SUBJECT: Administrative Variance No. 86-1 to allow a 15 foot
encroachment into the required 50 foot street side
setback at the southwest corner of Palomar Airport
Road and Camino Vida Roble.
Dear Sirs:
The Planning Director has completed a review of your application
for an administrative variance at the soutwest corner of Palomar
Airport Road and Camino Vida Roble. After careful consideration
of the circumstances surrounding this request, the Planning
Director has determined that·the four findings required for
granting an administrative variance can be made and, therefore,
@prove~ this request based on the following findings and
conditions.
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because the lot is bounded
on all sides by slopes. These slopes have in effect reduced
the buildable area by at least 30%. Development of the lot
necessitates allowing the parking area to encroach into the
50 foot street side setback approximately 15 feet.
2. The requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question because other planned industrial
lots have been allowed to develop to their full potential.
But because of its unique situation, the slopes, development
of the lot to its full potential requires encroachment into
the 50 foot setback.

3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinty and zone in which the
property is located because the encroachment will not be
visible to the general public since heavy landscaping will be
used to screen the parked vehicles.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because the use of the property is
consistent with the General Plan.
Conditions:
1. Approval is granted for AV-86-1, as shown on Exhibit "A",
dated February 4, 1986, on file in the Planning Department
and incorporated herein by reference.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
have any questions regarding this matter, please feel free to
call this office.
