SUBJECT: AV 90-3 • PACIFIC POINT BUSINESS CENI'ER
The City has completed the review of your request for an Administrative Variance to allow a reduced
front yard setback for both a structure and a parking area at 5600 Avenida Encinas in the City of
Carlsbad -Assessor's Parcel Number 210-090-47.
It is the Planning Director's Determination that the findings required by Section 21.51.010 of the
Carlsbad Municipal Code can be made and, therefore, APPROVES this variance based upon the
findings and subject to the conditions below:
Findin&5:
1. Exceptional circumstances exist in this vicinity because the property across Avenida Encinas
from the subject property contains many utility access points that would need to be relocated
unless the proposed right-of-way alignment is allowed to encroach seven feet into the
required front yard setback of the subject property.
2. The variance is necessary for the preservation of an already substandard front yard setback
for the existing building on the property across Avenida Encinas from the subject property.
Without granting a variance to allow a reduced front yard on the subject property, the
existing building across the street would be 20.8 feet from the proposed right-of-way rather
than the existing 23.3 foot setback.
3. The granting of this variance will not be materially detrimental to the public welfare because
it allows street improvements on Avenida Encinas to proceed in one phase rather than
disturbing traffic flow now and when the Palomar and Company property develops.
4. The granting of this variance will not adversely affect the general plan because it allows for
the required improvements on Avenida Encinas to proceed at this time while preserving the
existing setback consistency of the surrounding buildings.

Conditions:
1. Approval of AV 90-3 is granted as shown on Exhibits "B" -"C", dated May 10, 1990, on file
in the Planning Department. Development shall occur substantially as shown.
2. AV 90-3 is subject to the conditions of SOP 89-2 and MS-800, on file in the Planning
Department and incorporated herein by reference.
