Subject: AV 84-1 Llewellyn Shores -Request for approval of an
Administrative Variance to allow a 5-foot high fence within
the front yard setback on the east side of Garfield Street
between Chinquapin Avenue and Date Avenue in the RD-M zone.
The Land Use Planning Office has completed a review of your
application for an administrative variance on Garfield Street.
After careful consideration of the circumstances surrounding
this request, the Land use Planning Manager has determined that
the four findings required for granting an administrative
variance can be made and, therefore, APPROVES this request based
on the following findings and condition:
Findings
1) There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended
use that do not apply generally to the other property or
class of use in the same vicinity and zone because the
depth of the lot is so minimal that the swimming pool must
be placed in the side yard projecting into the front yard.
State law requires a minimum 5-foot fence surrounding such
pools.
2) The requested variance is necessary for the preservation
and enjoyment of a substantial property right possessed by
other property in the same vicinity and zone, but which is
denied to the property in question because other residential
properties in the area possess swimming pools. Denial of
this request would prevent the applicant from enjoying the
same right.
3) The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which
the property is located because a 5-foot fence within the
front setback will not interfere with traffic sight-
distance nor surrounding view corridors.

4) The granting of this variance will not adversely affect the
comprehensive general plan because the granting of this
variance will not alter the multiple-family use of the
property as intended by the residential high density
designation of the general plan.
Condition
1. Approval is granted for a 5-foot high fence (AV 84-1) as
shown on Exhibit "A", dated July 9, 1984, on file in the
Land Use Planning Office and incorporated herein by
reference.
