A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ADOPTING THE REVISED PLANS, SPECIFICATIONS AND
CONTRACT DOCUMENTS, ACCEPTING THE BIDS AND AWARDING A
CONTRACT TO PALM ENGINEERING CONSTRUCTION COMPANY, INC. FOR
THE CONSTRUCTION OF THE PONTO SEWER MANHOLE REHABILITATION
PROJECT IN AN AMOUNT NOT TO EXCEEED $433,300
WHEREAS, the City Council of the City of Carlsbad, California has determined it is necessary,
desirable and in the public interest to rehabilitate the Ponto sewer manholes or access holes, Capital
Improvement Program, or CIP, Project No. 5503-17, or Project; and
WHEREAS, on March 24, 2026, the City Council adopted Resolution No. 2026-061, adopting the
plans, specifications and contract documents and authorizing the City Clerk to advertise for bids to
construct the Project; and
WHEREAS, the plans, specifications and contract documents were revised in response to bidder
questions, and an addendum was issued on April 10, 2026; and
WHEREAS, on April 24, 2026, staff received two bids in response to the bid advertisement; and
WHEREAS, staff found the lowest bid submitted by Palm Engineering Construction Company,
Inc. in an amount not to exceed $433,300 to be responsive; and
WHEREAS, staff determined that Palm Engineering Construction Company, Inc. is a responsible
bidder in that it has successfully performed similar projects for other agencies; and
WHEREAS, Carlsbad Municipal Code Section 3.28.040(C)(5) authorizes the City Manager or
designee to approve change orders in an amount equal to the contingency set at the time of contract
award, which is $87,000; and
WHEREAS, there are sufficient funds available in the CIP Project No. 5503-17 budget to
complete construction of the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the Planning Commission adopted Resolution Nos. 7538 and 7539, on March 19,
2025, approving the project initial study/mitigated negative declaration and mitigation
monitoring and reporting plan for Site Development Permit SDP2024-0014, Coastal

Development Permit CDP 2024-0019, Habitat Management Permit HMP-2024-0007 and
finding consistency with the initial study/mitigated negative declaration.
3.That the City Council adopts the revised plans, specifications and contract documents
for the Ponto Sewer Manhole Rehabilitation Project, CIP Project No. 5503-17.
4.That the bid in an amount not to exceed $433,300 submitted by Palm Engineering
Construction Company, Inc., is accepted, and the Mayor is hereby authorized to execute
a contract.
5.That the City Manager or designee is authorized to approve construction change orders
up to $87,000 for CIP Project No. 5503-17.
6.That the City Manager or designee is authorized to sign all other documents necessary
for regulatory compliance, to extend funding opportunities, or to otherwise implement
and finalize the project, all of which are subject to review and approval as to form by
the City Attorney’s office.
7.That the award of this contract is contingent upon Palm Engineering Construction
Company, Inc. executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within 20 calendar days after adoption
of this Resolution. The City Manager may grant reasonable extensions of time to execute
the contract and assemble the required bonds and insurance policies.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City
of Carlsbad on the 19th day of May, 2026, by the following vote, to wit:
AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin.
NAYS: None.
ABSTAIN: None.
ABSENT: None.
