HomeMy WebLinkAboutPRE 2026-0018; 3429 MADISON ST LOT SPLIT - SB 330; Admin Decision LetterApril 29, 2026 Kris Petrovic 1025 Vietta Drive Escondido, CA 92027-4313 (city of Carlsbad SUBJECT: PRE 2026-0018 (DEV2026-0041) -PRELIMINARY HOUSING DEVELOPMENT (SB-330) PRE-APPLICATION -3429 MADISON LOT SPLIT The Housing Accountability Act (HAA; Government Code Section 65589.5) establishes the state's overarching policy to streamline housing development. The law allows the filing of a preliminary application to vest ordinances, policies and standards, including fees, in effect at the time of filing (Government Code Section 65589.S(o)(i) and (4). A preliminary application is "deemed complete" at the time of submittal if it contains all elements in Government Code Section 65941.1. The Planning Division received a Senate Bill (SB) 330 preliminary housing development pre-application submittal on April 7, 2026 for 3429 MADISON LOT SPLIT, application no. PRE 2026-0018. The materials submitted on April 7, 2026 present a concept proposal to subdivide the lot, demolish two housing units and construct two three-story duplexes. The city has determined the items submitted on April 7, 2026 do not fully satisfy the statutory checklist requirements required by the HAA (Government Code Section 65941.1), for the following reasons: 1. Page 2 of 5 of SB 330 pre-application. Please indicate whether a subdivision is proposed. 2. Page 2 of 5. Please indicate whether nonresidential uses are proposed. 3. Page 2 of 5. Pursuant to city GIS records, the addresses for APN 204-172-03-00 are 3429 and 3437 Madison Street. The application notes 3427 and 3429 Madison St. Please clarify and update as appropriate. 4. Page 2 of 5. Please provide a detailed project description-lot sizes, building height, proposed density, parking, unit sizes, square footage (with roof deck and garage) bedroom/bathroom count, etc. Please ensure the project description matches what is presented in the plans. 5. Page 4 of 5. Please submit legal documentation to show who is authorized to sign on behalf of ATK Rea I Estate LLC. 6. Page 4 of 5. The same person appears to have signed as applicant and owner, but the contact information is different. If the two are the same person, please check the box "Same as above." If it is not the same person, please provide signatures from each person . The site plan shows the street and alley on the incorrect sides of the lot; please revise. This correspondence serves as notification and documentation that the materials submitted by you or on your behalf are incomplete and do not constitute a preliminary application for the purposes of the HAA. This correspondence identifies the specific provision or provisions and provides an adequate explanation of the reason or reasons why the city considers the materials to be incomplete, noncom pliant, or non- conformant with identified HAA provisions. To be considered as part of this application, state law requires a resubmission within 90 calendar days from the date of this letter, or no later than July 28, 2026. If a preliminary application is not submitted within this timeframe, the SB 330 application will expire, and a new SB 330 request must be filed .
