RESOLUTION NO. 2026-113 .
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, DIRECTING THE CITY MANAGER TO PROCEED WITH FINAL
DESIGN, ENVIRONMENTAL REVIEW AND PERMITTING FOR THE TERRAMAR
AREA COASTAL IMPROVEMENTS PROJECT TO INCLUDE ROAD RESURFACING
AND RESTRIPING WITH NO SIDEWALKS ON CARLSBAD BOULEVARD AND TO
CONSIDER A POTENTIAL SECONDARY PROJECT FOR THIS AREA AFTER THE
SEASIDE TRANSACTION AGREEMENT IS COMPLETED
WHEREAS, the City Council of the City of Carlsbad, California has determined that it is necessary,
desirable, and in the public interest to make improvements on Carlsbad Boulevard and Cannon Road
within the limits of the Terramar Area Coastal Improvements Project, Capital Improvement Program,
Project No. 6054; and
WHEREAS, on Oct. 28, 2025, the City Council reviewed three options and selected the option to
proceed with a smaller-scale project consisting of certain roadway and sidewalk improvements with
resurfacing and restriping on Carlsbad Boulevard and Cannon Road within the project limits, and no
roundabout and no lane reductions for the project; and
WHEREAS, consistent with the City Council’s action, staff prepared conceptual designs and
conducted public engagement from mid-March to early April 2026 to invite community feedback on
the proposed sidewalk, pavement, parking and striping improvements within the project area; and
WHEREAS, hundreds of community members participated in the process; and
WHEREAS, conceptual design options for the project were presented to the Traffic Safety &
Mobility Commission for its feedback and recommendations on April 6, 2026; and
WHEREAS, the commission recommended that the City Council proceed with resurfacing and
restriping with no sidewalks on Carlsbad Boulevard and consider a potential secondary project for this
area after the Seaside Transaction Agreement with Cabrillo I LLC (a subsidiary of NRG Energy) and San
Diego Gas & Electric is completed; and
WHEREAS, the Seaside Transaction Agreement is a final negotiated settlement agreement that
includes a land transfer to the city for the area north of Cannon Road on the east side of Carlsbad
Boulevard, immediately north of the Terramar project area. The approval process and fulfillment of the
obligations of this agreement is expected to take approximately five to seven years after the effective
date of the agreement, April 16, 2025; and

WHEREAS, on June 9, 2026, the City Council reviewed options for sidewalks, pavement, parking
and striping improvements in the project area and selected the option to direct the City Manager to
proceed with final design, environmental review and permitting for the project that will include road
resurfacing and restriping with no sidewalks on Carlsbad Boulevard and consider a potential secondary
project for this area after the Seaside Transaction Agreement is completed; and
WHEREAS, sufficient funding has been appropriated in the project account.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the City Council has determined that the proposed action is not a “project” as
defined by the California Environmental Quality Act, or CEQA, Section 21065 and CEQA
Guidelines Section 15378(b)(5) and does not require environmental review under CEQA
Guidelines Section 15060(c)(3) and 15061(b)(3), because the proposed action of the City
Council providing direction on improvements within the project area is an
administrative government activity that does not involve any commitment to any
specific project which may result in a potentially significant physical impact on the
environment. Any subsequent action or direction stemming from the proposed action
may require preparation of an environmental document in accordance with CEQA or the
CEQA Guidelines.
3.That the City Council directs the City Manager to proceed with final design,
environmental review and permitting for the Terramar Area Coastal Improvements
Project, CIP Project No. 6054 to include road resurfacing and restriping with no
sidewalks on Carlsbad Boulevard and consider a potential secondary project for this area
after the Seaside Transaction Agreement is completed.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City
of Carlsbad on the 9th day of June, 2026, by the following vote, to wit:
