SUBJECT: ADMINISTRATIVE VARIANCE· AV 90-4
The City has completed the review of your request for an Administrative Variance to allow
a retaining wall approximately nine feet in height in the side and rear yard setback at 1809
Oak Avenue in the City of Carlsbad -Assessor's Parcel Number 205-080-80.
It is the Planning Director's Determination that the findings required by Section 21.51.010
of the Carlsbad Municipal Code cannot be made and therefore, DENIES this variance
request based upon the findings below:
Findings:
1. Exceptional circumstances do not exist in this area. The increased height of the
existing retaining wall has allowed a larger side and rear yard and a pool has been
constructed within this side yard, however the topography over this lot is similar to
the surrounding residences which do not have overheight retaining walls.
2. This variance is not necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity. Although a pool has
been constructed within the increased side yard, there is still room in the rear and
opposite side yard to accommodate the pool and still leave room for an adequate
yard.
3. The granting of this variance would not be materially detrimental or injurious to
property in the vicinity as it would allow the retaining wall to remain in place and
subsequently be reinforced to increase stability.
4. The granting or denial of this variance win not adversely affect the comprehensive
general plan as this area is designated for residential uses of low to medium density.
