Suite 305 Solana Beach, CA 92075 {city of Carlsbad SUBJECT: PRE 2026-0022 (DEV2026-0006} -PRELIMINARY HOUSING DEVELOPMENT (SB-330} PRE-APPLICATION -CALLE BARCELONA CARLSBAD APN: 255-012-05-00 Dear Mr. Covington, The Planning Division is in receipt of the Senate Bill 330 (SB-330) preliminary housing development pre- application for the CALLE BARCELONA CARLSBAD project, application no. PRE 2026-0022, submitted on March 30, 2026. The CALLE BARCELONA CARLSBAD project, consisting of the construction of 186 apartment units within a six-story, 66-foot-tall, 343,690-square-foot structure with a parking garage on the first two levels consisting of 362 parking spaces does not qualify for qualify for the Housing Crisis Act SB-330 Streamlining permitted under Government Code 66300. Although the CALLE BARCELONA CARLSBAD project qualifies as a "housing development project" pursuant to Government Code Section 65589.5{h)(2), it is not eligible for the streamlining provisions of the Housing Crisis Act of 2019 (SB 330). Government Code Section 66300{e)(4) explicitly states that these provisions do not apply to housing development projects located within a very high fire hazard severity zone as identified by the State Fire Marshall (Gov. Code § 51178). Because the CALLE BARCELONA CARLSBAD project site is located within a very high fire hazard severity zone per the Office of the State Fire Marshall (Cal Fire) maps adopted by the State of California in March 2025, and adopted by the City of Carlsbad in June 2025, the project is ineligible for SB-330 permit streamlining. While the project does not qualify for SB-330 permit streamlining, it does meet the definition of a "housing development project" under state law. Therefore, the city will only apply the objective design standards in effect throughout the "incomplete" phase of the application review. Furthermore, the city will process the application in accordance with the Permit Streamlining Act and department Discretionary Processing Guides, observing the standard 30-day turnaround for each submittal cycle . Furthermore, the city raises both completeness items and conflicts with objective design standards during each iteration cycle, and makes every effort to provide for complete comments in all cycles.
