SUBJECT: Administrative Variance No. 87-1 -Request to allow a
2 foot encroachment for a patio cover into the
required six foot sideyard setback.
Dear Steven Knight:
The Planning Director has completed a review of your application
for an administrative variance at 2697 Sauasalito. After careful
consideration of the circumstances surrounding this request, the
Planning Director has determined that the four findings required
for granting an administrative variance cannot be made and,
therefore, denies this request based on the following findings.
Findings:
1. There are not exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because no other property
of similar shape and size in the same vicinity has a patio
cover encroaching into the required side yards. The lot is
rectangular (approximately 65' x 150') with a gentle slope on
the eastern side yard and compares favorably to other lots in
the area.
2. The requested variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by
other property in the same vicinity and zone but which is
denied to the property in question because there is ample
room to extend the patio cover into the rear yard without
encroaching into the required side yard setback.

3. The granting of this variance could be materially detrimental
to the public welfare or injurious to the property or
improvements in the vicinty and zone in which the property is
located. If granted, this variance might create an
undesirable precedent of reduced side yards and increased lot
coverage which would undermine the intent of setbacks to
maximize light and air and promote pleasing open areas.
You have the right to appeal this decision to the Planning
Commission within ten days of receipt of this letter. If you
have any questions regarding this matter, please feel free to
call this office.
