SUBJECT: Administrative Variance No. 86-3 Request to reduce the
required R-1 (7500) minimum lot width from 60 to 55
feet on a lot located on the north side of Knowles
between Pio Pico Drive and Elmwood Street ..
Dear Mr. Wickham and Mr. Lin:
The Planning Director has completed a review of your application
for an administrative variance as described above. After careful
consideration of the circumstances surrounding this request, the
Planning Director has determined that the four findings required
for granting an administrative variance can be made and,
therefore, approves this request based on the following findings
and conditions.
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone. Lots 63 and 64 were
created by MS-663 with the intention that future access
would be taken off of Cynthia Lane when this street is
expanded. Currently, Lots 63 and 64 have 147 feet access
panhandles off-of Knowles. The widths of the two panhandles
are 20 and 35.01 feet respectively. Once the northern
access has been established, the panhandles would be
virtually unusable due to the narrowness of these panhandle
areas, creating an unusual or extraordinary situation. To
alleviate this problem, the applicant plans to split the
panhandles off from Parcel 63 and 64 and join them to form a
third parcel. This would create a 55.01 foot frontage
instead of the required 60 foot width. Although this is a
substandard width, this would make better use of land for
the applicant.

2. The requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question since:
a) There are various other lots with substandard widths in
this older section of the city, both north and south of
Knowles.
b) All other possible resources for adding five feet have
been exhausted. Neighboring properties are either
developed or developing.
3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which
the property is located because the area is designated
single family -R-1-7500. All three parcels to be created
are in excess to this size requirement.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because it conforms with the RLM
0-4 du's/ac designation.
Conditions:
1. Approval of this variance does not excuse compliance of all
other applicable sections of the Carlsbad Municipal Code.
2. Approval of this variance shall be contingent upon approval
of a parcel map combining the southern half of Parcel A and
Parcel B.
3. The granting of this variance is contingent upon the
installation of Cynthia Lane.
4. All conditions specified under MS-663 shall be completed.
5. Approval is granted for AV 86-3, as shown on Exhibit "A",
dated February 7, 1986 on file in the Planning Department
and incorporated herein by reference.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
