The Assistant Director of Community Development has completed a review of your application for
Substantial Conformance, CD 2025-0015, pursuant to Chapter 21 .89 of the Carlsbad Municipal Code
(CMC). The substantial conformance review consists of minor modifications to the West Oaks project (GPA
16-04/ZC 16-03/LCPA 16-04/SDP 16-20/CDP 16-31/HMP 16-04/MS 2018-0005), a 192-unit multi-family
apartment development which received a recommendation of approval from the Planning Commission
on January 20, 2021 (Planning Commission Resolution Nos. 7395, 7396 and 7397), and approvals from
City Council on May 4, 2021 (Ordinance CS-397 and City Council Resolution No. 2021-097) and the
California Coastal Commission on October 12, 2022. A two-year time extension was approved on March
26, 2024, extending the approval until October 12, 2026. Since the West Oaks project was not a density
bonus project, no incentives, waivers or concessions were granted. Accordingly the proposed
modifications meet the objective standards that apply to the property thought the General Plan and
Zoning Ordinance.
The 12 .52-acre project site, consisting of APNs 212-110-01, -02, -03, -04, -05, -06, -07, -08, and 212-040-
26, is located southwest of the intersection of Palomar Airport Road and Palomar Oaks Way, and within
the Appealable Jurisdiction of the Coastal Zone and the Mello II Segment of the Local Coastal Program.
After careful consideration of the request, the Assistant Director of Community Development, as the City
Planner, has determined the request meets the required findings pursuant to Carlsbad Municipal Code
(CMC) Section 21.89.080 listed below and APPROVES this request. The proposed minor modifications
include the following:
• Decrease number of inclusionary one-bedroom units from 24 to 19 and increase the number of
inclusionary three-bedroom units from 6 to 11; total number of inclusionary units, 42, remains
unchanged
• Increase in building gross square footage from 171,324 to 176,328 square feet, resulting in a 3%
increase
• Increase in gross building coverage from 71,346 to 71,363 square feet, resulting in a 0.1% increase
• Addition of 3 parking spaces, increasing the total number of proposed spaces from 384 to 387, to
accommodate the increase in inclusionary unit bedrooms, resulting in a 0.8% increase in the
number of parking spaces
• Reverse Building #6 Unit Type B to provide access to electrical cabinet
• Reduce Building Type A footprint from 10,235 to 9,762 square feet, resulting in a 4.6% reduction
• Increase Building Type E footprint from 4,291 to 4,681 square feet, resulting in a 9% increase

• Increase the leasing/recreation building footprint from 2,705 to 2,805 square feet resulting in a
3.6% increase
• Rotate orientation for leasing/recreation building to allow pool side improved sun exposure/
views and added brick veneer to exterior stairway to enhance street-facing elevation.
• Relocate fitness/gym to second floor of recreation building which required an elevator accessible
access. No increase in building height proposed .
• Revised affordable unit plans sized per the approved entitlement affordable unit areas
• Revise affordable elevations to match new unit mix building composites
• Revise sound attenuation railing facing street to a solid wall for better maintenance and long-term
appearance
• Updates to the detention basins-final engineering design to be reviewed and approved by the
City Engineer as part of the review of the grading permit. The landscape plan will be updated
once the basin designs are approved.
For a substantial conformance to be approved, the following findings must be made pursuant to CMC
Section 21.89.080:
1) That the proposed revision provides an architectural style of development that is substantially
consistent with the building forms, building colors, and building materials that were approved as
part of the authorizing discretionary action, in that the architectural modifications to address the
minor changes proposed to the affordable housing buildings are substantially consistent with
the approved design for the West Oaks project, GPA 16-04/ZC 16-03/LCPA 16-04/SDP 16-20/CDP
16-31/HMP 16-04/MS 2018-0005. The building forms, colors and materials remain the same.
2) That the proposed revision complies with all relevant development standards and design criteria
and will not result in any health, safety, or welfare impacts, in that the Fire Department and the
Land Development Engineering Division have approved the revisions, and the project remains
consistent with the project approved by the City Council on May 4, 2021 and the California
Coastal Commission on October 12, 2022, including the Mitigation Monitoring and Reporting
Program.
3) That the proposed revision is consistent with the density, intensity, or use from what was approved
as part of the authorizing discretionary action, in that the minor adjustments in square footage
and changes to the one and three-bedroom unit counts do not include a net increase in the
number of units; therefore, the approved density remains unchanged. Three additional parking
spaces are proposed to comply with the requirements of the Parking Ordinance and offset the
increase in required parking spaces. Specifically, 387 spaces are required and 387 are proposed.
4) That the proposed revision is minor and authorizes a deviation or deviations of no more than 10
percent, provided it is consistent with the authorizing discretionary action and maintains
compliance with all relevant development standards, in that as described in the scope of changes
above, none of the changes proposed represent greater than a 10 percent change. The project
complies with all relevant development standards of the Zoning Code, General Plan, the Mello
II of the Local Coastal Program and the Mitigated Negative Declaration, Mitigation Monitoring
and Reporting Program and Addendum. The proposed changes in bedroom count are within and

under the 10 percent standard, and results in a larger number of three-bedroom affordable
units, supporting inclusionary housing and General Plan Housing Goals for a mix of unit types.
5) That the proposed revision maintains, in their entirety, all the project conditions required as part
of the authorizing discretionary action as approved by the City Council on May 4, 2021 and the
California Coastal Commission on October 12, 2022.
6) That the proposed revision is consistent with the previously evaluated environmental findings and
will not result in any significant environmental impact, and/or require further environmental
review in that the modifications proposed to the architecture, square footage, parking, lot
coverage and the number of bedrooms for the inclusionary housing units, are within the scope
of the Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program and
Addendum for the West Oaks project, approved by the City Council on May 4, 2021. No new
environmental impacts are associated with the proposed minor modifications to the project;
therefore, further environmental review is not required.
7) That the proposed revision is consistent with the standards set forth in the Village and Barrio
Objective Design Standards or the Citywide Objective Design Standards, as applicable, in that the
project site is not located within the Village and Barrio Master Plan and the West Oaks project
was approved by the City Council on May 4, 2021, prior to the adoption of the Citywide Objective
Design Standards on August 9, 2023. Therefore, this finding is not applicable.
Therefore, the Assistant Director of Community Development has determined that the application
qualifies for a substantial conformance with the approved permit and approves the changes to the project
pursuant to CMC Section 21.89.060.

NOTICE
Please take NOTICE that approval of your project includes the "imposition" of fees, dedications,
reservations, or other exactions hereafter collectively referred to for convenience as "fees/exactions."
You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you
protest them, you must follow the protest procedure set forth in Government Code Section 66020(a) and
file the protest and any other required information with the City Manager for processing in accordance
with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any
subsequent legal action to attack, review, set aside, void, or annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT
APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other
similar application processing or service fees in connection with this project; NOR DOES IT APPLY to any
fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute
of limitations has previously otherwise expired.
APPEAL NOTICE
This decision may be appealed by you or any other member of the public to the Planning Commission
within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division
at 1635 Faraday Avenue in Carlsbad, along with a payment of $952. The filing of such appeal within such
time limit shall stay the effective date of the order of the City Planner until such time as a final decision
