SUBJECT: Administrative variance No. 86-4 -Request to reduce
the panhandle width of a lot from 20 feet to 15 feet
at 1715 Butters Road.
Dear Mr. Stone:
The Planning Director has completed a review of your application
for an administrative variance at 1715 Butters Road. After
careful consideration of the circumstances surrounding this
request, the Planning Director has determined that the four
findings required for granting an administrative variance can .be
made and, therefore, approves this request based on the following
findings and conditions.
Findings:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because the lot is
irregularly shaped. The width averages fifty feet to ninety
feet. A standard 20 foot wide panhandle cannot be designed
without it encroaching within three feet of the applicant's
residence. Thus, this situation can justify the reduction
of the panhandle width from 20 feet to 15 feet.
2. The requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone but which is denied to
the property in question because the parcel has enough
square footage to create two-10,000 square foot lots which
would exceed the 7,500 square foot minimum lot size required
for this areai but the shape of the lot restricts the use of
a standard panhandle. Thus, justification can be made that
a property right is being denied.

3. The granting of this variance will not be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinty and zone in which the
property is located because the use is consistent with the
single family homes in the area.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because the use is consistent
with the General Plan.
Conditions:
1. Approval is granted for AV 86-4, as shown on Exhibit "A",
dated April 2, 1986, on file in the Planning Department and
incorporated herein by reference.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
have any questions regarding this matter, please feel free to
call this office.
