The construction, addition, or alteration of buildings is governed by the California Contractors License Law
(commencing with Business Professions Code section 7000). The law has an exemption that allows a person
who is not a California Licensed Contractor to construct a single-family residential structure and engage in
home improvements and repairs, provided they meet certain requirements. (Form B-61 provides information
about the requirements that apply to Owner-Builders makes you aware of your responsibilities and possible
risk you may incur by having a permit issued to an Owner-Builder.) Permits for multi-family projects are only
to be issued to California Licensed Contractors. Refer to Form B-16 for other frequently asked questions.

within one year from the application date (original filing date), unless an extension of time has been
granted (Form B-25). With some limited exceptions, if a building permit application expires and there
is interest in proceeding with the same project, a new application will be required and the project will
be subject to new fees and regulations that are in effect at the time the new application is submitted.
After submitting the application, the Billing Party designated as part of the application will be sent
future city invoices for above referenced building permit(s). I understand that if a permit fee or
development impact fee refund is issued, the check will be mailed to the financial responsible party
(the actual person or company that paid the invoice). If the information on file for the financially
responsible party is outdated or inaccurate, it must be corrected before the refund can be sent. Form

appointed officials, employees, volunteers and agents (the "Indemnified Parties") from all claims and

purpose of which is to challenge, attack set aside, void, modify, or annul the approval or denial of the
application, or the processing thereof, except liability caused by the Indemnified Parties' sole
negligence or willful misconduct, in which case the indemnity received by the city shall be reduced by
the amount: (a) that the city's active negligence contributed to the liability on a comparative basis; or
(b) such other amount as may be required by law. This obligation is effective without reference to the
existence or applicability of any insurance coverages which may have been required by city or any
additional insured endorsements which may extend to Indemnified Parties. Property Owner(s) and
Applicant, on behalf of themselves and all parties claiming under or through them, waive all rights of
subrogation and contribution against the Indemnified Parties while acting within the scope of their

~I understand a frequent practice of unlicensed persons is to have the Property Owner obtain an
"Owner-Builder" building permit that erroneously implies that the Property Owner is providing his or
her own labor and material personally. I, as an Owner-Builder, may be held liable and subject to
serious financial risk for any injuries sustained by an unlicensed person and his or her employees while
working on my property. My homeowner's insurance may not provide coverage for those injuries. I

am willfully acting as an Owner-Builder and am aware of the limits of my insurance coverage for
injuries to workers on my property.
I understand building permits are not required to be signed by a Property Owner unless the Property
Owner is responsible for the construction and are not hiring a Licensed Contractor to assume this
responsibility.
I understand as an "Owner-Builder" I am the responsible party of record on the permit. I understand
that I may protect myself from potential financial risk by hiring a Licensed Contractor and having the
permit filed in his or her name instead of my own .
I understand Contractors are required by law to be licensed and bonded in California and to list their
license numbers on permits and contracts.
I understand if I employ or otherwise engage any persons, other than California Licensed Contractors,
and the total value of my construction is at least five hundred dollars ($500), including labor and
materials, I may be considered an "employer" under State and Federal law.
I understand if I am considered an "employer" under State and Federal law, I must register with the
State and Federal government, withhold payroll taxes, provide workers' compensation disability
insurance, and contribute to unemployment compensation for each "employee." I also understand my
failure to abide by these laws may subject me to serious financial risk.
I understand under California Contractors' State License Law, an Owner-Builder who builds single
family residential structures cannot legally build them with the intent to offer them for sale, unless all
work is performed by Licensed subcontractors and the number of structures does not exceed four
within any calendar year, or all ofthe work is performed under contract with a licensed general

liable for any financial or personal injuries sustained by any subsequent owner(s) that result from any

Internal Revenue Service, the United States Small Business Administration, the California Department
of Benefit Payments, and the California Division of Industrial Accidents. I also understand I may

Licensed Contractors are regulated by laws designed to protect the public. I understand if I contract
with a person who does not have a license, the Construction Industry Licensing Board, the Department
of Business and Professional Regulation and the Building Department may be unable to assist me with
any financial loss that I sustain as a result of a complaint. I understand my only remedy against an
unlicensed person may be in civil court. I also understand that, if an unlicensed person or employee of
an individual or firm is injured while working on my property, I may be held liable for damages. If I
obtain an Owner-Builder permit and wish to hire a Licensed Contractor, I will be responsible for
verifying whether the Contractor is properly licensed and the status of the Contractor's workers'

Assembly Bill 2335 amended California Health and Safety Code Section 19825 and added new application
requirements to enhance consumer awareness and protection. Did you know-unlicensed persons
frequently have the property owner obtain an "Owner-Builder" building permit which erroneously implies
that the Property Owner is providing his or her own labor and material personally? Moreover, your
homeowner's insurance may not provide coverage for injuries sustained on your property by an unlicensed
person and his/her employees. If you are considered an "employer" under State and Federal law, you must
register with the State and Federal government, withhold payroll taxes, provide workers compensation and
disability insurance, and contribute to unemployment compensation for each "employee."

Please be advised, all unpermitted work is considered new and shall comply with the most recent code.
Separation between dwelling units is required. The following comments apply per CRC R302.3:
o Dwelling units in two-family dwellings shall be separated from each other by wall having not
less than a I-hour fire-resistance rating when tested in accordance with ASTM E 119 or UL
263 or CBC 703.2.2.
PC3: The common walls and floors are required to have a have an STC rating of 50
minimum per CBC 1206.2 and CBC 1206.3. Please show on the detail provided.
o Revise the plan to show a I-hour fire-resistive assembly between the two units. Provide
construction details with a basis of approval (i.e., UL design#, G.A.file #).
PC3: The basis of approval for the 1-hr fire-rated wall provided is based on the 2012 /BC.

This checklist is intended to help building permit applicants identify which Climate Action Plan (CAP) ordinance requirements
apply to their project. This completed checklist (B-50) and summary (B-55) must be included with the building permit
application. The Carlsbad Municipal Code (CMC) can be referenced during completion of this document.
NOTE: The following type of permits are not required to fill out this form

The B-50 checklist was originally developed several years ago to support implementation of the CAP. Recent updates to
the California Building Standards Code have imposed newer performance standards on building permit applications.
Therefore, the applicant is advised to review all applicable code sections and apply the maximum performance standard,
which may exceed the CAP consistency checklist requirements
Consultation with a certified Energy Consultant is encouraged to assist in filling out this document. Appropriate
certification includes, but is not limited to: Licensed, practicing Architect, Engineer, or Contractor familiar with Energy
compliance, IECC/HERS Compliance Specialist, ICC GB Energy Code Specialist, RESNET HERS rater certified, certified
