SUBJECT: Administrative Variance No. 85-11 Request to reduce
the required R-1(10000) minimum lot width from 75
feet to 61 feet on two lots located on the west side
of proposed James Drive between Oak Avenue and
Basswood Avenue.
Dear Mr. Stone:
The Planning Director has completed a review of your application
for an administrative variance as described above. After careful
consideration of the circumstances surrounding this request, the
Planning Director has determined that the four findings required
for granting an administrative variance can be made and,
therefore, approves this request based on the following findings
and conditions.
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone. Presently many long narrow
lots front along Highland Drive and this circumstance will
probably lead to many of these lots to be parceled when James
Drive is constructed from Oak Avenue to Basswood Avenue.
Since these lots will front along James Drive staff could
support a rezone to R-1-7500 and because of this reason staff
can support the proposed variance to reduce the minimum lot
width from 75 to 60 feet, since this will comply with the
minimum lot width requirements of the R-1-7500 zone.
2. The requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question since James Drive will eventually
run from Oak Avenue to Basswood Avenue the lots fronting
along James Drive will probably receive staff support to be
rezoned to R-1-7500. Therefore, staff can support the
variance to reduce the minimum width from 75 to 60 feet
since this will comply with the minimum lot width
requirements of the R-1-7500 zone.

3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinty and zone in which the
property is located because the area is designated for
single family and since the proposed lots will end up having
single family homes on them, the proposal should not be
detrimental to the public.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because it conform~ with the RLM
0-4 du's/ac designation.
Conditions:
1. Approval is granted for AV 85-11, as shown on Exhibit "A",
dated December 11, 1985, on file in the Planning Department
and incorporated herein by reference.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
have any questions regarding this matter, please feel free to
call this office.
