HomeMy WebLinkAboutSDP 2023-0009; MAPLE DUPLEX - 1ST EXTENSION; Admin Decision Letter Community Development Department Planning Division  1635 Faraday Avenue  Carlsbad, CA 92008  442-339-2600 May 28, 2026 Rachael Petelski 147 Maple Avenue Carlsbad, CA 92008-3264 SUBJECT: SDP 2023-0009/CDP 2023-0017 (DEV2023-0059) – MAPLE DUPLEX – 1ST EXTENSION The Planning Division has completed its review of your application for the first extension of Site Development Plan SDP 2023-0009 and Coastal Development Permit CDP 2023-0017, submitted on April 29, 2026. The approved project, consisting of the demolition of an existing duplex and the construction of a new 11,047-square-foot, three-story duplex with subterranean parking and attached storage, is located at 147 and 149 Maple Avenue in the Mello II Segment of Coastal Zone. The project was approved on May 1, 2024, and due to expire on May 1, 2026. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Coastal Development Permit regulations, and (3) that the findings required for granting a Site Development Plan and Coastal Development Permit extension can be made; therefore, the City Planner APPROVES the first extension Site Development Plan SDP 2023-0009 and Coastal Development Permit CDP 2023-0017 for two (2) years from May 1, 2026 to May 1, 2028, based on the following findings and conditions. Findings: 1. All of the findings contained in the Planning Commission Resolution No. 7512 dated May 1, 2024 for Site Development Plan SDP 2023-0009 and Coastal Development Permit CDP 2023-0017, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the first two-year extension from May 1, 2026 to May 1, 2028 is appropriate because the project is still consistent with the Site Development Plan and Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for the demolition of an existing duplex and the construction of a new 11,047-square-foot, three-story duplex with subterranean parking and attached storage. 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 4. That the City Planner has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303(b) – New Construction or Conversion of Small Structures of the State CEQA Guidelines and will not have any adverse significant impact on the environment. {'city of Carlsbad PRE 2026-0025 (DEV2026-0043) – 4380 HIGHLAND REMODEL May 28, 2026 Page 2 Conditions: 1. This first extension of Site Development Plan SDP 2023-0009 and Coastal Development Permit CDP 2023-0017 is granted from May 1, 2026 to May 1, 2028. If building or grading permits for this project are not obtained within this time, the Site Development Plan and Coastal Development Permit will expire on May 1, 2028, unless extended pursuant to Section 21.201.210 of the Carlsbad Municipal Code. 2. All the conditions contained in Planning Commission Resolution No. 7512 dated May 1, 2024 for Site Development Plan SDP 2023-0009 and Coastal Development Permit CDP 2023-0017 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 9 which is superseded by Condition No. 1 of this Site Development Plan and Coastal Development Permit extension approval letter.
