After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the findings required for allowing the parking of a recreational vehicle in the front yard setback can be made and therefore APPROVES the request, based on the following findings Findings: 1. That parking in or access to the side or rear yard WILL require structural alteration to the existing residence or will require the removal of significant or unique landscaping in that the southern side yard is 9.5 feet and the northern side yard is 7.5 feet, both of which are narrower than the 11-foot width of the r~creational vehicle. Additianally, a water meter and an eave of the house protrude two feet into the southern side yard and a chimney protrudes almost two feet into the northern side yard, all of which further restrict movement through the side yards. 2. That parking of the recreational vehicle in the front yard WILL NOT interfere with visibility to or from any street in that the property is on a flag-shaped lot and the proposed parking space is not visible from the street. 3. That allowing the recreational vehicle in the front yard WILL NOT interfere with traffic on the street or encroach into the street and utility right-of-way or interfere with visibility to or from any street in that the property is over 150 feet from Valley Street and the proposed parking space is not visible from the street. 4. That the recreational vehicle WILL NOT preclude access to the garage in that the proposed parking space is more than five feet north of the garage and the driveway that accesses it. 5. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not. have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15305 (a), Minor lot line adjustments, side yard, and set back variances not resulting in the creation of any new parcel, of the state CEQA Guidelines. Conditions: 1.-Approval is granted for AV 08-02 as shQwn on Exhibits "A", dated August 11., 2008; on file in the Planning Department and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $598.50. The filing of such appeal within such -time limit shall stay the effective date of the order of the Planning· Director until such time as a final decision on the appeal is reached.
