SUBJECT: Administrative Variance No. a2~1, Request to reduce
sideyard setback from 10' to 6 1 ;·frontyard setback from
20' to 12'; erect 6' wall in frontyard setback.
Dear Mrs. Flanigan,
The Planning qirector has completed Q review of your application
for an Administrative Variance at 7243 Estrella de Mar.
Afte~ careful consideration of the circumstances surrounding this
request, the Planning Director has determined that the four
findings required for granting an Administrative Variance can be
made and, therefore, APPROVES this request based on the following
findings and conditions:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not a~ply generally to the other property or class
of use in the same vicinity and zone, because: the unusual
lot shape precludes further development of the lot in any
area other than the requested location.
2. The requested variance. is necessary for the
preservation and enjoyment of a substantial property right
possessed by other property in the same vicinity and zone
but which is denied to the property-in question because:
other properties in the area were developed under county
re~ulations which permitted smalle~ setbacks. The majority
of dwellings on the street have 10' --15' front setbacks.
Deni.al of this request would prevent the applicant from
enjoying the same rights to a smaller setback requirement
-that other property owners now possess.

3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which
the property is located because other properties on the same
street are utilizing similar setbacks as requested and which
have had no detrimental affect on the public welfare nor have
been materially detrimental to neighboring properties.
4. The granting of this variance will not adversely affect
the comprehensive general plan because the granting of this
variance will not alter the single family use of the property
as intended by the residential lowmedium density designation
of the General Plan.
Conditions
Approval is granted for AV-82-1, as shown on Exhibit A,
dated April 6, 1982 , on file in the Planning Department
and incorporated herein by refeiehce~
Additional Conditions (if any)
1. The 35' stucco wall located in the frontyard setback
must not exceed a maximum height of 42".
You have the right to appeal this decision to the Planning
Commission within 10 days of receipt of this letter.
