SUBJECT: ADMINISTRATIVE VARIANCE NO. 88-1 -Request approval of
a storage shed within the required side yard setback at
3415 Santa Clara Way.
Dear Mrs. Gibson:
The Planning Director has completed a review of your application
for an administrative variance at 3415 Santa Clara Way. After
careful consideration of the circumstances surrounding this
request, the Planning Director has determined that at least three
of the four findings required for granting an administrative
variance cannot be made and, therefore, denies this request based
on the following findings and conditions.
Findings:
1. There are not exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class
of use in the same vicinity and zone. Comparison of the
subject property to other properties in the same vicinity
does not reveal any substantial difference that would
justify making a finding of exceptional or extraordinary
circumstances peculiar to the site. The development rights
of the property are equal to its neighbors. The size,
shape, and slopes of the lot are similar to other lots in
the vicinity.
2. The requested variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by
other property in the same vicinity and zone but which is
denied to the property in question because review of the
area does not reveal similar storage sheds or previous
variances issued in this neighborhood. In addition, the
shed could be placed onsite without the need for a variance
as it could on other lots in the neighborhood.

3. The granting of this variance could be materially
detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which
the property is located because it could establish an
undesirable precedent. It would encourage construction of
similar storage sheds that do not comply with setback
requirements and could reduce visual quality in the area.
This variance would also grant the applicant an entitlement
not enjoyed by the neighbors.
You have the right to appeal this decision to the
Commission within ten days of receipt of this letter.
