SUBJECT: Administrative Variance No. 83-2 -Request for an
administrative variance to reduce the front yard
setback on a panhandle lot from 20 feet to 15 feet on
,property located at 3295 Valley Street in the R-1-7500
zone.
Dear Mr. Peterson:
The Land Use Planning Manager has completed a review of your
application for an administrative variance at 3295 Valley Street.
After careful consideration of the circumstances surrounding this
request, the Land Use Planning Manager has determined that the
four findings required for granting an administrative variance
can be made and, therefore, approves this request based on the
following findings and conditions:
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone because the residence is
located on a panhandle lot that will be created when a long
narrow lot is subdivided. The original lot has frontage on
two public streets and will be required to dedicate 60 feet
for the construction of James Drive.
2. The requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question because adjacent properties have
been developed in a similar manner with panhandle lots.

3. The granting of this variance will not be materially detri-
mental to the public welfare or injurious to the property or
improvements in the vicinty and zone in which the property is
located because the residence for which this variance is
requested is on an interior panhandle lot 46 feet from the
nearest residence and will probably be removed when this lot
is sold.
4. The granting of this variance will not adversely affect the
comprehensive General Plan by setting an undesirable
precedent because of the unusual shape of this lot, the need
for an interior street, James Drive, and the age and size of
the existing residence.
Conditions:
1. Approval is granted for AV 83-2, as shown on Exhibit "A",
dated March 8, 1983, on file in the Land Use Planning Office
and incorporated herein by reference.
2. This variance is applicable only to the existing residence
on Lot C of MS-601. Any future construction on this lot
shall comply with the standards of the R-1-7500 zone.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
have any questions regarding this matter, please feel free to
call this office.
