HomeMy WebLinkAboutPRE 2026-0031; 160 & 172 SEQUOIA AVENUE - SB 330; Admin Decision LetterMay 21, 2026 Jonathan Frankel 5315 Avenida Encinas, Suite 200 Carlsbad, CA 92008 {city of Carlsbad SUBJECT: PRE 2026-0031 (DEV2026-0048) -PRELIMINARY HOUSING DEVELOPMENT (SB-330) PRE-APPLICATION -160 & 172 SEQUOIA AVENUE APN 206-011-09-00, 206-011-10-00 Dear Mr. Frankel, The Planning Division is in receipt of the Senate Bill 330 (SB-330) preliminary housing development pre­ application for the 160 & 172 SEQUOIA AVENUE project, application no. PRE 2026-0031, submitted on April 22, 2026. The 160 & 172 SEQUOIA AVENUE project, consisting of demolition of two single-family residences, consolidation of two existing parcels, and construction of four three-story condominium units qualifies as a housing development project pursuant to paragraph (2) of subdivision (h) of Section 65589.5 of the Government Code. City staff has determined the items submitted with the subject SB-330 preliminary housing development pre-application satisfy the requirements pursuant to Government Code Section 65941.1. The preliminary application is therefore "deemed submitted" as of April 22, 2026. As such, pursuant to Government Code Section 65589.5, the 160 & 172 SEQUOIA AVENUE project shall be subject only to the ordinances, policies, and standards adopted and in effect as of March 3, 2026. Pursuant to Government Code Section 65941.1, the city looks forward to the submittal of the development application consistent with Sections 65940, 65941, and 65941.5 within 180 calendar days from the "deemed submitted" preliminary application date of April 22, 2026, or no later than October 19, 2026.
