SUBJECT: Administrative Variance AV 88-9: Request to reduce the re~uired
R.A. (10,000) minimum lot width from 75 to 72.5 feet for a future
lot split of a through lot located west of Maria Lane and east of
Seaview Way.
Dear Mr. Montgomery:
The Planning Director has completed a review of your application for an
Administrative Variance as described above. After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that
the four findings required for granting an Administrative Variance can be made
and, therefore, approves this request based on the following findings and
conditions.
FINDINGS:
1. There are exceptional or extraordinary circumstances or conditions
app 1 i cab 1 e to the property or to the intended use that do not app 1 y
generally to the other property or class of use in the same vicinity and
zone. Parcel 3 of Parcel Map 14467 was created by MS-692 with the
intention that future access would be taken off of Maria Lane which is now
being completed. The proposed lot split would yield two lots fronting on
a public street, with lot widths of 72.5 feet. Although this is a
substandard width, this would be preferable since the new lots would not
have to use a panhandle to gain access.
2. The requested variance is necessary for the preservation and enjoyment of
a substant i a 1 property right possessed by other property in the same
vicinity and zone but which is denied to the property in question since:
a. There are some other lots with substandard widths in the
adjacent area on Celinda Drive and Sara Way.
b. All other possible resources for adding five feet have
been exhausted. North of the subject property is a
greenhouse operation and the land owner has refused to
sell a 5 foot strip of his property. South of the
subject property on the adjacent 1 ot is a structure
close to the property line and so there is no 5 foot
strip of vacant land.
3. The granting of this Variance will not be materially detrimental to the
public we 1 fare or injurious to the property or improvements in the
vicinity and zone in which the property is located because the area is
designated single family residential/agricultural R-A-10. Both lots to
be created are in excess of the 10,000 square foot minimum area
requirement. There are no other factors, inc 1 udi ng 1 ot access, which
would prevent the two lots from being developed to R-A-10 standards.
4. The granting of this Variance will not adversely affect the comprehensive
general plan because it conforms with the RLM 0-4 dwelling units per acre
designation.
CONDIT IONS:
1. Approval of this Variance does not excuse compliance of all other
applicable sections of the Carlsbad Municipal Code.
2. All conditions specified under MS-765 must be completed
3. Approval is granted for AV 88-9, as shown on Exhibit "A", dated October
13, 1988 on file in the Planning Department and incorporated herein by
reference.
4. Approval of AV 88-9 is granted subject to the approval of MS-765.
