Government Code Sections 39560-39588. This document is the second of three reports related to the Hazard Reduction Program. This public hearing allows property owners an opportunity to voice any objections concerning the parcels being declared to be public nuisances. Staff recommend scheduling another public hearing on July 21, 2026, to review the final Hazard Reduction Cost Report. Explanation & Analysis The Carlsbad Fire Department completed its annual hazard survey and identified 221 parcels that have, or are likely to have, potential hazards during the drier months when the risk of fire increases. A list of these parcels is provided in Attachment A of Exhibit 1. The City Council declared these parcels public nuisances on March 24, 2026. The Fire Department and City Clerk mailed notices to property owners the following day, explaining the City Council’s action and providing information for the public hearing on April 14, 2026. A copy of the notice sent to property owners is attached as Exhibit 2. After May 15, 2026, any hazards that property owners have not removed will be subject to removal by the city. The costs related to the abatement of these parcels will be forwarded to April 14, 2026 Item #10 Page 1 of 12 Docusign Envelope ID: EC2079A7-AE26-4ED9-8B03-49BC6C0B9CD1 the San Diego County Tax Assessor for inclusion in the property tax bills for the affected properties. This process will take place after the program closes in August, allowing the City Council time to consider any objections from property owners. Fiscal Analysis Most city administrative and contractor costs related to weed abatement are recoverable from property owners via their property tax bills. However, this recovery method does not apply to land valued at zero or deemed to have no taxable value. In this case, a zero-value property does not receive a property tax bill. The Fire Department’s operating budget has sufficient funds for weed abatement expenditures in the current year. Expenditures will be recouped via property tax bills in the following year. Next Steps •The city will use a contractor for weed abatement work starting May 15, 2026. •All work will be completed by June 30, 2026. •A public hearing will be scheduled on July 21, 2026, for the City Council to consider the final Hazard Reduction Cost Report. •Staff will forward the report to the San Diego County Tax Assessor for the costs related to weed abatement for inclusion in property tax bills. Environmental Evaluation The proposed action to declare weeds, rubbish, and refuse on private property as public nuisances under the city’s Hazard Reduction Program is categorically exempt from environmental review under California Environmental Quality Act, or CEQA, Guidelines Section 15321(a) because it involves the enforcement of a law, general rule, standard, or objective administered or adopted by the city. No exception to the exemptions as set forth in CEQA Guidelines section 15300.2 or the Carlsbad Municipal Code Section 19.04.070 (C) apply. (Alternate Procedures for Weed and Rubbish Abatement). 4.That the words used in this resolution and subsequent action in connection with it shall be defined as outlined in said code sections. 5.That the City Council of the City of Carlsbad declared weeds, rubbish, and refuse as public nuisances upon those certain parcels of private property in the City of Carlsbad described in Attachment A, incorporated by reference. 6. That the City Council of the City of Carlsbad declared its intention to cause the removal of said weeds, rubbish, and refuse. That property owners were notified that nuisances existing after May 15, 2026, are subject to abatement by the City of Carlsbad, and the cost of abatement will appear on the property tax bill. 8. That a public hearing was held in the City of Carlsbad Chamber at 1200 Carlsbad Village Drive, Carlsbad, CA, on April 14, 2026, to consider responses from property owners to said proposed removal of weeds, rubbish, and refuse. 9. That the Fire Chief of the City of Carlsbad is designated to perform the duties imposed on the Superintendent by California Government Code Section 39560, et seq. 10. That the Superintendent is authorized to abate the nuisance declared by Resolution No. 2026-065 by having the weeds removed from the properties listed in Attachment A to this Resolution. The Superintendent may enter upon those private parties to abate the nuisance. Before the Superintendent arrives, any property owner may remove the weeds, at the property owner’s expense. 11. That the Superintendent shall keep an account of the cost of abatement for each parcel of land where the work is done by the City. The Superintendent shall submit to the City Council the final Hazard Reduction Cost Report at the City Council meeting on July 21, 2026, at 5 p.m., where a public hearing will be held in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, to consider the final Hazard Reduction Cost Report. Those persons wishing to speak on this item are cordially invited to attend the public hearing.
