HomeMy WebLinkAboutCD 2025-0016; PLAZA PASEO REAL; Admin Decision LetterMay 11, 2026 Roberto Jenkins RDC 245 East 3rd St. Long Beach, CA 90802 SUBJECT: CD 2025-0016 (DEV 2025-0099) -PLAZA PASEO REAL {city of Carlsbad The City Planner has completed a review of your application for Substantial Conformance CD 2025-0016, pursuant to Chapter 21.89 of the Carlsbad Municipal Code (CMC). The Substantial Conformance review consists of minor modifications to Site Development Plan (SOP) 86-11(A), which approved the development of an approximately 27-acre commercial shopping center. The subject property is located at 6941, 6943, 6949, 6955, 6965, 6971, 6981, and 6985 El Camino Real, APN 215-050-75-00, and 6951 El Camino Real, APN 215-050-76-00), on the northwest corner of El Camino Real and Aviara Parkway, in the Local Shopping Center Zone (C-L) Zone. After careful consideration of the request, the Assistant Director of Community Development has determined that the request meets the required findings of CMC Section 21.89.080 listed below and APPROVES this request. The proposed modifications include updating the fac;:ades of all buildings within the shopping center and enhancing the existing mediterranean architectural style. These modifications include the following: 1) Modify existing round columns in select areas to a rectilinear shape 2) Add decorative metal panels and tile in select areas 3) Expand plaza on the lower level and renovate the lower central surface parking area between 6949 and 6965 El Camino Real 4) Relocate an existing trash enclosure to the east of the structure located at 6971 El Camino Real 5) Removal of seven parking stalls from the lower central area for the lower plaza extension and trash enclosure relocation which will result in a total of 115 excess parking stalls available for the development which now will have 851 total parking stalls 6) Retrofit existing clock tower to include an elevator 7) Enhance lighting to add pendant lanterns, wall-mounted lanterns, and surface mounted linear lighting 8) Update exterior paint colors with the following: a) Dunn Edwards W380 Warm White b) Dunn Edwards 6218 Antique Paper c) Dunn Edwards 6220 Porous Stone d) Sherwin Williams 6385 Black Bean e) Sherwin Williams 6992 Inkwell Community Development Department Planning Division I 1635 Faraday Avenue I Carlsbad, CA 92008-7314 I 442-339-2600 CD 2025-0016 (DEV 2025-0099) -PLAZA PASEO REAL May 11, 2026 Pa e 2 In order for a Substantial Conformance to be approved, the following findings must be made pursuant to CMC Section 21.89.080: 1) That the proposed revision provides an architectural style of development that is substantially consistent with the building forms, building colors, and building materials that were approved as part of the authorizing discretionary action, in that the proposed changes to exterior paint colors, square framing around existing round columns, decorative metal panels, decorative exterior tile installed at 6949, 6951, 6965, 6971, plaza expansion and renovation at the lower central surface parking area between 6949 and 6965, retrofitting of the existing clock tower to include an elevator, lighting enhancements including pendant lanterns, wall mounted lanterns, and surface mounted linear lighting, and relocation of an existing trash enclosure to the east of the building located at 6971 El Camino Real are in substantial conformance with the Mediterranean architectural style, including the building forms, building colors, and building materials of the original project design as approved through permit SOP 86-11{A) and Area 5 of the El Camino Real Corridor Standards. 2) That the proposed revision complies with all relevant development standards and design criteria and will not result in any health, safety, or welfare impacts, in that the project complies with all relevant development standards and design criteria of the El Camino Real Corridor Standards and SOP 86-11{A). The changes to exterior paint colors, square framing around existing round columns, decorative metal panels, decorative exterior wall tile, plaza expansion and renovation at the lower central surface parking area, retrofitting of the existing clock tower to include an elevator, lighting enhancements including pendant lanterns, wall mounted lanterns, and surface mounted linear lighting, and relocation of an existing trash enclosure to the east of the building located at 6971 El Camino Real, comply with all Building and Fire codes and will not result in any health, safety or welfare impacts. 3) That the proposed revision is consistent with the density, intensity, or use from what was approved as part of the authorizing discretionary action, in that the project site is developed as a commercial shopping center and no changes are proposed to the uses or commercial square footage. A total of seven (7) parking spaces will be removed for the relocation of the trash enclosure and lower plaza expansion, resulting in a 115-parking stall surplus for the overall site after these renovations occur. A total of 851 parking stalls will remain for the development. 4) That the proposed revision is minor and authorizes a deviation or deviations of no more than 10 percent, provided that it is consistent with the authorizing discretionary action and maintains compliance with all relevant development standards, in that the proposed changes to exterior paint colors, square framing around existing round columns, decorative metal panels, decorative exterior wall tile, plaza expansion and renovation at the lower central surface parking area, removal of seven parking stalls, retrofitting of the existing clock tower to include an elevator, lighting enhancements including pendant lanterns, wall mounted lanterns, and surface mounted linear lighting, and relocation of an existing trash enclosure to the east of the building located at 6971 El Camino Real are less than a 10 percent deviation from SOP 86-11(A). The removal of seven (7) parking stalls constitutes a 0.8% change from the previously existing parking stall count of 858 stalls Community Development Department Planning Division I 1635 Faraday Avenue I Carlsbad, CA 92008-7314 I 442-339-2600 CD 2025-0016 (DEV 2025-0099) -PLAZA PASEO REAL May 11, 2026 Pa e 3 5) That the proposed revision maintains, in their entirety, all of the project conditions required as part of the authorizing discretionary action pursuant to SDP 86-ll{A), approved by the Planning Commission on February 1, 1989, pursuant to Resolution No. 2812. 6) That the proposed revision is consistent with the previously evaluated environmental findings and will not result in any significant environmental impact, and/or require further environmental review as approved by the Planning Commission on February 1, 1989. Specifically, the renovations to the center are minor in nature and will not result in any additional environmental impacts since the renovations are located within the developed footprint of the shopping center. 7) That the proposed revision is consistent with the standards set forth in the Village and Barrio Objective Design Standards or the Citywide Objective Design Standards, as applicable, the project is not located within the Village and Barrio Master Plan area and is not a housing development project or mixed-use project; therefore, neither set of Objective Design Standards apply. Therefore, the City Planner has determined that the application qualifies for a Substantial Conformance with the approved permit and approves the changes to the project pursuant to CMC Section 21.89.060. You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a) and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other similar application processing or service fees in connection with this project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute of limitations has previously otherwise expired. This decision may be appealed by you or any other member of the public to the Planning Commission within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $952. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
